Members present: of the City of Medina met in regular session on Tuesday, July 3, 1979 at Mayor, Thomas Anderson; Councilmembers, Sarah Lutz, Nancy Laurent, Thomas Crosby, William Reiser; clerk -Treasurer, Donna Roehl{ planning and Zoning Administrator, Robert Derus; Police Chief, Charles Hoover; Public Works Director, Ron Duran; Engineer, Lyle Swanson; Attorney Riohard Schieffe Assessor, william Dredge; Building Inspector, Loren Kohnen 1. Minutes of June 19, 1979 Motion by Laurent, seconded by Lutz to approve the minutes of June 19, 1979, as presented. Motion declared carried 2. PUBLIC WORKS DEPARTMENT Road Grader Mayor Anderson stated that he would be relying on the road committee's recommendation when making his deoision. Representative of Borchert -Ingersoll asked that he be allowed to report that no municipality in the state of Minnesota owns a 14G road grader as they are to large and expensive to own. Thomas Crosby reported that the Orono public Works Director had stated that Medina could use this type of machine but that he still was not convinced that Medina needed such a large machine. William Reiser stated that he too felt that it was to big of a machine but that the road committee had spent a great deal of time in making its recommendations. Nancy Laurent stated that Medina will have gravel roads for a long time and will need to do a lot of repair work. Motion by Laurent, seconded by Reiser to purchase a Caterpillar 14G road grader from Ziegler's at a cost of $130,511, under a year payment plan with 7% interest. Motion carried Voting No, homas Crosby Northwestern Bell Telephone Co. Motion by Reiser, seconded by Crosby to adopt Resolution 79-34 allowing Northwestern Bell Telephone Co. to install poles on pioneer Trail. Motion declared carried Minnesota Gas Co. Motion by Laurent, seconded by Lutz to adopt Resolution 79-35 allowing Minnegasco to bury gas lines to serve 430 Red Fox Dr. Motion declared carried Hunter Farms Roads Ron Duran requested that he and the Engineer be authorized to inspect the wads in Minter Farms and inform Darrell Farr of the work that needs to be completed. Motion by Crosby, seconded by Lutz to authorize the inspection and preparation of a list of work that needs completion on the Hunter Farms roads and stipulate that the work is to be done within 2 weeks. Motion declared carried Dust Control Discussion of the substance "Black Magic" which has been applied to control dust to several problem roads. Ron Duran stated that the cost of the material is $1.00 per foot and that several property owners have stated that they would pay for the material if it were put on roads fronting their properties. Motion by Crosby, seconded by Lutz to charge $1.00 per foot for the "Black Magic" material to all future property owners and not to charge those property owners already benefitt- ing from the substance as it was considered an experimental project. Motion declared carried 3. CABLE TV Donna Roehl was asked to contact the appropriate body regarding having Medina included in a Cable TV region. 4. POLICE DEPARTMENT (-p Labor Negotiations 9,3 Discussion of he proposal of Labor Relations Associates Inc. Thomas Crosby reported that they appear to be a competent firm and have been engaged in many negotiations. Richard schieffer stated that as the contract would probably go to arbitration he would sug- gest a flat fee rather than an hourly rate of pay. Motion by Crosby, seconded by Lutz to employ the firm of Labor Relations Associates Inc. at a flat rate of $2000. with the city reserving the right to haveseveral individuals of the firm as Medina's representatives, rather than one partioular individual. Motion declared carried Thomas crosby stated that it was up to the Medina police officers to take the next step. Council discussed the need for a council representative to be involved in the negotiating. Thomas Crosby stated that two counoilmembers should be involved so as to have two opinions. He agreed to serve as a representative as did Sarah Lutz who stated that she is familiar with negotiations. Mike Rouillard Chief Hoover asked if Mike Rouillard would be allowed to have his police car at home if he were to move out of the Medina area. Mayor Anderson stated that Council would need to make apolicy decision regarding the matter. 5. ASSESSOR Assessor Bill Dredge discussed assessing possibilities for Medina. He stated that if Hennepin County were to do Medina's assessing they would want from $13-14,000. He stated that Rolf Ericson, a present employee of Hennepin County, would be doing Corcoran's assessing and that he is interested in assessing for Medina as is Howard Triggs, assessor for Hassan. He added that he wishes to continue Medina's work but that he would want more money. Mayor Anderson stated that he had met with Don Monk of Hennepin County and Bill Dredge as Mr. Dredge appeared to be having problems with the Hennepin County system. Mr. Monk had said that if a change in assessors were to be made it should be made very soon. Council decided to discuss Medina's assessing with each applicant individually. William Dredge He stated that he had not understood the computer work as well as he should have. He discussed agricultural classifications, also Green Acres. He felt that Hennepin County had made to much of an increase at one time although Lake Independence valuations were substantiated by com- paring to other Lakeshore properties. He stated that he wished to continue as Medina's assessor but that he would want $200 more per month for the coming year. Rolf Ericson He stated that he does not feel that Hennepin County is trying to take over all of the assess- ing in Hennepin County. He felt that the County would have no problems working with him as an independent assessor. He explained that he will be working for the County until August and will be paid $10,400 by Corcoran. His fee for Medina would be based on various aspects including the number of parcels, number of new homes, etc. He stated that when he helped in Medina he assessed new houses only using a rate that had been used in other areas. He felt that the assessing year should begin in july. Thomas crosby stated that Medina should be notified immediately if Medina's work is falling behind schedule. Thomas Anderson asked that both Mr. Dredge and Mr. Ericson present a proposal at the july 17th meeting along with any other person interested in assessing for Medina. 