A RESOLUTION: AUTHORIZING THE MAYOR TO EXECUTE AN EASEMENT AND
RIGHT OF WAY AGREEMENT FOR NOVEC TO INSTALL UTILITIES
ACROSS PUBLIC PROPERTY
WHEREAS, as part of the Sycolin Road Phase III Capital Improvement Project, streetlights
and other utilities will be installed along the western portion of public property located at 301
Sycolin Rd., SE, PIN 189-15-5207 and referred to as the Route 643 Booster Pump Station ; and
WHEREAS, in order for NOVEC to install the cables, streetlights and additional utilities, an
easement must be conveyed by the Town to NOVEC;
WHEREAS,NOVEC has drafted an Easement and Right of Way Agreement that limits the
term of the easement to forty (40) years as required by Code of Virginia §15.2-2100 and which
authorizes the installation of cables, streetlights and other utilities to be installed across and through
the aforementioned public property; and
WHEREAS,the Town Attorney's Office has reviewed and approved the Easement and
Right of Way Agreement drafted by NOVEC.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that the
Mayor is authorized to execute, on behalf of the Town,NOVEC's Easement and Right of Way
Agreement for PIN 189-15-5207.
