RESOLUTION NO. 2015-103 ADOPTED September 22, 2015
A RESOLUTION: AUTHORIZING THE EXECUTION OF A CONTRACT BETWEEN THE
TOWN OF LEESBURG AND AQUA-AEROBIC SYSTEMS, INC FOR
REFURBISHMENT OF THE SAND FILTER FACILITY AND
EQUIPMENT AT THE WATER POLLUTION CONTROL FACILITY;
AND AUTHORIZING A SOLE SOURCE PROCUREMENT FOR THE
PROJECT AND AUTHORIZING THE TOWN MANAGER TO
PROCURE THESE SERVICES
WHEREAS, the Town of Leesburg ("the Town") owns and operates a wastewater
treatment plant; and
WHEREAS, the sand filter facility and equipment refurbishment project is a fully funded
capital asset(3R) replacement project in the Fiscal Year 2016 budget; and
WHEREAS,the contract proposal for the refurbishment project is $520,000; and
WHEREAS, Aqua-Aerobic Systems, Inc is the sole sourced vendor to match existing
equipment; and
WHEREAS,the contract is subject to the Virginia Public Procurement Act ("VPPA"); and
WHEREAS, Code of Virginia, § 2.2-4303(E) of the VPPA allows for sole source
procurement if there is only one source "practicably available"; and
WHEREAS, the contract has been reviewed and approved by the Town's Chief
Procurement Officer; and the Director of Utilities recommends the completion of the
refurbishment project; and
SECTION I. THEREFORE, RESOLVED by the Council of the Town of Leesburg in
Virginia that the Town Manager is authorized to execute a contract, in a form approved by the

AND AUTHORIZING A SOLE SOURCE PROCUREMENT FOR THE
REFURBISH PROJECT AND AUTHORIZING THE TOWN MANAGER
TO PROCURE THESE SERVICES
Town Attorney, with Aqua-Aerobic Systems, Inc in the amount of $520,000 for the sand filter
facilty and equipment.
SECTION II. The Town Council determines that only one source is practicably available
for the procurement of the refurbishment of the sand filter facility and equipment and directs that
this Resolution be posted on the public notice board in the town offices for a period of ten (10)
days.
SECTION III. The Town Manager is hereby authorized to procure the sole source contract
for refurbishment of the sand filter facility and equipment by Aqua-Aerobic Systems, Inc.
