MINUTES OF THE BOARD OF SELECTMEN REGULAR SESSION MEETING
DATE: January 5, 2009
TIME: 7:00 P.M.

Call to Order
Chairman Norton called the meeting to order at 7:00 pm

Chairman Norton said Happy New Year and stated it will be a challenging year.
Meet & Greet Sue Leven, Town Planner
Charlie stated a lot of credit should go to Ed Lewis for forming the Committee under the
guidance of the Board of Selectmen. There were 22 applicants and Sue fit the needs for
Brewster. She has a lot of Cape experience and served as Town Planner of Eastham and
Harwich.
Sue introduced herself and gave a brief background of her qualifications. She has a
Bachelors in historic preservation, Masters in landscape architecture, started her planning
career in the city of New York at the Manhattan office for the Dept of City Planning. She
came to the Cape in 1992, ran 2 restaurants in Provincetown then worked on the Planning
Board in Provincetown before moving onto the Planning Dept in Eastham then Harwich.

Selectmen Lewis moved the minutes of October 20, 2008. Selectmen Levasseur second.

Chairman Norton read the notice. Selectman Levasseur moved to approve the switch in
location as presented and requested. Selectman Lewis second. The Board voted 5-Yes 0-
No.
Department of Public Works Solid Waste Fees -Public Hearing Bob Bersin
Bob Bersin compared the cost between Yarmouth and SEMASS based on trips per year. He
handed the Board of Selectmen sheets with all the direct and indirect costs. The total annual
indirect cost is $414,000. The SEMASS total cost per year is $729,237. Yarmouth is a little
more expensive and would charge us an additional $30 per ton. He said Neil Andrade; the
Director of Eastham called local towns and got their residential sticker fees. They are:
Brewster $85, Chatham $110, Harwich $105, Orleans $75 and Eastham $70. They talked
about commercial haulers and Ralph Ingeneri asked why do the commercial haulers bring
trash here and not to SEMASS? Chairman Norton said that was a good point and we`ll need
to revisit this subject.
Crosby Lane Road Drainage Reconstruction Proiect Public Hearing Bob Bersin &
Russell Kleekamp of Stearns & Wheeler
Selectman Levasseur gave a brief overview. He said Crosby Lane has come under serious
disrepair in the last 20 years and the last time it was repaired it was fixed with tar and
gravel. He said the main aspect is to protect an asset, which is a public road, make it safe
to travel on and have safe passage to a public beach. He also said Stearns and Wheeler
will need to go to the Planning Board and the Conservation Commission to get all the
permits in place and if all goes well, we'll be looking for construction money at spring
Town Meeting. He also asked the Board to contact the Commonwealth of Mass to partner
up to finally bring forward a public project which is public access to Bayside Beach front.
Russ K1eeKamp gave an overview of the proposed project, which included administrative
issues and engineering issues. He said they are basically looking to improve 3 major
areas, which include the drainage, the condition of the road and the safety improvements.
They'll put a crown on the road, which slopes off the 2 berms. He said by the parking
area at the end of Crosby there is a lot of untreated storm water run off entering the
wetland area, which is a fairly major source of storm water pollution. By putting these
drainage structures in we greatly reduce the amount of untreated storm water entering the
wetland areas. Once that is done, he said they will work on the road reconstruction. They
take the machine and grind up the existing pavement and compact it for asub-base and
place a new pavement on top of it. He said this is good because it recycles the existing
base. It should last 20 years if not 40 to 50 years.
Selectman Lewis asked if there were any chapter 90 funds available for this. Mr. Sumner
stated he and Bob Bersin are in the process of analyzing some projects and this would be
a combo of chapter 90 and town revenues. They took comments from the public. One
concern was rate of speed on the road after it gets widened. Chief Koch assured them that
it shouldn't be a problem and he will do enforcement and follow up on it.

Selectman Levasseur moved to approve action items 1-4 as recommended. Selectman
Cooney second. The Board voted 5 -Yes 0-No.

