Present: Mayor, Thomas Anderson; Councilmembers, Thomas Crosby, William Reiser, Sarah Lutz, Nancy Laurent; Clerk -Treasurer, Donna Roehl; Planning and ZoningAdmin- istrator, JoEllen Hurr;, Public Works Director, Ron Duran; Police Chief, Charles Hoover; Attorney, Richard Schieffer; Engineer, Lyle Swanson 1. MINUTES OF JUNE 3, 1980, BOARD OF REVIEW MEETING Donna Roehl asked that minutes reflect Mr. Emerson's request to correct his suggested assessment on one parcel of land to $70,000 not a $70,000 assessment on his. entire farm. Motion by Reiser, seconded by Lutz to amend minutes of Board of Review Meeting as requested. Motion declared carried 2. MINUTES OF JUNE 17, 1980 . Motion by Reiser, seconded by Lutz to accept minutes of June"17, 1980 meeting, as presented. Motion declared carried 3. POLICE DEPARTMENT Motorbike Licensing . Police Chief Hoover reported that identification plates for recreational motor vehicles would cost $2.0.0 each plus $.25 for each number. Sarah Lutz stated that she would look into the cost of plates, also. Motion by Laurent, seconded by Crosby to adopt. Resolution 80-18, establishing a fee for recreational vehicle identification plates at $5.00 each for 2 plates, as required. Motion declared carried Negotiator Thomas Crosby reported that Karen Olson of Labor Relations Associates would negotiate the cities Police contract for a flat fee of $1500 or at the rate of $50.50 per hour, portal to portal. . He also read from a letter Written by Attorney, Richard Schaeffer recommending Dennis 0' Brien of the LeFevere, Lefler law firm who would work for a fee of $50.00 per hour plus $40000 - 45.00 per hour for work done by less experienced lawyers in the firm. Mr. Crosby recommended hiring Ms. Olson for $1500 using Mr. O'Brien as a back-up, if needed. Motion by Crosby, seconded by Lutz to hire Karen Olson and the firm of Labor Relations Associates to represent the city in police labor negotiations on the basis of a $1500 fee, up to arbitration. Motion declared carried Sarah Lutz stated that she would like to take part in the negotiating again. Hill Liquor Thomas Anderson reported that there .is a noise problem at the Hill Liquor among guests in the parking lot., He asked that. they be requested to discuss the situation at the July 15th meeting. 4. PUBLIC WORKS DEPARTMENT Northwestern Bell Telephone Co. . Motion by Crosby, seconded by Reiser to adopt Resolution 80-19, allowing Northwestern Bell Telephone Co. to bury cable on Tamarack Dr. north of Co. Rd. 24. Motion declared carried • Hwy. 55 - Co. Rd. 116, Signals Mayor Anderson reported that Lyle Swanson had not received information from the State High- way Department regarding the possibility of the city installing the signals using city plans and at city expense. Several residents expressed the opinion that they should not be charged for the project. Thomas Crosby suggested tabling the matter until July 15th pending receipt of information from city Engineer regarding alternatives available to Medina. Chippewa Corporation Ron Duran recommended that $50p being held by the city could be returned to the Chippewa Corporation as they had maintained Mohawk Dr. and there were apparently no major road dam- ages incurred. Motion by Lutz, seconded by Laurent to return check of $500 to Chippewa Corporation. Motion declared carried JoEllen Hurr was advised that she should proceed.with the land alteration permit application of the Chippewa Corporation. Hamel Sidewalks Thomas Anderson reported on the meeting held in Hamel for residents of the area to discuss the possibility of repairing and replacing sidewalks on Hamel Rd. Motion by Lutz, seconded by Laurent to adopt Resolution 80-20, setting a Public Hearing for August 5, 1980 at 8:00 P.M. to discuss installation of sidewalks on Hamel Rd. from Brockton Lane to Hunter Dr. Motion declared carried 5. CHARLES PANGIER Richard Schaeffer explained that an error had been made in dividing assessments at the time that Mr. Pangier combined his lots into 3 building sites and that there is one half of an assessment that needs to be added to make a total of 3 full assessments. He addedthat the resolution he had prepared would correct the apparent mistake. Mr. Pangier agreed that the assessments'should be corrected but he questioned whether stub had been installed for a third lot. Motion