HomeMy Public PortalAbout07/02/74 CCM46 The council of the City of Medina met in regular session on Tuesday July 2, 1974 at 7:45 P.M. 1. Wayne Neddermeyer, Mayor in Chair Donna Roehl, Clerk All Council members present Motion by Robert Franklin to dispense with reading of June 4, 1974 minutes as they had been received by the council prior to this meeting. Seconded by Donald DesLauriers Motion carried unanimously Charles Pangier appeared with a request that something be done to control flooding of Maple St. at Lake Independence. Leo Leuer stated that there is a 4 ft. culvert under Ardmore St., but the ditch beyond had never been opened. Robert Franklin asked the road supervisor to look at exit ditoh from Lake Ardmore and report finding to council. Mr. Pangier also asked consideration of his plans to build a garage on his property located at Fern St, and Cedar Ave. Anne Dorweiler stated that she and Jerry Dykhoff had checked the site and found the garage would be 8 ft, from the Fern St. Right of Way and the zoning code states side lot footage should be 10 feet and corner lots 20 feet from Right of Way. She also stated that any approval would require a variance of the 8 ft. on street and lot line. Motion by Robert Franklin to grant Charles Pangier a variance to construct a garage not less that 8 feet from Right of Way of Fern St. on condition he file with Zoning Administrator and application for combination of Lots 12--13--and W. half of Lot 11 in Block 7, Independence Beach. Seconded by Donald DesLauriers Voting as follows: Robert Franklin, Yes; Wayne Neddermeyer, No; Donald DesLauriers, No; Thomas Stevens, No; Arthur Theis, No; After additional discussion ; Motion by Robert Franklin to grant Charles Pangier a variance to construct a garage not less than 15 feet from Right of Way of Fern St. under same conditions of previous motion. Seconded by Donald DesLauriers Motion carried unanimously Mr. Pangier stated that he would attend the July Planning Commission meeting with a representative and any other plans he may have. 3. Willis Gilliard of McCombs -Knutson advised that the Comprehensive Sewer Plan for Medina is being held pending securing a map from the soil conservation service. Regarding the Hamel Sewer Plan, he stated that Lyle Swanson had looked at Alternate revisal and had found it feasable at a cost savings of $2000.00. Sewer cost would be $13,500 and water construction cost, $35,943. Construction could begin in approximate a month after council approves the plans. Council discussed various ways of paying for the project. Motion by Thomas Stevens to table Sewer and Water project at this time Seconded by Robert Franklin Motion carried unanimously 4. The Mannix Corp. has asked for clarification of resolution regarding upgrading of roads on their property. 5. Pat Doherty appeared regarding drainage ditch problem on his property at Medina Morningside. Approximate cost for labor, equipment and materials to correct situation would be $450.00 Mr Doherty agreed to pay $300.00 as Mr. Kwas is unwilling and unable to do so at this time. Motion by Robert Franklin to adopt the following resolution: RESOLUTION NO. 74-14 RESOLUTION APPROVING CONSTRUCTION CONTRACT WHEREAS, Patrick J. Doherty and Gary Kwas have requested improvements to the surface drainage in Medina Morningside area near Lots 20 and 21, Block 2, Medina Morningside, Hennepin County and WHEREAS, the installation of sanitary sewer may alleviate the problem described but the installation of said sanitary sewer must be delayed until the Metropolitan Sewer Boards installs an interceptor; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that the City enter into the contract attached hereto with Mr. Kwas and Mr. Doherty to effect a temporary solution to the drainage problem. They would like the council members and their wives, building committee, and planning commission members to act as hosts for the occassion. 7. Motion by Thomas Stevens to grant Northwest Suburban Chamber of Commerce a permit to hold a street dance on Aug. 9th in Hamel. Seconded by Arthur Theis Motion carried unanimously 8. Discussion of raising rates of lawn mower rental Motion by Donald DesLauriers to increase rates to $3.00 per hour Seconded by Robert Franklin Motion carried unanimously 9. Motion by Thomas Stevens to grant permission for N.W. Bell Telephone to bury cable on Co. Rd. 24 between Willow Drive and Parkview, project No. 4676. Seconded by Donald DesLauriers Motion carried unanimously 10. Clerk was instructed to send letter to Building Movers Assn. stating requirements of $5000.00 Bond and $10.00 permit are needed to move buildings through Medina. 