RESOLUTION NO. 2013-137 ADOPTED November 26, 2013
A RESOLUTION: AWARDING PURCHASE OF BATTLEFIELD PARKWAY—
EDWARDS FERRY TO FORT EVANS STREAM MITIGATION BANK
CREDITS TO BOLLING BRANCH MITIGATION BANK, LLC. IN THE
AMOUNT OF $322,864.50.
WHEREAS,the Battlefield Parkway—Edwards Ferry to Fort Evans project required the
impact to two minor streams which require mitigation; and
WHEREAS,there was no opportunity on the project to provide the mitigation,thus
requiring offsite mitigation; and
WHEREAS, in response to a public solicitation for bids for the purchase of stream
mitigation bank credits for the Battlefield Parkway—Edwards Ferry to Fort Evans project,the
Town received two bids on November 18, 2013 from the following firms:

Stream Bank
WHEREAS,the bids were evaluated by the Director of the Office of Capital Projects and
the Chief Procurement Officer in accordance with the Town's Procurement Policy; and
WHEREAS,the Loudoun County Wetlands and Stream Bank had only 713 of the required
951 credits and they were $9.50/credit higher than Bolling Branch Mitigation Bank, LLC; and
WHEREAS, Bolling Branch Mitigation Bank, LLC was determined to be the lowest
responsive and responsible bidder; and

CREDITS TO BOLLING BRANCH MITIGATION BANK, LLC IN THE
AMOUNT OF $322,864.50.
WHEREAS,this is a unit price contract and the estimated quantities multiplied by the unit
price have established the not-to-exceed contract price; and
WHEREAS,there are sufficient funds in the Capital Projects Fund and no additional
funding is needed to award this contract.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute a contract, in a form approved by the Town Attorney, with
Bolling Branch Mitigation Bank, LLC in the amount of$322,864.50 for the purchase of stream
mitigation bank credits for the Battlefield Parkway—Edwards Ferry to Fort Evans project.
PASSED this 26th day of November,2013.
