AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN A C-1, NEIGHBORHOOD BUSI-
NESS DISTRICT OF ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF RICHMOND, INDIANA, APPROVED JUNE 3, 1968.
BE IT ORDAINED by the Common Council of the City of Richmond, Indiana,
as follows:
SECTION 1. As provided in Article 30, Section 30.012 and more speci-
fically provided in Article 48 of Ordinance No. 2325-1968, commonly
known as the zoning ordinance of the City of Richmond, Indiana, the
following described use of the following described real estate is
allowed as a Special Use for a restaurant located at 1400 & 1408
National Road West in the City of Richmond, Indiana, more particularly
described; to -wit:
Lots No. 12, 13 and 14, Earlham Heights Addition.
SECTION 2. As a condition of the aforesaid Special Use and as an
additional restriction on said use, the following requirements shall
hereafter and at all times be met by the owner, leasee or any person,
firm or corporation using such real estate.
1. The site plan submitted and referred to as Amended Scheme
No. 2 shall be part of this Ordinance.
2. The green areas on the subject plan shall be landscaped.
3. The two (2) existing trees as denoted on the subject plan
shall be saved.
4. The green area to the north shall be landscaped in such a
manner as to provide a visual buffer consisting of non-
seasonal trees and shrubs and other landscaping techniques
and devices including a fence six (6) feet in height along
the north side.
5. Drainage plans shall be prepared and submitted by the peti-
tioner and approved by the Board of Public Works and Safety
prior to the issuance of an Improvement Location Permit and
such drainage shall at no time drain onto the property across
the alley to the north.
6. New curbs and gutters shall be provided along the west side
of South 14th Street the length of the property.
7. The trash area shall have a solid fence on the north, west
and south sides, and such fence shall be a minimum of six
(6) feet in height.
8. The curb cuts as shown on the site plan shall be the only
curb cuts applied for. The curb cut on National Road
West, at the western -most part of the site, shall, when
the property to the west is developed commercially, be
used as a joint curb cut to service both properties; and
said curb cut shall not be wider than thirty (30) feet
measured at the right-of-way line and the twenty-four
(24) feet of new curb cut shown on the site plan shall be
reduced to a twenty (20) foot maximum. If a curb cut is
given by the Board of Public Works and Safety, a fence
specified by the Board shall be installed by the petitioner
along the western property line, but said fence shall not
be extended beyond the right-of-way line of National
Road West.
SECTION 3. The Zoning Administrator of the City of Richmond, Indiana,
is hereby authorized and directed, upon enactment and publication
of this Ordinance, to record and approve the issuance of a permit
for the establishment of the use herein allowed.
SECTION 4. This Ordinance shall be in full force and effect from
and after its passage and approval by the Mayor, and publication as
by law required.
PASSED AND ADOPTED by the Common Council of the City of Richmond,
Indiana, this 3rd day of September, 1974.

hearings. Four copies of this petition are
to be filed with the Director of Planning.
Petitions shall be accompanied by the
necessary plats which show building site
and structures. A legal description is
also necessary.
