Mayor Pro Tem Harker called the regular meeting of the City Coun- cil to order at 7:30 P. M. Rabbi Camillus Angel of the Temple 2. Beth David, 9677 Longden Ave., Temple City, gave the invocation 3. following which Mayor Pro Tem Harker led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Beckley, Briggs, Harker, Merritt ABSENT: Mayor Tyrell ALSO PRESENT: City Attorney Martin, Traffic Engineer Envall, Public Works Director Pizzorno, Asst. to the City Manager Recupero, and City Manager Koski 5. APPROVAL OF MINUTES: Regular meeting of November 1, 1966 Councilman Merritt referred to item 14, page 3, subsection B, which he corrected to add "Councilman Harker moved to approve item B ". Also item 17, page 4, subsection A, the amount on line i and line 7 should read $530. Councilman Merritt moved to approve the minutes of the regular meeting of November 1, 1966, as corrected, Councilman Briggs seconded, and the motion was unanimously carri- ed. 7 :40 P. M. Mayor Tyrell arrived at this time. Mayor Pro Tem Harker vacated the chair which was assumed by Mayor Tyrell at this time. UNFINISHED BUSINESS: 6. ORDINANCE NO. 66 -211: 2nd read. re salary of City Treasurer City Attorney Martin read title to Ordinance No. 66 -211 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 2302 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO THE SALARY OF THE CITY TREASURER. Councilman Harker moved to waive further reading of Ordinance No. 66 -211 and to adopt, Councilman Beckley seconded, and the motion carried unanimously. PUBLIC HEARING: 7 :30 P. M. CURB & GUTTER: Garibaldi Ave., north side, St. James to Primrose Public Works Director Pizzorno advised the above petition was signed by property owners representing 82.9% of the lineal front footage of the area. Mayor Tyrell declared the public hearing opened and asked if any- one present wished to speak for or against this improvement. No one came forward to speak. Councilman Merritt moved to close the public hearing,. Councilman Briggs seconded, and the motion was unanimously carried. Councilman Merritt moved to find the project in public interest and to instruct the Supt. of Streets to cause the work to be done, Councilman Harker seconded, and the motion carried unanimously. PUBLIC HEARING: 7 :30 P. M. SIDEWALKS: BALDWIN AVE., west side Lower Azusa to La Rosa Public Works Director Pizzorno advised the petition was signed by property owners representing 60.4% of the lineal front footage in the area. Mayor Tyrell declared the public hearing opened and asked if any- one wished to speak for or against the improvement. No one came forward to speak. Councilman Merritt moved to close the public hearing, Councilman Briggs seconded, and the motion was carried unanimously. Councilman Harker moved to find the project in the public inter- est and to instruct the Supt. of Streets to cause the work to be done, Councilman Briggs seconded, and the motion was carried unanimously. 7. ORDINANCE NO. 66 -212: 1st reading,re dismantling of motor vehicles etc. City Attorney Martin advised this ordinance had been previously 970 Council Minutes, November 15, 1966, page 2 considered by the Planning Commission and the City Council. The City Attorney had been instructed to include this in the new zoning ordinance. As this ordinance is still under study by the Planning Commission he presented for first reading Ordinance No. 66 -212 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADDING CERTAIN SECTIONS TO THE ZONING REGULATIONS OF THE TEMPLE CITY MUNICIPAL CODE TO REGULATE THE DISMANTLING OF MOTOR VEHICLES ON "R" ZONED PROPERTIES. Councilman Briggs moved to waive further reading, Councilman Merritt seconded, and the motion was carried unanimously. As this was the first reading of the ordinance no further action was taken. NEW BUSINESS: 8. ORDINANCE NO. 66 -213: re Business Licenses, 1st read. City Attorney Martin advised he was requested to prepare a busi- ness license for the City which would be a new ordinance and a new tax. This ordinance sets forth the mechanics and procedures to follow in this licensing. The rates are not yet established, which will be done by adoption of a Res or Ord. The City Attorney read title to Ordinance No. 66.213 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING ARTICLE VI OF THE TEMPLE CITY MUNI- CIPAL CODE BY REPEALING CHAPTER 2 AND ADDING NEW CHAPTERS 2, 3, 4, AND 5 THERETO RELATING TO BUSINESS LICENSES. Mayor Tyrell asked if anyone in the audience wished to comment. Pete Costa, 10216 E. Olive St., stated he was a painting contract or, and he was opposed to a City business. license. He felt thet he paid a state license and that should suffice. Also that the other cities in the area do have a city license and he felt this city should not follow this procedure as the small business man is at a disadvantage having to pay all these licenses. Al Lindberg, 96102 E. Las Tunas Dr., stated he had not seen the license proposed and did not know if he was for or against. He asked if it would go along with the regulatory licenses of the County, and was advised it would take the place of the County Regulatory