A RESOLUTION TO AUTHORIZE THE MAYOR AND ADMINISTRATOR/CLERK, UPON
CONCURRANCE WITH THE CITY ATTORNEY, TO NEGOTIATE AND SIGN THE REAL
ESTATE PURCHASE AGREEMENT AND ALL NECESSARY DOCUMENTS AND TAKE ALL
NECESSARY ACTIONS FOR THE PURCHASE OF THE RAILROAD PROPERTY
Whereas, The City of Tiffin desires to purchase real estate described as:.
Parcel 14. The Point of Beginning being on the North/South centerline of Section 28 and on a
line fifty feet northerly of and parallel to the centerline of Grantor's main track; thence northerly
along said North/South centerline one hundred feet; thence easterly and parallel to said track
centerline three hundred feet; thence normal southerly one hundred feet to said line fifty feet
northerly of said track centerline; thence westerly along the last line intersected three hundred feet
to the Point of Beginning; all in the North Half of the Southwest Quarter of the Southeast Quarter
of Section 28, Township 80 North, Range 7 West of the Fifth Principal Meridian (Railroad
Property)
located within the legal boundaries of the City of Tiffin, from the Iowa Interstate Railroad LTD or other
appropriate entity and;
Whereas, the City of Tiffin wishes to offer the amount of $10,000.00 to the Iowa Interstate Railroad LTD
or other appropriate entity;
Now, therefore be it resolved that the City Council of the City of Tiffin, Iowa authorizes the Mayor and
City Administrator/Clerk, upon concurrence with the City Attorney, to execute the Real Estate Purchase
Agreement for Railroad Property and all other necessary documents, and to take all necessary actions, to
finalize the purchase of the Railroad Property.
On the 22°a day of May, 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Ryan introduced Resolution No. 2013-108, A RESOLUTION TO AUTHORIZE THE
MAYOR AND CLERK/ADMINISTRATOR, UPON CONCURRANCE WITH THE CITY
ATTORNEY, TO NEGOTIATE AND SIGN THE REAL ESTATE PURCHASE AGREEMENT
AND ALL NECESSARY DOCUMENTS AND TAKE ALL NECESSARY ACTIONS FOR THE
PURCHASE OF THE RAILROAD PROPERTY and made a motion for approval. Motion seconded
by Councilperson Kahler.
Ayes: Kahler, Ryan, Bartels, Upton, Phillips
Nays: none.
Absent: none.
Whereupon five Council members were present and voted approval and Mayor Berner declared that the
Resolution No. 2013-108, A RESOLUTION TO AUTHORIZE THE MAYOR AND
ADMINISTRATOR/CLERK, UPON CONCURRANCE WITH THE CITY ATTORNEY, TO
NEGOTIATE AND SIGN THE REAL ESTATE PURCHASE AGREEMENT AND ALL
NECESSARY DOCUMENTS AND TAKE ALL NECESSARY ACTIONS FOR THE PURCHASE
OF THE RAILROAD PROPERTY to be adopted and signified his approval of the same by affixing his
signature thereto.
