SOLUTION NO. 2013-074 ADOPTED June 25,2013
A RESOLUTION: AWARDING THE CONSTRUCTION CONTRACT FOR THE MILLER
DRIVE EXTENSION PROJECT TO BAY COUNTRY ENTERPRISE,
INC. IN THE AMOUNT OF $971,347.00.
WHEREAS,the Miller Drive Extension project is a fully funded capital project; and
WHEREAS,this contract award is for the extension of Miller Drive from Blue Seal Drive
to Tolbert Lane; and
WHEREAS, in response to a public solicitation for bids for construction of the Miller
Drive Extension project,the Town received eight bids on June 12,2013, from the following firms:
• Bay Country Enterprise, Inc. $ 971,347.00
• General Excavation, Inc. $ 980,511.75
• A&M Concrete $1,125,322.50
• LA Terre Enterprise Inc. $1,144,817.00
• E.E. Lyons Construction Co. $1,154,428.00
• Arthur Construction $1,199,985.00
• Fort Myers Construction $1,272,725.78
• Finley Asphalt $1,622,909.12
WHEREAS,the bids were evaluated by the Director of the Office of Capital Projects and
the Chief Procurement Officer in accordance with the Town's Procurement Policy; and
WHEREAS, Bay Country Enterprise, Inc. was determined to be the lowest responsive and
responsible bidder; and
WHEREAS,this is a unit price contract and the estimated quantities multiplied by the unit
price have established the not to exceed contract price; and
WHEREAS, change order procedures are detailed in the bid specifications; and
WHEREAS,there are sufficient funds in the Capital Projects Fund,no additional funding is
needed to award this contract.

A RESOLUTION: AWARDING THE CONSTRUCTION CONTRACT FOR THE MILLER
DRIVE EXTENSION PROJECT TO BAY COUNTRY ENTERPRISE,
INC. IN THE AMOUNT OF $971,347.00.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute a contract, in a form approved by the Town Attorney, with
Bay Country Enterprise,Inc. in the amount of$971,347.00 for the construction of the Miller Drive
Extension project.
