Brewster Town Office Building Chairman Bugle convened the Planning Board meeting at 6:30 pm in the Brewster Town Office Building with members Taylor, Barnard, Kuzman and McMullen. Also present Sue Leven, Town Planner Chairman Bugle opened the hearing July 8th, 2009 by reading the legal advertisements and making the applicant and parties in interest aware of their rights to appeal as required under Chapter 40A, Section 17. He stated that during the hearing any member of the Board or interested party could direct questions through the Chairman to a speaker relating to the proposal. 1. Informal Discussion: Road improvement to Stony Brook Road tt was noted that the Board had not received a full size plan and therefore unable to review. Taylor: motioned to continue to the next meeting. Seconded by McMullen. All Aye. 2. Informal Discussion: Road improvement to Crosby Lane Apparently new issues were raised this past weekend and a full discussion may not be accomplished tonight. Bugle: Wanted to make sure that all the citizens of Brewster were aware that the Planning Board was looking out for their best interest. The Board needs to protect the characteristics of the Towns roads by reviewing the width, drainage and berms. It was imperative that the beach roads maintain there unique features. McMullen: Heard the Board of Selectmen had created a task force to address the beach roads. He would like the selectmen to appoint someone from the Planning Board to be on that task force. Barnard: wanted to know if he should recuse himself? Bugle: Did not think it was necessary because the Board was only discussing informally. Barnard: Understood that the task force currently consisted of: Foley/Norton from BOS; Charlie Sumner and possibly Sue Leven. Planning Board Meeting Page 1 of 3 07-08-09 Taylor: the BOS is calling this task force the Beach Road Committee. Wanted to know how this applies across all town roads. Johnson, Peter: Thought a task force was a good idea but also thought the Planning Board should have input at some point. Lewis: The task force/work group is a BOS committee and does not require a Planning Board member to be involved. Taylor: Felt that if the Town Planner was on the committee then the Board shouldn't worry. McMullen: Wanted to the make sure the BOS was aware that there is an expertise on the Planning Board and it should utilized at least in an advisory role. It was agreed to let the project lie as it was. The Board would address if it became an issue. Public Hearing -Approval Not Required #2009-13. Applicant: Joel & Patricia Lamb; James Nancy Rickenberg, Soren & Carol Lauritsen, Property Located at 105 Great Fields Road, Assessors' Map 23; Parcel 58. Proposal is division of Lot 2 and Lot 7. Lot 2B is to be combined with Lot 76. Total combined area equals 63, 997 SF. Lot 7A is to be combined with Lot 2A. Total combined area equals 45, 793 SF. Present: Phil Scholomiti Scholomiti: Provided an overview of the ANR. Bugle: Would this modification allow the parcels to meet zoning requirements? Scholomiti: These are pre-existing non conforming lots. The applicants are trying to exchange equal size lots to make their shape more functional. Taylor: swapping equal amounts is ok Bugle: Opened to the Board. No comments. He then opened to the Public. No comments. Taylor: Motioned to endorse the ANR. Seconded by Barnard. Tree Cutting on Scenic Roads- Apparently the utility companies have been trimming and DPW has been cutting hazardous trees. Bugle: Was informed that trees have been cut because they were deemed hazardous and they needed to come down. It was his understanding that trees would be cut without a public hearing only after a Planning Board Member and the Tree Warden reviewed the tree. Planning Board Meeting Page 2 of 3 07-08-09 Kuzman: Lives on a Scenic Road and the DPW company was cutting down at trees that weren't even a threat to the power lines. This was not right it should have been reviewed by the Board. It was also noted that the utility company in there infinite wisdom also trimmed the "Christmas" tree and they butchered it. After all that has been discussed on this tree it is unbelievable that they could go out and do that. Taylor: Stated that NStar used to come to the Planning Board and detail the fast growers which were trimmed significantly and the slow growers were lightly trimmed. The Planning Board needs to send a letter to NStar and B. Bersin requesting a discussion on this issue. Barnard: According to the State Scenic Roads act a public hearing needs to occur for any of this cutting. Bugle: Utilities do not have to comply - In the past they have come before the Board as a courtesy. Let us review the Scenic Road and Shade Tree Act before NStar and Mr. Bersin appear. 2. Review Zoning Board of Appeals July 14th agenda The Planning Board did not have any additional information on the agenda items and therefore unable to provide comments. The Board would like to receive copies or at least have enough notice so that they can come into the office to review the file if necessary. 3. Proposed draft bylaws: a. Scenic Road -review the revised draft b. Conservation Subdivision: Ms. Leven provided a handout and a brief discussion occurred. The Board would like to know how much land this would effect. Don Keeran, a citizen, stated that he had a companion document for the bylaw which may help the average user to understand. c. In law Status - a brief discussion occurred regarding how to handle the "In-law" use. Ms. Leven stated she had a possible bylaw that she used in Harwich that may work in Brewster. She agreed to forward the wording. The Board would also like to know the number of in law apartment decisions the ZBA has granted over the past 5 years. McMullen: Motioned to adjourn.