11. Motion by Thomas Stevens to grant Medina Rec. Inc. a permit to park a trailer on their property for 90 days with a renewable clause for another 90 days. Seconded by Robert Franklin Motion carried unanimously 12. Discussion as to whether filling in swamp next to Medina Rec. would create a problem. Zoning Administrator should decide if permit is needed. 13. Motion by Donald DesLauriers to pay the bills Seconded by Thomas Stevens Motion carried unanimously Order checks in the amount of $16,673.99 and Payroll in the amount of $6021.43. 48 14. Julius Dorweiler, Hamel Fire Chief appeared for discussion. Regarding Mpls. Gas Co. installation of propane tank: Proposal meets requirements of State Fire Marshal, but he questions the possibility of a fire because of only a 75 foot distance from inlet to vaporizor of tank.. Problems at Medina Rec. Fire: Power outage at city well could perhaps have been avoided if there had been an independent unit or the Power Co. may have suggestions for future. Sprinkler valve was inside the building and future buildings hhould have an outside shut-off valve. Hamel Fire Dept. is purchasing a new pumper truct costing from $35,000 to $40,000 and council should consider at some time their long range plans for fire fighting. Perhaps phasing out volunteer system and replacing it with a municipal system. Discussion was held on charges for fires starting on a city street and moving on to private property. 15. Charles Hoover reported on cost of installing a pay telephone: Cost is $15.00 for installation, $3.00 for shelf; $15.60 per month or 520 per day plus 600 per month for shelf rental. 16. Discussion of possibility of raising council salaries; Mr. Schieffer stated that councilshould pass an ordinance, publish same, and raise would take effect after municipal election. 17. Motion by Robert Franklin to pay Ray Vignola , planner, $12.00 per hour plus 10 cents a mile for his work. Seconded by Thomas Stevens Motion bgrried unanimously 18. Discussion of Hennepin Co. Park Reserve Dist . 17 million Dollar program. Motion by Robert Franklin to adopt Resolution No. 74-15 regarding Park Reserve Dist. 5 year development program. REGARDING THE FIVE-YEAR DEVELOPMENT PROGRAM OF THE RESOLUTION NO. 74--15 HENNEPIN COUNTY PARK RESERVE DISTRICT WHEREAS nearly all of Morris T. Baker County Park is located in the City of Medina; and WHEREAS the City of Medina has taken a continuing interest in the plans and policies of the Hennepin County Park Reserve District; and WHEREAS the Hennepin County Park Reserve District has approved a five-year development program in the amount of $17,520,000; and WHEREAS the Environmental and Transportation Committee of the Metropolitan Council has scheduled a public hearing for July 16th on immediate action grants recommended by the ,Metropolitan Parks and Open Space Commission; and WHEREAS the Medina City Council believes there has not been meaningful public input for or review of the Hennepin County Park Reserve District develpment program; and WE REDS the Hennepin County Park Reserve District has requested metropolitan funding for •a substantial amount of that program; and WHEREAS TFfF HENNEPIN COUNTY PARK RESERVE DISTRICT failed to hold public hearings 'before approving its development program despite a request to do so; NOW, THEREFORE, BE IT RESOLVED that the Medina City Council does hereby request that the Metropolitan Council withold any funding of 1976-78 programs of the Hennepin County pgrx Repprve District until after the District submits to it a review of the entire 1 49 five-year development program based upon public hearings; and BE IT FURTHER RESOLVED that, because of a lack of public explanation and justification, the Medina City Council takes no position on the merits of the Hennepin County Park Reserve District's five-year development program. Motion by Robert Franklin to grant Maple Plain Fire Department use of the Medina City Park for a picnic. Seconded by Arthur Theis Motion carried unanimously 20. Motion by Thomas Stevens to grant Bill Torodor of the Colonial Drive -In Theater a permit to display fireworks on July 4th, if he submits request for same. Seconded by Arthur Theis Motion carried unanimously 21 C.O. Dorweiler stated that the Northwest Suburban Chamber of Commerce would present a U.S. Flag to city for use in the council meeting room.
