US BOARD OF HEALTH MEETING TUESDAY, AUGUST 11, 2009 AT 7:OOPM TOWN HALL, ROOM A Present: Joanne Hughes, Chairman, James Reynolds, Keith Johnson, Andrew Petty, Nancy Ellis Ice, Health Director and Tammi Mason, Administrative Clerk 1. Ryder &Wilcox-variance request for 112 Governor Prence Road Judy Bersin represented the homeowners. This home is having a septic upgrade for the sale of the home. The following variances are being requested: 1. To allow the SAS to be 14 feet from the cellar wall 2. To allow the SAS to be 5 feet from the street side property line Conservation Commission has already given their approval. Motion: JR-grant variances as requested. AP seconded. 4 yes. Environmentally Sensitive Area conditions apply. 2. J.M. O'Reilly-variance request for 96 Run Hill Road-less than 300' to pond Keith Fernandez represented the homeowner. They will be adding two bedrooms and putting in a new septic system. KF stated that he was only able to keep the SAS 246' from the pond. Motion: AP-grant variance to pond. KJ seconded. 4 yes. 3. Stefan Semple-variance request for 365 Holly Ave-less than 300' to pond No one was present for this hearing. It is a real estate transfer. There is no addition of rooms. Motion: JR-grant variance to pond. AP seconded. 4 yes. 4. Jay Merchant-Sand & Gravel Mining Permit application for 1515 Freeman's Way 4~, Spoke to the Board about the re-vegetation at Cape Sand & Recycling. JM told the Board that FA hasn't been put into place yet. There was discussion on this issue. a'`* ZrJ JR suggested that JM may want to start re-vegetating the flat area. Motion: JR-grant the Sand & Gravel Mining Permit. KJ seconded. 4 yes. -~ 5. Chef Paul's Truffles &Catering-request to add additional items to menu Chef Paul will be adding additional items to his menu. All food is prepackaged and will be sold as retail food. David Burnie-proposed alternative system at 65 Pell's Fishing Road David Burnie and Bob Silva, manufacturer of system were present. This will be an insert in the septic tank. DB told the Board that this septic system was almost in failure and this insert should bring it back into compliance. BS stated that this insert is specifically designed to save a failed system. Daily monitoring of the system is required by DEP. Motion: AP-approve alternative system. Manufacturer will come back to Board in 120 days with data Collected. This is a galley system and not a leach pit. KJ seconded. 4 yes. 7. Chadd Kodak-variance request for 1554 & 1560 Main Street-less than 300' to pond Motion: AP-grant variance request for both 1554 & 1560 Main Street. KJ seconded. 4 yes. 8. Building Systems-seeking approval for variance to plumbing code for Camp Wono The Board is in favor of the State granting this variance. 9. Minutes from 7/7/09 meeting Motion: KJ-approve minutes as written. AP seconded. 3 yes. Minutes from 7 / 21 / 09 meeting Motion: AP-approve minutes as written. KJ seconded. 3 yes. 10. Discuss Health Director's objectives for FY10 AP suggested reviewing the Bedroom Defmition again. Other suggestions were Emergency Planning, Outdoor Cafe Regulations and enforcement of Sand & Gravel Mining applications. The Board asked that NI check with Victor Staley, Building Commissioner to see if the Grover's are listed as a Tree Farm. Also check with State and let the Assessor's office now. The Board asked that the Bedroom Defmition be brought to the next meeting. Bills to be raid: KJ-pay bills. AP seconded. 4 yes. 1. Nancy Ellis Ice 2. MAHB Informational Items: work boots & mileage annual dues 1. Letter to DEP re: Walkers Pond 2. Assistant Health Directors monthly report for April, May and June 3.