provisions and be absorbed in the City license. He also was concerned about the need for and use of the revenue de- rived from having a City license. The Mayor advised him the Council felt it was needed, and that with part of the revenue the City planned to assist the Chamber of Commerce in its activi- ties, that the City in the past had spent substantial sums of money from the general fund to improve the business district. Also considerably more will have to be spent to complete the malls. Mr. Lindberg requested a copy of the proposed ordinance which was furnished him. No one else came forward to speak in opposition. Mr. Mendes, 8812 Las Tunas Dr., stated he was a one man service operation and wondered if licenses were to be imposed only on established businesses in the City or on any persons doing busi- ness within the limits of the City. Mayor Tyrell advised it would cover both areas and that if imposed it would be enforced Mr. Mendes felt in view of these facts that it would be a benefit: City Attorney Martin advised that the ordinance being on first reading at this time makes it a public record and copies can be made available. Mr. Burls, 8912 E. Broadway, stated he paid $35. to the state for a television service license, and wondered about having to pay a City license. The City attorney advised this state license imposes conditions or requirements which the City will not do anc: a City license will also be required. Councilman Merritt moved to waive further reading of Ordinance No. 66 -213, Councilman Briggs seconded, and the motion was carri- ed unanimously. As this was the first reading of the ordinance no further action was taken. The Mayor advised the ordinance would come up for second reading at the regular council meeting of Dec. 6, 1966. Also that the Council would hold an adjourned meeting on Nov. 21 1966, at 7 :30 P. M. for a thorough study of rates for licensing. 971 Council Minutes, November 15, 1966, page 3 9. RESOLUTION NO. 66 -675: re Mall #1A RESOLUTION NO. 66 -676: re Mall #1B RESOLUTION NO. 66 -677: re Mall #1C RESOLUTION NO. 66 -678: re Mall #3 RESOLUTION NO. 66 -679: re Mall #4 City Attorney Martin advised this was the initiation of 5 malls in the City. These resolutions will also set public hearings on the five mall districts for March 7, 1967, at 7:30 P. M. The proposal is to close the alleys and replace with curbs, sidewalks. landscaping and off - street parking adjacent to the parking lots behind the stores and thus the stores can be improved and rear entrances installed. Councilman Beckley moved to adopt Resolutions No. 66 -675, 66,676, 66 -677, 66 -678 and 66 -679, Councilman Merritt seconded, and the motion was unanimously carried. 10. BROADWAY: Rosemead to Eaton Wash: re engagement of appraiser for Right of Way Public Works Director Pizzorno advised several proposals had been received for appraisal of the subject right of way. He recommend- ed the City engage Morris and Martin in the amount of $3000. as this would give two appraisals which would be advantageous should there be any litigation. Councilman Merritt moved to engage Morris and Martin at a cost of $3000., Councilman Harker seconded, and the motion carried unani- mously. 974 Council Minutes, November 15,,1966, page 6 11. TRAFFIC COMMISSION RECOMMENDATIONS: A. Item 13 - ELM Ave. between Rosemead Blvd. and Reno Ave. Recommend red curb markings be placed adjacent to the drive, ways on both sides of Elm Ave. between Rosemead Blvd. and Reno Ave. Traffic Engineer Envall presented the above recommendation. Following discussion Councilman Merritt moved to approve Item A, Councilman Briggs seconded, and the motion was unanimously carried. B. Item 6 - Overnight Parking Signs: Recommend purchase of 20 or more (as needed) Overnight Parking signs and authorization for installation as recommended by the Traffic Engineer. (estimated cost $18.49 each for 20 or more. Traffic Engineer Envall presented the above recommendation. Following discussion Councilman Briggs moved to approve Item B, Councilman Harker seconded, and the motion was carried by the following roll call vote: AYES: Councilmen - Beckley, Briggs, Harker, Merritt NOES: Councilman - Tyrell ABSENT: Councilmen -None C. Item 7 - Arden Drive & Lower Azusa Rd. re Crossin. Guards Recommend Crossing Guar • at Arden Dr. an Lower Azusa '•. be retained only until beginning of Christmas vacation. Traffic Engineer Envall presented the above recommendation ad- vising the Council the Traffic signal had been up- graded with "Walk" and "Do Not Walk" and the Commission felt this was sufficient. Following considerable discussion Councilman Beckley moved to approve the recommendation of the Traffic Commission, Council- man Merritt seconded, and the motion did not carry by the following roll call vote: AYES: Councilmen - Beckley Merritt NOES: Councilmen - Briggs, Harker, Tyrell ABSENT: Councilmen -None D. Item 3 - Kauffman & Las Tunas Dr. Recommend two additional parking stalls with designated 2 -hour parking be placed in a portion of the red curb markings on the east side of Kauffman Ave. south of Las Tunas. The Traffic Engineer