6. AUDIT REPORT Mark Babcock, accountant, appeared to answer questions regarding the 1978 audit report. He explained the reason for the deficit in the sewer and water funds is the fact that depre- ciation is taken on the systems. He explained that it is not unusual for growing communities to experience deficits in the general fund. He also explained the accrual method of the aduiting that was done for 1978. Motion by Crosby, seconded by Lutz to approve the 1978 audit report as prepared by Hanson and Babcock and to make copies available in the City Office, the Medina Library and the Hamel Bank. Motion declared carried 224 7. DON DYKHOFF VARIANCE Robert Derus explained that the proposed garage is to be used for storage and a car port. The location would be 40 ft. from the edge of the blacktop or 30 ft. from the property line. mayor Anderson asked if 2 driveways could be built. He expressed concern that a precedent could be set if the variance were approved for the Banter Farms area. Thomas Crosby stated that he would want to be consistent with the zoning ordinance. Sarah Lutz stated that this proposalshould not be offensive to the owners of the abutting lot. Nancy Laurent stated that she could see no problem with the way Mr. Dykhoff wished to locate the garage. Mayor Anderson stated that Council would have a problem with the next request that would come from the Hunter Farms area if this variance were approved. Nancy Laurent stated that she would rather see a garage where Mr. Dykhoff wants to put it than where the council want it located. Richard schieffer stated that a hardship which is unique to the property must be demonstrated. Robert Derus stated that the only hardshiphe could see was aesthetic and perhaps monetary in that a second driveway would need to be built. Motion by crosby, seconded by Reiser to deny the variance to Don Dykhoff because - suffioent hardship has not been shown. Motion carried Voting No, Sarah Lutz 8. SEWAGE DISPOSAL ORDINANCE Robert Derus explained several problems with the proposed ordinance and asked that it be referred back to the planning Commission. phil zietlow, planning Commission member, stated that a provision would be written whereby innovative systems would be allowed if a conventional system is failing and on 10 acre sites. Emil jubert stated that he would rather see innovative systems allowed on 5 acre sites. Attorney Schieffer asked how the Planning Commission proposed to control location of such a system. phil zietlow explained that a special permit would be needed and the septic system site will determine the placement of the house. Thomas crosby stated that there should be a majority and a minority opinion on the 5 and or 10 acre minimums suggested by the planning Commission. He also asked if the acreage requirement could stand attack. Attorney Schieffer stated that data would be needed to back up an acreage requirement or the city could take a posistion that a homeowner on large acreages would be allowed to pollute his own property. Robert perms asked that the attorney and engineer be authorized to review the ordinance before presenting to the Council. Motion by Laurent, seconded by Crosby to authorize the Planning Commission to have the attorney and engineer review and comment on the sewage disposal ordinance. Motion declared carried 9. HERB BEATTY VARIANCE Robert Derus reported that the Pere Test on Lot 1, Block 1, Paradise Haven is 80-548 min. per inch. Thomas Anderson asked if the Council would have a problem in view of the fact that there are electro-osmosis systems in Hunter Farms and on Co. Rd. 24. Richard Schleifer stated that the city must be told how the system works so that it could be inspected. Mr. Beatty stated that Plymouth and some other cities allow these systems, they are working, and perhaps something could be learned from them. Robert Derus explained that there is no monitoring criteria. Mr. Beatty asked if the size of the lot would make a difference if information could be gotten from Mr. Coolbrath, the originator of the system. Thomas Crosby stated that the only way that it could be allowed would be as an experimenta system. Notion by Reiser, seconded by Crosby to table the variance request until design criteria information is received. motion declared carried 10. MEDINA MORNINGSIDE SEWER 22 Thomas crosby stated that Allen Olson had reported to him that neither of Mr. Keller's requests for 23 or 35 lots would have made any difference in Orono's determination not to allow additional property to be included in the area to be served by sewer. Mayor Anderson stated that he felt that the request was an issue that would no longer need to be discussed. 11. SAC CHARGE ORDINANCE AMENDMENT Motion by Crosby, seconded by Reiser to adopt Ordinance 184,•amending Ordinance 149, regarding amount of sewer Availability Charges to be collected. Motion declared carried 12. COMMUNITY DEvEIOPMENT BLOCK GRANT FUNDS Motion by Crosby, seconded by Lutz to amend application for Year V Community Development Funds to include repair of the Hamel sewer system. Motion declared carried Dogma Roehl reported that she would find out whether a new income survey would be needed for the Hamel area. 13. CITY OFFICE PATTING Donna Roehl presented 2 quotes for painting the police office and the Clerk's office and some outside painting: Don Benson--$461.00; Tom Roehl--$520.00 Motion by Reiser, seconded by Crosby to hire Don Benson to do the painting as listed in quote for a total of $461.00 Motion declared carried 14. CITY HALL TELEPHONE CHANGES Motion by Crosby, seconded by Reiser to apply the credit received from overbilling by Northwestern Bell Telephone Co. to additional services as outlined by the telephone company. Motion declared parried 15. BILLS Motion by Crosby, seconded by Reiser to pay the bills. Order Checks # 8160-8222 in the amount of $36,013.21 and payroll Checks # 5389-5414 in the amount of $7,857.84. motion declared carried 16. PARK COMMITTEE Council asked that Clerk write a letter to the Park Committee commending them for the work they have been doing and to ask them to act as an advisory group in budgeting, operations, and future development with the understanding that the Council makes all Bits► decisions. 17. PLANNING COMNIISSION ATTENDANCE Discussion of absenteeism at planning Commission meetings. Various alternatives for correcting the problem was discussed.
