HomeMy Public PortalAbout2871-1974 - Zoning - Specail Use - Restaurant - 2440 Williamsburg PikeORDINANCE NO. 2871-1974 AN ORDINANCE AUTHORIZING A "SPECIAL USE" FOR A RESTAURANT AT 2440 WILLIAMS- BURG PIKE, IN AN M-2 GENERAL INDUSTRIAL DISTRICT OF ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, APPROVED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. As provided in Article 35, Section 35.011, and Article 34, Sec- tion 34.013 and Article 48, of Ordinance No. 2325-1968, commonly known as the Zoning Ordinance of the City of Richmond, Indiana, the following described real estate is allowed as a Special Use for a restaurant located at 2440 Williamsburg Pike, in the City of Richmond, Indiana; more particularly described; to -wit: Part of the Southwest Quarter of Section 19, Township 14 North, Range 1 West, in Wayne County, Indiana, more particularly described as follows: Beginning at a point in center line of a thirty-six (36) foot driveway three hundred thirty-three and thirty hundredths (333.30) feet west and six hundred thirty- nine and eighty-five hundredths (639.85) feet north of the southeast corner of the Southwest Quarter of Section Nineteen (19), Township Fourteen (14) North, Range one (1) West, the said point being one hundred twenty-four (124) feet west of center line of State Road No. 38; thence west on center line of said driveway one hundred twenty (120) feet; thence south at right angles seventy-eight and thirty hundredths (78.30) feet; thence east one hundred twenty (120) feet; thence north seventy- eight and thirty hundredths (78.30) feet to place of beginning. ALSO, a part of the southwest quarter of section 19, township 14 north, range 1 west in Wayne County, Indiana, described as follows: Beginning 961.3 feet east of an established concrete monument in the center of a driveway 36 feet wide which monument is 1294.6 feet west and 639.85 feet north of the southeast corner of said quarter section; thence north of the center line of said driveway 124 feet to the center line of Indiana State Highway No. 38: thence south 35 degrees east along said center line 95.58 feet; thence west 178.8 feet; thence north 78.3 feet of the place of beginning. ALSO, a part of the Southwest Quarter of Section Nineteen (19), Township Fourteen (14) North, Range One (1) West, described as follows: Beginning at a point in the center line of Indiana State Road Number 38 which is six hundred thirty-nine and eighty- five hundredths (639.85) feet north and two hundred nine and three tenths (209.3) feet west of the southeast corner of said Quarter Section, thence south thirty-five (35) degrees east along said center line ninety-five and fifty-eight hundredths (95.58) feet to the true place of beginning of this description; from said beginning point running thence west two hundred twenty (220.0) feet, thence south thirty-eight (38.0) feet, thence east two hundred forty-six and fifty-eight hundredths (246.58) feet to the center line of said Indiana State Road Number 38; thence north thirty-five (35) degrees west, along the center line of said road, forty-six and thirty-nine hundredths (46.39) feet to the place of beginning. ORDINANCE NO. 2871-1974 SECTION 2. As a condition of the aforesaid Special Use and an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any person, firm or corporation using such real estate: ( No conditions or restrictions were added.) SECTION 3. The Zoning Administrator of the City of Richmond, Indiana, is hereby authorized and directed, upon enactment and publication of this ordinance, to record and approve the issuance of a permit for the establishment of the use herein allowed. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor, and publication as by law required.
