HomeMy Public PortalAbout2899-1974 - Appropriation - Federal Revenue Sharing Trust Fund - Department of TansportationORDINANCE NO. 2899-1974 AN ORDINANCE TO APPROPRIATE THIRTY THOUSAND, FIVE HUNDRED DOLLARS ($30,500.00) FROM THE FEDERAL REVENUE SHARING TRUST FUND, FOR CERTAIN ORDINARY AND NECESSARY MAINTENANCE AND OPERATING EXPENDI- TURES AND FOR CERTAIN ORDINARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAWS OF THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND, INDIANA. WHEREAS, the State and Local Fiscal Assistance Act of 1972, Title I of Public Law 95-512 was apuroved October 20, 1972, WHEREAS, Section 51.40 of Part 51, Chapter I, Subtitle B, Title 31 of the Code of Federal Regulations provides as follows: A recipient government whicfr receives entitlement funds under the Act shall: (C) Provide for the expenditure of entitlement funds in accordance with the laws and procedures appli- cable to the expenditure of its own revenues; WHEREAS, pursuant to the said State and Local Fiscal Assis- tance, the proper legal officers of the City of Richmond. Indiana, have established a trust fund known as the Federal Revenue Sharing Trust Fund, WHEREAS, revenues are available in said trust fund to be used for certain ordinary and necessary maintenance and operating expenditures and for certain ordinary and necessary capital expenditures, WHEREAS, there is a need for funds for certain ordinary and necessary maintenance and operating expenditures and for certain capital expenditures as authorized by law, and WHEREAS, certain extraordinary emergencies have developed since the adoption of the existing annual budget so that it is now necessary to appropriate more money for the various functions of the City Government than was appropriated in the annual budget; NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHOND, INDIANA: SECTION 1. That for the expenses of the City Government and its institutions for the year ending December 31, 1974, the fol- lowing amount of money is hereby appropriated and set apart out of the Federal Revenue Sharing Trust Fund for certain ordinary and necessary maintenance and ordinary and necessary capital expendi- tures, said sum being subject to all laws governing the same and such amount appropriated shall be held to include all expenditures authorized to be made during the year unless expressly stipulated by law. SECTION 2. That for the said fiscal period, there is hereby appropriated from the Federal Revenue Sharing Trust Fund for the hereafter enumerated purposes the following specified amount to meet the extraordinary emergencies hereby declared to exist: SERVICES PERSONAL Salaries and Wages $22,000.00 For Public Safety, Building Code Enforcement, for Social Services for the poor and aged, and for Financial Administration PROPERTIES Department of Transportation $ 8,500.00 Street Information Signs SECTION 3. An extraordinary emergency exists for the above appropriation, and it has been recommended by the City Controller. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor and is subject to the laws of the State of Indiana governing emergency appropriations. Councilman Marino presided with the following members present: Messrs. Brown Cornett Elstro Geier Merchantfiouse shiMs williclm7' Marino Absent: Mills + , + �t The following business was had to -wit: (OTHER BUSINESS HAD) The Clerk presented proof of publication of Notice to taxpayers painted in the Richmond Palladium Itei, a newspaper of general circulation in he C of Richmond, Indiana, on the dates of June 5 and June 1�Z, 19�� Said notices stated that a public hearing would be held on the I 9tfiday of Jim e , 19_ZL, by the Common Council to consider additional appropria- tions as provided for in Ordinance NO. 2899-1974 within the City of Richmond, Indiana. The*proof of publication and posting of notices were examined and found to be correct and in order. Councilman Geier moved the proof of publication and posting of notices be received and ordered filed, seconded by Councilman _Elstro , and on voice vote the motion was carried. The Clerk read on second reading Ordinance No. 2899-1974. Councilman Brown moved for engrossment of Ordinance No. 2899-1974, seconded by Councilman Geier and on unanimous voice vote the motion was carried. Councilman Geier moved for suspension of the rules and read by title only on third reading Ordinance No. 2899-1974, seconded by Councilman Elstro and on a call of the roll the following was recorded: Ayes; Brown, Cornett, Elstro, Geier, Merchanthouse, Shields, Williams and Marino. Noes; None. The vote being 8 to 0 in favor of suspension. The Clerk read by title only on third reading Ordinance No. 2899-1974. No one appeared against Ordinance No. 2899-1974.
