HomeMy Public PortalAbout2890-1974 - Zoning - Special Use - 600 SW 15th StORDINANCE NO. 2890-1974 AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN A R-2 ONE -FAMILY RESIDEJ- TIAL DISTRICT OF ORDINANCE NO. 2325-1968, COt41ONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, APPROVED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indi- ana, as follows: SECTION 1. As provided in Article 20 and carried forth to Article 21 and more particularly described in Article 45 and Article 48, of Ordinance No. 2325-1968, commonly known as the Zoning Ordinance of the City of Richmond, Indiana, the following described use of the following described real estate is allowed as a Special Use for Residential Development Unit Project including a park located at 600 S.W. 15th Street (Tract Entrance), in the City of Richmond, Indiana; more particularly described•, to -wit: Being a part of the Southwest Quarter of Section Six (6), Township Thirteen (13) North, Range One (1) West, in the City of Richmond, Indiana, and being more particularly described as follows: Beginning at the southeast corner of Pine Manor Estates Sub -Division First Addition, as recorded in Plat Book 9, Page 155, in the Records of the Wayne County Indiana Recorder, said southeast corner being five hundred twelve and fifty-nine hundredths (512.59) feet east and one thousand fifty-two (1052) feet south of the northwest corner of the Southwest quarter of Section Six (6) and running thence from said beginning point,north zero (0) degrees and twelve (12) minutes east, along the east line of said Pine Manor Estates Sub -division, First Addition, five hundred ninety-two (592) feet to the southwest corner of Sutton Place Addition, as recorded in Plat Book 5, Page 146, in the records of said Wayne County Recorder; thence east, along the south line of said Sutton Place Additon, and along the south line of J.D. Baird`s Re -Subdivision of Lots in Sutton Place, as recorded in Plat Book 7, Page 117, in the records of said Wayne County Recorder, a distance of six hundred fifty-four and fifty hundredths (654.50) feet; thence south zero (0) degrees and thirty-six (36) minutes east, and along an established fence line, five hundred sixty- one and fifty-three hundredths (561.53) feet to a point on the north right-of-way line of the former Evansville and Richmond Railroad; thence south eighty-seven (87) degrees and twenty-one (21) minutes west, along said north right-of-way line, six hundred sixty-three and nine hundredths (663.09) feet to the place of beginning, together with the north half of the former Evansville and Richmond Railroad, said above described tract of land containing 9.30 acres of land, more or less. SECTION 2. As a condition of the aforesaid Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any person, firm or corporation using such real estate. 1. The street (continuation of South West 15th Street) shall be dedicated to the City upon construction in accordance with the Richmond Subdivision Ordinance. 2. The utilities shall be placed underground. 3. The plans submitted and filed in the Plan Commission File No. 74-5 shall be both the preliminary and final plans and the development shall be in conformance with these plans. 4. The sanitary sewer system shall be approved by the Sanitary District and the storm sewer system shall be approved by the Board of Public Works and Safety. SECTION 3. The Zoning Administrator of the City of Richmond, Indiana, is hereby authorized and directed, upon enactment and publication of this ordinance, to record and approve the issuance of a permit for the establishment of the use herein allowed. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor, and publication as by law required.
