Brewster Town Office Building Chairman Robert Bugle convened the Planning Board meeting at 7:00 pm in the Brewster Town-Office Building with members Taylor, Pierce, McMullen, Barnard, Tubman and Kuzman. Chairman Bugle opened the hearing May 13, 2009 by reading the legal advertisements and making the applicant and parties in interest aware of their rights to appeal as required under Chapter 40A, Section 17. He stated that during the hearing any member of the Board or interested party could direct questions through the Chairman to a speaker relating to the proposal. Informal Discussion: Housing Production Plan—Community Preservation Committee; review and discuss revised draft plan dated 4/1/09 Present: Paul Hush and Paul Ruchinskas Ruchinskas: Provided an overview of the revised plan. Mr. Ruchinskas and Mr. Hush were before the Board seeking the Planning Board endorsement. After they have been before this Board then they will go to the Board of Selectman. In order to send it to the State they need both endorsements. The Plan identifies several planning and zoning strategies that would be addressed over the timeframe outlined. Hush: The plan is a framework. It does not bind the Town but it gives a general direction. He noted that Sue Leven, the Town Planner, had provided comments and the Plan had incorporated the changes. Bugle: Do you need a formal vote from the Board? Unfortunately, this has been listed as an informal discussion and in order for the Board to vote it needs to be advertised and held as a public hearing. Pierce: Expressed some confusion due to the fact that so many different agencies were involved in this process. Ruchinskas: Unfortunately, it has become difficult with this evolution of agencies. Taylor: Wanted to make sure the plan addressed all the points from the DHC. Mr. Ruchinskas assured Ms. Taylor that they had. Taylor: Can this plan be revised or is it set in stone. Barnard: Noted that he had some conversations with residents and they all expressed concern over the need for affordable housing in Town. Mr. Bonnonj would like to know if there was a vvoy to make the housing only ormainly available for locals. Ruohinokos: Noted that state programs allow 70% of housing be given preference (i.e. local residents). Pierce: Liked the idea of incorporating the seasonal workers housing into the Plan. Bugle: What isthe role ofthe CPC and what imthe driving force behind this Plan? Hush: The CPC had the money and was able tofinance this project. They have agreat interest inthis issue and since they had the money available felt this was anappropriate cause. Ruchinokoo: The Plan highlights Roles. You will note there ianot much involvement from the CPC other than financing. Bugle: Agreed with Mr. Barnard and would like to see if there was a way for Brewster residents to have opnofmnsnoe. Mr. Bugle also wondered if the majority of the homes would be new or existing. Ruohinnhas: Would have todoaninventory count and found out what was available. For example ia there commercial space that could accommodate residential use...accessory apartments with existing homes. Mr. Ruchinskas recognized that the Town could not build only new homes to reach the 10% mark. The Town would need 10use both new and existing, Hush: Mr. Hush and the committee have reviewed the accessory apartment by|evv and it is not working. It appears there are too many hurdles and not easy for people hounderstand. Pierce: Felt the biggest hurdle \nthis bylaw was with its deed restriction. Barnard: Have you reviewed this with the Board of Health? Hush: No, that is not a requirement for submission to the State. Bugle: Felt that everyone had made some good points but since they were not able to vote on the Plan tonight asked tocontinue toadate when oPublic Hearing could beheld. Work session: Road improvement bzCrosby Lane Robert Barnard noted that he was a homeowner on Crosby Lane and recused himself and sat in the audience. Present: Greg Levasseur; Chief Koch, Robert Bersin, Russell Kleecamp from Stearns and Wheeler Lavamsaur The Town has identified Town roads that need improvement and Crosby Lane is one of them. The drainage needs to be fixed on Crosby Lane. In order to fix the problem, drains would be installed in the roadway every 3OOfeet. The current plan shows an 18 foot roadway with a 1 foot berm. This ioawell traveled road and needs hobeaddressed. However, itdoes not look like itwill baanytime soon. All the Town's money has gone to handle the Stony Brook redesign. Mr. Levoaeeurvvou|d like to keep the plans moving forward and have available when funds do