HomeMy Public PortalAbout2015_11_10_R136 TLTA 2014-0001 Crescent District Land Uses The Town of Leesburg, Virginia PRESENTED: November 10, 2015 RESOLUTION NO. 2015-136 ADOPTED: November 10, 2015 A RESOLUTION: ADOPTING TOWN PLAN AMENDMENT TLTA-2014-0001, CRESCENT DISTRICT LAND USES, REVISING THE PLANNED LAND USES, AND RECLASSIFYING DAVIS AVENUE AS A THROUGH COLLECTOR ROAD. WHEREAS, Lansdowne Development Group, LLC, has requested that the Town Plan's Crescent District Land Use Policy Map be amended to reflect a change in planned land use from Commercial/Mixed-Use and Open Space to Residential as depicted on Exhibit A; and WHEREAS, Lansdowne Development Group, LLC, has also requested that the Town Plan's Roadway Network Policy Map be amended to reflect Davis Avenue as a Through Collector Road as depicted on Exhibit B; and WHEREAS, the Applicant has concurrently submitted a rezoning application, TLZM 2013- 0006,which proposes a mix of retail, office and residential uses north of Tuscarora Creek and residential uses south of Tuscarora Creek; and WHEREAS,the submitted a rezoning application, TLZM 2013-0006, depicts Davis Avenue as a Crescent District"General Street"; and WHEREAS, the Planning Commission held a duly advertised Public Hearing on June 4, 2015; and WHEREAS, at their June 4, 2015 meeting,the Planning Commission recommended denial of the land use changes and reclassification of Davis Avenue requested by Town Plan Amendment TLTA 2014-0001; and WHEREAS, staff recommends denial of the land use changes and reclassification of Davis - 2 - RESOLUTION: ADOPTING TOWN PLAN AMENDMENT TLTA-2014-0001, CRESCENT DISTRICT LAND USES, REVISING THE PLANNED LAND USES, AND RECLASSIFYING DAVIS AVENUE AS A THROUGH COLLECTOR ROAD. Avenue requested by Town Plan Amendment TLTA 2014-0001; and WHEREAS, Town Council held a duly advertised Public Hearing on October 13, 2015; and WHEREAS, Town Council has determined that the approval criteria of Zoning Ordinance Section 3.16.12 have been satisfied; and WHEREAS, Town Council has determined that the planned land uses,proposed by Town Plan Amendment TLTA 2014-0001, provides a more compatible land use pattern that promotes the health, safety, convenience,prosperity and general welfare for Leesburg. WHEREAS, Town Council has determined that the reclassification of Davis Avenue as a Through Collector Road, proposed by Town Plan Amendment TLTA 2014-0001, will provide sufficient capacity for the anticipated residential development of the adjacent property and promotes the health, safety, convenience, prosperity and general welfare for Leesburg. THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that TLTA-2014-0001 Crescent District Uses and Reclassification of Davis Avenue is hereby approved as described: 1. The Town Plan's Crescent District Land Use Policy Map is amended to reflect a change in planned land use from Commercial/Mixed-Use and Open Space to Residential as depicted on Exhibit A; and 2. The Town Plan's Roadway Network Policy Map is amended to reflect Davis Avenue as a Through Collector Road as depicted on Exhibit B. 3. Insert the following text on Page 9-16 of the Town Plan: Davis Avenue-Gateway Drive Extended - 3 - RESOLUTION: ADOPTING TOWN PLAN AMENDMENT TLTA-2014-0001, CRESCENT DISTRICT LAND USES, REVISING THE PLANNED LAND USES, AND RECLASSIFYING DAVIS AVENUE AS A THROUGH COLLECTOR ROAD. 1. Require a minimum 70' right-of-way dedication and construction as development occurs. 2. Construct two travel lanes with on-street parking with required turning lanes, or additional travel lanes as required by a traffic impact analysis. 3. Construct street sections in accordance with Crescent District street sections.
