RESOLUTION NO. 2015-069 ADOPTED June 9,2015
A RESOLUTION: AWARDING THE CONSTRUCTION CONTRACT FOR THE
DOWNTOWN IMPROVEMENTS PROJECT FOR KING STREET TO
MADIGAN CONSTRUCTION INC. IN THE AMOUNT OF$603,099.94.
WHEREAS,the Downtown Improvement project for King Street is an approved project
within the Town's Capital Improvement Program; and
WHEREAS,this portion of the Downtown Improvement project for King Street included
reconstruction of the curb, gutter and widened sidewalk, storm drainage,upgrading the traffic
signal at the intersection of King Street and Market Street, and crosswalk enhancements; and
WHEREAS,in response to a public solicitation for bids for construction of the Downtown
Improvements project for King Street,the Town received bids on May 14,2015 from the
following firms:
• Madigan Construction Inc. $2,149,051.25
• Jeffrey Stack Inc. $2,680,685.00
WHEREAS,the bids were evaluated by the Director of the Office of Capital Projects and
the Chief Procurement Officer in accordance with the Town Procurement Policy; and
WHEREAS,Madigan Construction Inc. was determined the lowest responsive and
responsible bidder; and
WHEREAS, staff negotiated with Madigan Construction Inc. in accordance with the
Virginia Public Procurement Act and lowered the project cost to $1,678,794.25; and
WHEREAS,items that were removed from Madigan Construction Inc.'s contract will be
performed under existing continuing services contracts for asphalt mill and overlay and some of
the traffic signal equipment in order to save costs; and

MADIGAN CONSTRUCTION INC. IN THE AMOUNT OF $603,099.94.
WHEREAS,this is a unit price contract and the estimated quantities multiplied by the unit
price have established the not to exceed contract price; and
WHEREAS, change order procedures are detailed in the bid specifications; and
WHEREAS,to construct only the work that is within the original project between Market
and Loudon Streets,no additional appropriation will be required.
THEREFORE,RESOLVED by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute a contract in a form approved by the Town Attorney with
Madigan Construction, Inc. in the amount of$603,099.74 for the construction of the Downtown
Improvements project for King Street only between Market and Loudoun Streets.