presented the above recommendation. Following discussion Councilman Harker moved to approve Item D, Councilman Merritt seconded, and the motion was carried unanimously. E. Item 10 - Ellis Lane and Temple City Blvd. Recommend island be raised to make a solid berm on its peri- meter. The Traffic Engineer presented the recommendation and explained the safety measures involved. Following discussion Councilman Beckley moved Item E be approv- ed, Councilman Briggs seconded, and the motion was carried by the following roll call vote: AYES: Councilmen - Beckley, Briggs, Harker, Tyrell NOES: Councilman- Merritt ABSENT: Councilmen -None F. Item 12 - Olive St. between Encinita Ave. & Rosemead Blvd. Recommend a itiona regu atTons as perTF5TFTETE6.5176FFTs report with addition or relocation of center line on Olive at Loma Ave. Traffic Engineer Envall presented and explained the recommendation as follows: a) to rescind "No Stop at any Time" signs, b) re -work center line striping, c) extend 25 mph speed limit, between Encinita Ave. & Rosemead Blvd., with signs on north side of Olive and south side of Olive St. Following discussion Councilman Merritt moved to approve Item F, Councilman Harker seconded, and the motion carried unani- mously. Councilman Merritt asked about the old cars parked in this area next to the Flood Control. The Public Works Director advised a driveway opening had been requested for this area and was refused because it did not lead to a garage. He also suggested some landscaping might be a possibility there. Councilman Beckley suggested it be covered with asphalt. The Public Works Director will check further about the costs of some improvement. G. Item 15 (b) Additional. Post Patrol for Racing Season. Recommend request by Los AligelesvTurf Club for intersection control at three intersections as stipulated with the Sheriffs office to assign personnel for a minimum of two hours per day 975 Council Minutes, November 15, 1966, page 7 to be reimbursed to the City by the L. A. Turf Club. Traffic Engineer Envall presented the above recommendation. Following discussion Councilman Briggs moved to approve Item G, Councilman Harker seconded, and the motion was carried unanimously. The City Manager was requested to remind them that the race -tract buses are restricted to Baldwin Ave. H. Item 15 (di Rose Parade Float Route Restrictions: Recommend necessary restrictions an postings as in previous years for removal of floats from Miller Bros. and storage on Temple City Blvd., together with posting on Rosemead Blvd. from southerly to northerly City Limits. The Traffic Engineer presented the above recommendations. Following discussion, Councilman Briggs moved to approve Item H, Councilman Harker seconded, and the motion was carried unanimously. I. Item 15 (e) Civil Defense. Recommend a separate bod7 or purpose of administering Civil Defense program for the City of Temple City, and that the Traffic Commission be only an assist or aid to this body but not directly related to it. Mayor Tyrell felt this should be referred to a study session of the Traffic Commission and the Council. Councilman Beckley so moved, Councilman Briggs seconded, and the motion carried unanimously. 12. RESOLUTION NO. 66 -680: requesting additional law enforcement. City Manager Koski read title to Resolution No. 66 -680 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING ADDITIONAL LAW ENFORCEMENT SERVICES WITHIN THE CITY OF TEMPLE t: CITY, CALIFORNIA, FROM THE LOS ANGELES COUNTY SHERIFF'S DEPART- MENT UNDER THE LAW ENFORCEMENT SERVICES AGREEMENT. Councilman Beckley moved to adopt Resolution No. 66 -680, Councilman Merritt seconded, and the motion was carried unanimously. 13. APPEAL TO CITY COUNCIL: Re Denial of Overnight Parking Permit Traffic Engineer Envall advised the two houses involved have a common driveway which Y's out into their separate garages. He stated on inspection that the applicant had room to park the second car just outside the garage without interfering with ingress and egress to the other garage, and for this reason the permit was denied. Mrs. Wing, 5932 Hart Ave., the applicant, spoke in support of her request, stating that it was difficult getting in and out with a car parked in front of their garage and very often their car had to be moved to accomodate the neighbors, and for this reason she needed the permit. Following discussion Councilman Merritt moved the appeal be denied, Councilman Harker seconded, and the motion was unanimous- ly carried. 14. RESOLUTION NO. 66 -681: Warrants & Demands City Manager Koski presented Resolution No. 66 -681 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $33,760.32, DEMAND NOS. 8962 THROUGH 9003 AND 9030. Councilman Merritt moved to adopt Resolution No. 66 -681, Council- man Beckley seconded and the motion was unanimously carried. 15. COMMUNICATIONS: None. 16. