A RESOLUTION: TO INITIATE CHANGES TO THE TOWN CODE AND ZONING
ORDINANCE RELATED TO EXCESSIVE NOISE
WHEREAS, excessive noise can be a detriment to the citizens of Leesburg; and
WHEREAS,the Town may update its codes and ordinances from time to time; and
WHEREAS,the Town Council amended the Town's Noise Ordinance in 2009 in order to
strengthen its viability and enforceability in light of the Virginia Supreme Court decision of
Tanner v. City of Virginia Beach, wherein the Court struck down Virginia Beach's noise
ordinance on the basis that the standard ("unreasonable")was unconstitutionally vague; and
WHEREAS, since that time and as a result of recent increased outdoor and indoor
entertainment venues locating in the town, complaints of excessive noise have also increased;
and
WHEREAS, Town staff, including the Leesburg Police Department,believe that the
Ordinance needs to be amended and updated again to reflect changing needs.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that
Town Staff is hereby authorized to initiate changes to noise provisions of the Leesburg Town
Code and Zoning Ordinance.
