HomeMy Public PortalAbout2887-1974 - Zoning - 1400 &1408 National Road West - R-2 to C-2ORDINANCE NO. 2887-1974 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325- 1968 designates and describes as R-2 One Family Residence District the fol- lowing described property located at 1400 A 1408 National Road best, in the City of Richmond, Indiana, more particularly describe as follows: Lots # 12, 13, and 14 Earlham Heights SECTION 2. WHEREAS, it is the intent and purpose hereof to change the Zoning Classification of the above described area from R-2 to C-1. SECTION 3. WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 28th day of may , 1974, at which time remonstrances were heard from all parties interested in or affected by this Ordinance. SECTION 4. WHEREAS, the vote of the Richmond City Plan Commission was 8 to 1 in favor of recommending the passage of Ordinance No.-M-1974. NOW THEREFORE: SECTION 5. It is hereby ordained that the zoning classification of the above described property be, and the same is hereby changed to C-1 Neighborhood Business District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. SECTION 6. This Ordinance shall be in full force and effect from and after its passage and publication as by law required. SECTION 7. The original zoning classification of the aforementioned area is hereby rescinded and the zoning classification of this area will be in accordance with Section 2 of this Ordinance. FREEMAN PLANNING DIRECTOR The Richmond City Plan Commission held a public hearing on Tuesday, May 28, 1974, at 7:30 p.m., in the Council Chambers of the Richmond Munici- pal Building, to hear the request of I. V. Bartlemay, 101 South 12th Street, Richmond, Indiana, Frank Otto, Agent, Otto Realty, Inc., 2001 Chester Boulevard, Richmond, Indiana, requesting a rezoning from R-2, One -Family Residential, to C-1, Neighborhood Business, in order to per- mit a restaurant as a special use (special use ordinance to follow at 1400 and 1408 National Road West, Richmond, Indiana. All parties interested in or affected by this request were heard. One (1) person was present at the hearing to speak in opposition. She re- turned at the following meeting with nine (9) names of persons in the area who opposed the rezoning and five (5) names of persons in the area who were in favor of the same. Thirty-two (32) letters were sent to ad- joining property owners and four (4) were returned favorable while one (1) was returned opposed. On Tuesday, June 25, 1974, the Plan Commission voted eight (8) to one (1) to approve the rezoning request and recommend the same to Common Council. Mr. Case voted in opposition to the recommendation.
