RESOLUTION NO. 2013-109 ADOPTED September 10, 2013
A RESOLUTION: TO INTITATE AND TO AUTHORIZE THE EXECUTION OF A DEED
OF SUBDIVISION, CONEYANCE, EASEMENTS AND VACATION
AND DEED OF VACATION FOR SALE OF PUBLIC PROPERTY TO
LOUDOUN WATER
WHEREAS, Loudoun Water desires to purchase approximately 1.1846 acres of public
property owned by the Town on the site of the Kenneth B. Rollins Water Treatment Plant and
located in Loudoun County in order to design and construct Loudoun Water Raw Water Intake and
Potomac Raw Water Pumping Station; and
WHEREAS, at its meeting of August 12, 2013,the Town Council resolved to approve the
sale of the public property to Loudoun Water as well as authorizing the Town Manager to execute a
Memorandum of Agreement("MOA")between the Town and Loudoun Water outlining the
purchase, sale price, and other considerations as agreed to by the parties, and the details of the
transaction; and
WHEREAS, the Parties are refining the terms of MOA; and
WHEREAS, in order for the Town to convey said property it is required by the Code of
Virginia to advertise and give notice for the sale of public property; and
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that the
Town Council initiates the process pursuant to the Code of Virginia for the sale of public property
and for the Mayor to execute, at the time of closing or whenever practicable, the: 1) Deed of
Subdivision, Conveyance, Easements and Vacation; and 2) any and all further documents to
complete the transaction for the purchase and sale of public property for the design and construction
of the Loudoun Water Raw Water Intake and Potomac Raw Water Pumping Station.