by Crosby, seconded by Reiser to adopt Resolution 80-21, correcting assessments of Charles Pangier and to ask xon Duran to determine stub location. Motion declared carried 6. DOCKSIDE JoEllen Hurr listed reasons given by Planning Commission recommending disapproval of Mr. Spaeth's plans for development of the Dockside property. Among the concerns were set- backs from lake and road, density on the property and number of sewer units needed. She stated that Mr. Spaeth had requested toappear before the Council despite the denial-. Mr. Spaeth provided new plans indicating a 40 ft. easement along Lakeshore Dr. and cor- rected measurments of the property. Thomas Crosby stated that some of the set -back variance problems and density could be solvedby eliminating some of the units. William Reiser and Sarah Lutz stated that they would like to see a 12 unit development plan. Richard Schieffer stated that a hardship for variances could be found such as the shape of the property and the fact that it is located between the lake and a highway. Motion by Crosby, seoonded by Reiser to request that Mr. Spaeth redraw plans with 12 or 13 units and that developer take into consideration the Planning Commission concerns, concerns of the Council and residents, which primarily deal with set -backs. Motion declared carried Mr. Crosby addressed the Planning Commission concerns: Set -backs from street could be addressed, set -backs from lake could be handled by less units and additions to the sewer could be handled by the city as more use would benefit the system. Mayor Anderson asked that Mr. Spaeth have plans redrawn for the Planning Commission meet- ing of July 8th. 7. TAX FORFEIT LOTS Discussion of the policy that Hennepin County Board of Commissioners is considering adopt- ing regarding sale of tax foreit land in the county. Richard Schaeffer stated that he was working on a statement from Brooklyn Park and would _forward a letter to the Commissioners on°behalf of Medina. 8. INDUSTRIAL REVENUE BONDS Council discussed information presented by JoEllen Hurr and the need to develop for industrial revenue financing so as to encourage development. John Spaeth, former member of the Plymouth City Council, suggested that several included such as determining the number of employees a business will bring into and the fact that a developer should invest an amount of his own capital before becomes involved. Richard Schieffer explained that an ordinance regarding fees would need to be adopted. Thomas Anderson suggested that Medina adopt a policy similar to Plymouths and that the Attorney draft an ordinance setting forth a fee schedule which would include payment of all administrative, legal and any other expenses incurred. and that the matter be handled at the July 15th meeting. 69 a policy items be the city the city 9. BUDGET HEARING Motion by Laurent, seconded by Crosby to hold a budget hearing, including use of Revenue Sharing funds on August 19, 1980 at 8:00 P.M. Motion declared carried 10. PLANNING AND ZONING ADMINISTRATOR SALARY JoEllen Hurr discussed with Council her request for an increase in pay in conjunction with discussions held at time she was hired regarding reviewal after 3 months. She listed several neighboring communities pay schedule for similar posistions. Motion by Lutz, seconded by Reiser to increase wages of Planning and Zoning Administrator to $7.25 per hour and to increase amounts paid for meeting attendance for Zoning Adminis- trator and City Clerk to $30.00 for Council meetings and $15700 for Planning Commission meetings and $15.00 for department heads. BILLS Motion by Reiser, seconded by Lutz to pay the bills: Order Checks # 8868 - 8918 in the amount of $32,655.99; Payroll Checks #5792-5815 in the amount of 10,506.80; Revenue Sharing Check # 1028 in the amount of $1,175.10. Motion declared carried 12. SEAL COATING Donna Roehl reported that Ardmore Ave. from Co. Rd. 19 to Pine St. and Pine St. from Ardmore to Lakeshore Ave. had been included in the County Aid system. Lyle Swanson presented specifications for sealcoating streets in the Independence Beach area and overlaying Willow Dr. Motion by Reiser, seconded by Lutz to advertize for bids on sealcoating according to plans of Engineer, on July 15, 1980 at 10:00 A.M. with Council to consider bids at their meet- ing the evening of July 15.
