A RESOLUTION: AUTHORIZING THE TOWN MANAGER TO EXECUTE A LICENSE
AGREEMENT BETWEEN THE TOWN OF LEESBURG, LEESBURG
ACQUISTION PARTNERS, LLC, AND THE NORTHERN VIRGINIA
REGIONAL PARK AUTHORITY TO ALLOW TOWN UTILITIES TO
CROSS THE W&OD TRAIL
WHEREAS, Leesburg Acquisition Partners, LLC, are the developers of the Crescent Place
mixed-use development located within the Town and intend to construct utility lines which will be
owned and operated by the Town; and
WHEREAS,the Crescent Place development is bordered by the W&OD Trail, a linear park
owned and operated by the Northern Virginia Regional Park Authority("NVRPA"); and
WHEREAS, as part of the site development of Crescent Place, certain Town of Leesburg,
Virginia("Town")utility lines must cross the W&OD Trail; and
WHEREAS,those Town utilities which must cross the W&OD Trail consist of water lines,
sanitary sewer lines and stormwater drainage lines; and
WHEREAS, additionally, a portion of a mixed-use trail to be constructed by the developer
will connect with the W&OD; and
WHEREAS,NVRPA requires that a License Agreement be executed by the developer and
the Town to allow the crossing of its property by the Town for its utilities and for the developer to
connect the private trail to the W&OD Trail; and
WHEREAS,the Town Attorney has reviewed the License Agreement; and
WHEREAS, construction of the utility lines by LAP on behalf of the Town will benefit the
residents of the Crescent Place development.

REGIONAL PARK AUTHORITY TO ALLOW TOWN UTILITIES TO
CROSS THE W&OD TRAIL
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute the License Agreement with Leesburg Acquisition Partners
LLC and the NVRPA so long as the Town Attorney approves the License Agreement.
