A RESOLUTION AUTHORIZING THE MAYOR AND CITY
ADMINISTRATOR/CLERK, UPON CONCURRANCE OF CITY ATTORNEY, TO
NEGOTIATE AND SIGN LICENSE FOR AT -GRADE BICYCLE AND PEDESTRIAN
TRAIL ON RAILROAD LEASED LINE PROPERTY
Whereas, The City is participating in the construction, operation and maintenance of the
Jasper Avenue Trail, Phase 4 and the proposed pathway will intersect and cross at -grade track(s)
operated by The Railroad;
Whereas, the City Council of the City of Tiffin recognizes the Railroad requires railroad
crossing arms to be installed at this intersection;
Now, therefore be it resolved by the City Council of the City of Tiffin, Iowa to that the
Mayor and City Administrator/Clerk, upon concurrence of the City Attorney, may negotiate and
sign'and enter into the License for At -Grade Bicycle and Pedestrian Trail on Railroad Leased
Property.
On the 22nd day of May, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Ryan introduced Resolution No. 2013-107, A RESOLUTION
AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR/CLERK, UPON
CONCURRANCE OF CITY ATTORNEY, TO NEGOTIATE AND SIGN LICENSE FOR
AT -GRADE BICYCLE AND PEDESTRIAN TRAIL ON RAILROAD LEASED LINE
PROPERTY and made a motion for approval. Motion seconded by Councilperson Bartels.
Ayes: Kahler, Ryan, Bartels, Upton, Phillips
Nays: none.
Absent: none.
Whereupon five Council members were present and voted approval and Mayor Berner
declared that the Resolution No. 2013-107, A RESOLUTION AUTHORIZING THE
MAYOR AND CITY ADMINISTRATOR CLERK, UPON CONCURRANCE OF CITY
ATTORNEY, TO NEGOTIATE AND SIGN LICENSE FOR AT -GRADE BICYCLE AND
PEDESTRIAN TRAIL ON RAILROAD LEASED LINE PROPERTY to be adopted and
signified his approval of the same by affixing his signature thereto.