become available. Planning Board Meeting Page 2of6 O5-13~OS Russ from Stearns&Wheeler: Hestated that inorder hoadd the appropriate drainage the road needed tobemilled. The current plan includes an 18 foot width with 12 inch berms on both mkjos. The drains/catch basins with leaching pits are planned every 300 feet. They believe the pavement will only be expanded by inches to 1 foot. Bugle: Opened tothe Board. Taylor: How will the plan accommodate discharge from roads that intersect with Crosby Lane? Russ: They plan&obuild aprons onthe roads, Bugle: Doesn't this seem like o rather elaborate drainage system and how with the drains down by the bay work? Russ: The system down bvthe parking lot iosignificant due to the need tohandle the run off from the hill. |naddition, the system iadesigned for high tide. Stearns has had experience with this type of system and they have found that itworks. Bugle: Have you considered any other types of berms. Something other than pavement? Russ: They could look into itifrequested. However, they have found that grass berms look great but they need tohave maintenance. Bugle: How about decreasing the number of drains and not installing them every 300 feet? Russ: The current plan ioideal. |fyou change the drains then you run the risk ofwater pooling and then the road will deteriorate. Bugle: Have you considered drainage awm|om? Adeveloper used them inthe Pond Oaks and the VVhidah Way developments. They seem bowork well there. Beroin: Expressed some concern over these alternatives. The problem with them iothat it uses dirt and that is easily dug up with the snow plows and then we get back to the same state we are in today. Taylor: Will any vegetation bedisturbed? Russ: Notrees will be removed. Bugle: Nofurther comments from the Board ooheopened the floor tuthe public. Barnard, 1DDrake Way: Would like toaddress the ponding issue: There ioonly one flat area onthe road. The water accumulates down by the parking lot, at the intersection of Crosby/Weathervane and in front of a homeowner at the beginning of the road with a hole in his front yard. The water at the beginning of the road is accumulating probably from the run off of Rte. 6A. Snhofe|d. 123Crosby Lane: Stated that she had been conducting some research and has found that an effective way to handle storm water run off is with low impact development. One ofthe simplest ways to reduce run off iswith areduction inpavement. Ms. 8chofe|dwanted toknow ifthe plan addressed low impact development. Russ: The plan does not address low impact specifically. This idea iaenew idea and their firm doesn't believe it \oproven. Also, henoted that the increase inpavement iominimal. Gohofe|d: Expressed other more natural ways toaddress the drainage. Heattributes this horun off from OA. With this plan would the water run off tohis yard? Rune: No, that would bathe point ofthe increased drainage. The construction will adjust for homeowners driveways. Lamb, 154Crosby Lane: This plan will have 2Ofeet ofpavement(18feet with 1foot be,mo). Why add pavement which will only add tothe drainage concerns. 8eroin: |n1S73. the road was listed maan18foot roadway. Over time the road has overgrown and grass/yards have crept onto the roadway. What the DPW iaproposing just replaces the footprint ofthe roadway. Levaooeur: This plan just adds about 1 foot of pavement which will channel the water appropriately. Bugle: Recognizes that this area isasensitive area, The road isonly being restored tothe original design. He would like to make sure the impact is minimal. Barnard: Expressed concern over the statement that the road was 18feet with overgrown areas. He and several neighbors dug around onthe roadway and couldn't find any pavement onthe sides. Bugle: |nresponse toMr. Barnard, sometimes the developer doesn't put inthe full 18feet. Only if someone from the town supervised would vveknow for sure what was put in. Gchofe/d: She has measured 13, 14, and 15 feet of existing pavement and going to 20 feet is going to be significant. Russ: Did not agree with K8e. Sohoha|d—thia is not a major change. Lamb: Hewas very nervous about the proposed new width. For safety reasons, hewould like bmsee a narrower road. Tubman: Questioned whether a 18foot width with berm was acceptable. Russ: Stearns&Wheeler would not stand behind o18foot width road. itionot sound engineering and itwould boagainst design standards. The current stakes out onthe road show how far out the pavement would go. Chief Koch: The Police DepL is currently doing traffic counts for the area. They will also look at traffic in June