HomeMy Public PortalAbout2894-1974 - Appropriation - From tjhe Federal Revenue Shariong Trust Fund for necessary Capital ExpendituresORDINANCE NO. 2694-1974 AN ORDINANCE TO APPROPRIATE SIXTY THOUSAND DOLLARS ($60,000.00) FROM THE FEDERAL REVENUE SHARING TRUST FUND, FOR CERTAIN ORDINARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAI4S OF THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND, INDIANA. WHEREAS, the State and Local Fiscal Assistance Act of 1972, Title I of Public Law 92-512 was approved October 20, 1972. WHEREAS, Section 51.40 of P7rt 51, Chapter I, Subtitle B, Title 31 of the Code of Federal, Regulations provides as follows: A recipient government which receives entitlement funds under the Act shall: (c) Provide for the expenditure of entitlement funds in accordance with the laws and procedures appli- cable to the expenditure of its own revenues; WHEREAS, pursuant to the said State and Local Fiscal Assistance the proper legal officers of the City of Richmond, Indiana, have established a trust fund kn^wn as the FEDERAL REVENUE SHARING TRUST FUND, WHEREAS, revenues are available in said trust fund to be used for certain ordinary and necessary capital expenditures. WHEREAS, there is a need fcr funds for certain ordinary and neces- sary capital expenditures as authorized by law, and WHEREAS, moneys are now needed to construct llth Street from Rich Road to N.14. "L" in the tlorth:vest Industrial section of Richmond, Indiana, and WHEREAS, certain ext;-a,rdiaary emergencies have developed since the adoption of the existing annual budget so that it is now necessary to appropriate m re money for the various functions of the City Government ;;c.s--ppropriated in the annual budget; NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA: SECTION l.That for the exE=n�-es of the City Government and its institutions for the year cndioul Dccember 31, 1974, the following amount of money is FC'.cby ,ppropriat,_' ^d set apart out of the Federal Revenue Sh ring Trust Fund for certain ordinary and necessary capital e ,anditures, said s,!m being subject to all laws governing the sera and such amou:t appropriated shall be held to include all expenditures authorized to be made during the ye7.r unless expressly stipulated by law. SECTION 2. That fcr the said fiscal p-;-iod, there is hereby appropriated from ti Fadoval Revenue Sharing Trust Fund for the hereafter enum rated p�:rposes the following snecified amounts to meet the extraor. "L" $60,000.00 $60,000.00 FROM: The Federal Revenue Sharing Trust Fund. SECTION 3. An extraordinary emergency exists for the above appro- priation, and it has been recommended by the City Controller. SECTION 4. This ordinance shall be in full force and effect from and after its passage and approval by the Mayor and is subject to the laws of the State of Indiana governing emergency appropria- tions. Brown Cornett Elstro eler _Fleet an ouse M1 s s , W1 lams s a Absent: nr ShiP1dg The following business was had to -wit: (017HER BUSINESS HAD) The Clerk presented proof of publication of Notice to taxpayers printed in the Richmond Palladium Ite;i, a newspaper of general circulation in the City of Richmond, Indiana, on the dates of May 22 and May 29. 197� Said notices stated that a public hearing would be held on the 3rd day of June , 1974 , by the Common Council. to consider additional appropria- tions as provided for in Ordinance NO. 2894-1974 within the City of Richmond, Indiana. The proof of publication and posting of notices were examined and found to be correct and in order. Councilman Mills moved the proof of publication and posting of notices be received and ordered filed, seconded by Councilman GPi r and on voice vote the motion was carried. The Clerk read on second reading Ordinance No. 2894-1974. Councilman Cornett moved for engrossment of Ordinance No. 2894-1974, seconded by Councilman Mills and on unanimous voice vote the motion was carried. Councilman Geier moved to suspend the rules and readly title only on third reading Ordinance No. 2894-1974, seconded by Councilman Cornett and on a call of the roll the following was recorded: Ayes; Brown, Cornett, Elstro, Geier, Merchanthouse, Mills,Marind,and Williams. Noes; None. The vote being 8-0 in favor of suspension. The Clerk read by title only on third reading Ordinance No. 2894-1974. After hearing all persons present, Ordinance NO. 8-94-1974 was placed on final passage or rejection and on a call of the roll the following was recorded: Ayes: IF Geier , Williams , None , Cornett , , E1stro , Merchanthouse , Mills , Marino , Nayes: f , .
