He noted that in order to mitigate the transmission of the virus, the Board is complying with the Executive Order that suspends the requirement of the Open Meeting Law to have all meetings in a publicly accessible physical location. He noted that the Executive Order allows public bodies to meet entirely remotely as long as the public body makes provisions through adequate, alternative means to ensure that interested members of the public are provided reasonable access to the deliberations of the meeting. He noted that for this meeting the Commission is convening by video conference via Zoom App as posted on the Town’s web meeting calendar and the Commission’s agenda identifying how the public may join. He noted that the meeting may also be broadcast by HCAM TV. Mr. Ciriello made a motion to approve the August 24, 2021 Executive Session Minutes and the September 14, 2021 Minutes. The motion was seconded by Ms. Recos and roll call vote was held. • In person verse remote meeting discussion. The Commission determined to stay fully remote through February 2022. • HALT, 66 Fruit St, Trail Bridge Crossing. Mr. Chuck Dauchy, HALT, gave the Commission an overview of the proposed foot bridge on a portion of the Mary Pratt Trail. He stated the proposed bridge will span 24 feet as it needs to cross the stream and adjacent wetland area. The Commission approved the request to install the Bridge and thanked Mr. Dauchy for his work contributing to open space recreation throughout Hopkinton. 7:19 PM Rebel Hill, LLC, 188 Fruit Street DEP File No. 188-____ Abbreviated Notice of Resource Area Delineation The hearing was legally opened and continued without discussion to January 25, 2022. 7:20 PM Rebel Hill, LLC, 190 Fruit Street DEP File No. 188-____ Abbreviated Notice of Resource Area Delineation The hearing was legally opened and continued without discussion to January 25, 2022. 7:21 PM Vision Construction & Design, 178 Ash Street DEP File No. 188-1638 Amended Notice of Intent Jamie Bissonnette, Zenith Consulting Engineers; James Burton, property owner Mr. Bissonnette gave the Commission an overview of the Amended Notice of Intent and Septic/Well site plan dated September 14, 2017 revised through April 1, 2021 and BZ Mitigation plan dated September 23, 2021, revised through October 14, 2021. The Commission reviewed the Lucas Environmental memo dated November 15, 2021. Mr. Bissonnette stated the single family dwelling roof square footage has been reduced since the original proposal and stated the applicant sees the change as a beneficial impact to the dry wells. He stated the applicant is happy to install permanent immovable barriers, but is looking for guidance. Ms. Ciaramicoli stated she will be able to provide that guidance. Mr. Bissonnette stated there was buffer zone disturbance beyond the approved limit of work and the applicant is looking for guidance on the mitigation plan. The Commission determined that Ms. Ciaramicoli and Lucas Environmental can help the applicant with that. Ms. Ciaramicoli gave the Commission some background information on the original application and reviewed the following items: - Approved Single Family House with Well and Septic System - Construction began without the required pre-construction site visit - Erosion and sedimentation controls improperly installed and not-survey located - Contractor following a plan that wasn’t approved Ms. Ciaramicoli stated she determined the best next steps were to have the applicant file an Amended Notice of Intent and to propose mitigation for the disturbance past the approved limit of work. Hopkinton Conservation Commission November 16, 2021 Page 3 of 4 A discussion was held as to why the contractor was using the wrong plan and how Town staff reviews applications. Mr. Bissonnette stated some of the guidance the applicant is looking for regarding the planting schedule is to verify that a mix of type and sizes of plants is appropriate. The Commission welcomed Mr. Orzel to the staff and thanked Mr. Varrell for his hard work on behalf of the Commission over the past few years. Adjourn: 7:45 PM