andJu|v/AuguoL Hewould beopposed horeducing the width ofthe road. Emergency vehicles need the room homaneuver. Taylor: Wouldn't it be safer if you had a wider road to accommodate the bikers and walkers? Barnard: The first plan had sidewalks—those have been taken away. The people traveling ono narrower road will hesitate and wait. |fit\swider people can speed down the road. Gohofe(d: Stated that state laws are allowing Towns to relax some of the requirements. She has recommended the following: 1. The development ofaScenic Bylaw. —Curnant|yinproceaevvithtbeTovvnPianner 2. Develop a linkage program for Nickerson State Park for campers to get to the beach (through Niokenaon'uown beach front proparty). 3. Develop the final plans after the Scenic Bylaw isaddressed 4. Review traffic calming otnuhaQiea. Koch: The safety issue is something the Police Department addresses across Town. Noted that they dofollow oprocess and want todothe right thing for all Town citizens! Planning Board Meeting Page 4ofO 85-13-O8 Taylor: After this lengthy discussion, asked where they were now. Bergin: The Town has Chapter 90 funds for engineering and they would like to have the plans finalized and then tabled until the Town has more money. Levasoeuc Felt that the Town might boable toaddress this roadway project in2yearo. Taylor: Will the plan becast in stone? Levaeoeur This ioapublic road and vvewill bmspending tax dollars. The Town would like huspend the money appropriately. If someone has or would like to propose something different then they would consider. Tubnnon: Questioned how the Town obtained Chapter DOfunds. Bersin: The funding (oostate aid that comes from the gas tax. Proposal to construct single family dwelling on a pre-existing lot of record, lacking street frontage (dirt road access bylaw). Present: George Cavanaugh, Attorney; John Wilson Mr. Barnard returned to Board. Cavanaugh: provided anoverview ofthe application and plan. Henoted that his clients wanted bobuild ahome and the application meets the dirt road access bylaw requirements. Bugle: Read the Department reviews. Mr. Berain. the DPW Director, reported to N1a. Tubnnan that he had no comments onthe application. Bugle: Opened tothe floor: Taylor: Felt they had the access, the acreage and met the requirements. Barnard: Wondered ifthey owned the land across the dirt way? The answer was no. Bugle: Nofurther comments were made. Tubmnan: Motioned toapprove the special permit application aopresented. ROLL CALL VOTE: Robert Bugle Aye John McMullen Aye Marjorie Pierce Ave Elizabeth Taylor Aye Robert Barnard Ave ArnbarTubmnan Aye Planning Board Meeting Page 5 of 05'13-OG Informal Discussion: Naming the 2 new projects at the Fredrick's Court area— Dion Dugan Present: Dion Dugan Dugan: Wanted to know if the Planning Board addressed the naming of a Housing Complex. Mr. Dugan has heard that the Town would like to name the proposed housing plan to be Brewster Court. Mr. Dugan felt there were negative connotations with "Court" and wanted the name to remain Brewster Woods. Bugle: The Planning Board is responsible for the naming of roads—not specific projects. He then provided an overview of the road name process. Dugan: Mr. Dugan thanked the Board for their time. Other Business: 1. Performance Bond —Wood Duck Road A brief discussion occurred and then Ms. Pierce motioned to refund the performance bond currently being held by the Town for the installation of the guardrails. Seconded by Barnard. All Aye. 6-0-0 2. Any other business that may come before this Board Ms. Leven provided an update of the status of Ocean Edge. She has requested the following: a. that Ocean Edge provides an "As Built" plan that shows all that has been done to the property. b. a copy of the recorded documents. c. confirmation that Ocean Edge is compliant with the Town of Brewster Zoning Bylaws d. A parking plan Once the Town has this information then we would be in a position to decide what actions Ocean Edge needs to take. Ms. Leven also advised the Board that they should not go out to the location for any site visits. Further, Ms. Leven wanted to let the Board know that the landscape company had called and wanted to inform the Board that they were making changes to the entrance of the Mansion. The landscape company wanted to know if they needed to go before the Board. —The Board briefly discussed and felt that they did not need to review the changes. 3. Allard, 3937 Main Street, Map 30, lot 13 The Board reviewed the letter from the Building Commissioner regarding outstanding issues on the property. The Board noted the concerns.
