The house is being sold and the SAS is closer than 300' to a pond. SS did research where they could put it if the system was upgraded and they still wouldn't be able to meet that setback. SS is also requesting that they be allowed to abandon the existing d-box and install a pipe directly from the tank to the pit. Motion: DB-grant variance request to leave SAS in place and to allow the d-box to be abandoned and a pipe from tank to SAS installed. KJ seconded. 4 yes. 2. New food permit application for OKI Japanese Express-foster square Chang Ting Zou would like to open this in an already existing restaurant at foster square. It will be a take out restaurant. NI spoke the owner about going to the other departments for approval and gave him a copy of the inspector's recommendations. Motion: DB-grant permit conditional on meeting all of inspectors recommendations and getting approval from other departments. JR seconded. 4 yes. 3. Minutes from 6/2/09 Motion: JR-approve minutes as written. KJ seconded. 4 yes. 4. Discuss proposed Shared Septic System Regulation Discussion. The Board asked that NI do some investigating into a subdivision in Chatham that was told by the Board of Health to put in a shared system and get back to them. 5. Discuss email from Kyle Parker Mr. Parker handed out a copy of a previous Planning Board decision with regards to Breakwater Lobster & Fish. He would like the Board to reconsider their decision to allow BF & L to have picnic tables. There was discussion on the issue of the counting of picnic tables as actual seats with regards to the size of the septic system. NI went over how the code works and the difference between BF & L and El Quapo's. The Board asked Mr. Parker what he was looking for from them and he stated that he wants the Board to order BF & L to remove the picnic tables. The Board was not amenable to that at this time. The Board ultimately decided to table this discussion until the next meeting on July 7, 2009 so that they can look at more information. Motion: JR-table until July 7, 2009 meeting so that the Board can review more information and possibly reconsider their decision. DB seconded. 4 yes. 6.