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Ray Burger, 5417 Sultana Ave., reported a stop sign knocked down and tied to the power pole on Sultana near Olive. He also re- ported a high hedge at Olive and Sultana which obstructs the view. Also asked why there was not red curb next to the fire hydrant at the Bank of America and was advised this had been taken care of. He also stated an Elm tree on the northeast corner of Sultana turning onto Olive was too low and needed trimming. Also a hedge was too high for clear vision on Rancho Real the block up from where he lived on Sultana. These matters were all turned over to the Public Works Director for attention. Al Lindberg, 96102 E. Las Tunas, referred to Section 6400.33 in the license ordinance and wanted a definition of wholesaler, as it would relate to a franchised importer. He stated if a license 976 Council Minutes, November 15, 1966, page 8 were required from him he would not be able to show him merchan- dise in his store, and it would be driving him out of business as he would have no other customer in the City he does business with. The ordinance would require a license. 17. MATTERS FROM CITY OFFICIALS: The Public Works Director presented a petition for annexation to the Longden Lighting Maintenance District, and read title to Resolution No. 66 -683 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANTING CONSENT AND JURISDICTION TO THE COUNTY OF LOS ANGELES IN THE MATTER OF LONGDEN LIGHTING DISTRICT - PETITION NO. 203 -96. Councilman Merritt moved to adopt Resolu- tion No. 66 -683, Councilman Harker seconded, and the motion was unanimously carried. City Manager Koski presented Resolution No. 66 -684 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING PRE- EMPLOYMENT MEDICAL EXAMINATION SERVICES FROM THE MEDICAL DIVISION OF THE LOS ANGELES COUNTY CIVIL SERVICE COMMISSION PURSUANT TO THE GENERAL SERVICES AGREEMENT. Councilman Beckley moved to adopt Resolution No. 66 -684, Councilman Briggs seconded, and the motion was unanimously carried. City Manager Koski presented Resolution No. 66 -687 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING THE BOARD OF SUPERVISORS OF LOS ANGELES COUNTY TO GIVE CONSIDERATION TO THE PRESENT FLIGHT PATTERN OF THE LOS ANGELES COUNTY EL MONTE AIRPORT. Councilman Merritt moved to adopt Resolution No. 66- 687, Councilman Briggs seconded, and the motion carried unani- mously. Resolution No. 66 -685 was presented by the City Manager A RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING TEMPORARY EMPLOYEE. This is a budgeted recreation employee item. Councilman Harker moved to adopt Resolution No. 66 -685, Council- man Briggs seconded, and the motion carried unanimously. The City Manager presented the proposed Law Enforcement Education Program as a Demonstration Project at the Temple City Unified School Dist. as a joint effort between the school, Sheriff's Dept. and the City to educate youth on the importance of the orderly process of the law. It is to be submitted to the Office of Law Enforcement Assistance in Washington D. C. for the purpose of obtaining a grant to assist in financing the program as a cooperatively endorsed and sponsored project. He recommended the Council approve the project. Councilman Harker so moved, Coun- cilman Beckley seconded, and the motion carried unanimously. Resolution No. 66 -686 was presented by the City Manager A RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING DANNY LAWRENCE BEMOLL AS PARK DIRECTOR. Councilman Briggs moved to adopt Resolution No. 66 -686, Councilman Merritt seconded, and the motion carried unanimously. City Manager Koski recommended that Public Works Director Pizzorno be appointed Superintendent of Streets for purposes of Ch. 27 improvements. Councilman Beckley so moved, Councilman Briggs seconded, and the motion carried unanimously. The City Manager advised the Director of Recreation wished Coun- cil approval to accept a used tennis table and used games which have been offered the City by Edward F. Drew. Councilman Beckley moved the City Manager be appointed to accept this type of thing in the name of the City, Councilman Briggs seconded, and the motion carried unanimously. City Manager Koski requested two amendments to the budget as follows: from the General Fund: a. transfer from the general fund $2255. to pay for the crossing guard for the rest of the school year, and b. to budget $10,425. for the remaining portion of the year for the 40 hr. per week traffic control unit, and c. to budget $1082. for purchase of the radar unit for use on this traffic vehicle. Councilman Briggs moved to appropriate $2255. under item a, Coun- cilman Harker seconded, and the motion was carried by the follow- ing roll call vote: 977 1 Council Minutes, November 15, 1966, page 9 AYES: Councilmen- Briggs, Harker, Tyrell NOES: Councilmen- Beckley, Merritt ABSENT: Councilmen -None. Councilman Harker moved to approve the budget amendment for the radar equipment in the amount of $1082., Councilman Briggs second- ed and the motion carried unanimously. Councilman Merritt asked when the tree trimming crew would start. Also there is a bush on the southeast corner of the alley and Woodruff between Temple City Blvd. and Camellia, mid-block, that needs attention. The City Manager recommended the bush be remov- ed, and the Council agreed this should be done. 18.