Selectman Cooney stated she would like a copy of "Y" Underpass Road Affordable
Housing Feasibility Analysis Report.
Selectman Lewis stated "BB"Letter from Chief Koch in response to Mr. Thomas
Brennan's Letter, re: traffic on Stony Brook Road, is a nice letter and shows the hard
work the Chief has done.
Liaison
Selectman Lewis said he and Mr. Sumner will be going to the Board of Health meeting
tomorrow night where there will be a discussion regarding a regulation regarding sand and
gravel.
Selectman Lewis said there will be a Captain's Golf Men's Association meeting tomorrow
at 1:00 pm at Brewster Ladies Library.
Selectman Foley said the Golf Commission is meeting tomorrow at 1:00 pm at the Golf
Course for further discussion on things that are going on at the Golf Course.
Selectman Foley said Financial Committee said they are starting their work on budgets
and financial issues this Wednesday night and asked him to be there. He said he will
attend.
Chairman Norton said he would like the Board to complete the evaluations for Charlie,
Chief Koch, Roy Jones and Mark O'Brien,
Any Other Business
Selectman Cooney asked if the Water Department has a certificate of occupancy yet. Mr.
Sumner said No; they have a meeting scheduled for next week with the contractor and
architect to go over the remaining punch list issues that are holding up the final
occupancy.
Selectman Cooney said several people have asked her about the job classifications that we
are trying to get revised. She wanted to know where that stands. Mr. Sumner said he,
Greg, Ed and Jillian have a meeting with 5 employees who have questions and concerns
next Monday.
Selectman Levasseur said he'd like a discussion about the comment he made earlier
regarding access to the beach property. Chairman Norton said we should contact Rick
Sullivan from DCR and invite him for it. Selectman Levasseur said he has a call in to a
gentleman who has a copy of the 1985 master plan for the property and he'll drop it off to
him shortly. He said he thinks they should contact Senator O'Leary and Cleon Turner and
anyone else to see if they can get us public access.
Selectman Lewis said he thinks prior to a public hearing, the Board should have all
information in front of them so they can know in advance what is going on.
Mr. Sumner said there was a memo from the Lieutenant Governors office saying they are
looking for projects that will jump start economic development. He said he has a lot of
ideas and he'll review them but the only caveat is that they have to be ready within 180

days. The list includes: Solar panels on the golf cart shed, Eddy School roof replacement,
HVAC at Eddy School, Boiler replacement at Stony Brook School, School building
security, HVAC for Town Hall, Insulation at COA, Tennis courts, Fire Station project and
Stony Brook Millsite.

negotiations and not return to open session. Selectman Levasseur second. The Board
voted 5 -Yes 0-No.

BREWSTER BOARD OF SELECTMEN
MEETING OF JANUARY 5, 2009
ACTION ITEMS
1. Request - Candleberry Inn would like to have permission to have a
common victualler license. They would like to serve tea, scones, fruit and
a variety of desserts on a limited basis year round.
ADMINISTRATIVE RECOMMENDATION
We recommend the Board vote to approve this request pending approval
of the Health and Zoning.
2. Appointment of Officer Michael R. Mei for a fifth one-year term
beginning January 16, 2009 and ending January 15, 2010 and Officer
Joseph M. Mashrick for a third one-year term beginning January 21,
2009 ending January 20, 2010 as Police Officers and "Keepers of the
Lockup".
ADMINISTRATIVE RECOMMENDATION
We recommend the Board vote to sign these appointments.
3. Approval/Support to send a letter requesting the support and
help from Representative Turner and Senator O'Leary for the net school
spending at Cape Cod Tech.
ADMINISTRATIVE RECOMMENDATION
We recommend the Board approve and sign the attached letters to be
sent to Representative Turner and Senator O'Leary.
4. Nominate -MIIA is calling on its member to participate in electing
officials to serve on the Massachusetts Interlocal Insurance Association,
Inc. Board of Directors.
ADMINISTRATIVE RECOMMENDATION
The Board to let the Town Administrators office know if they would like
to nominate anyone and we will send the paperwork to MIIA.
