A RESOLUTION: INITIATING TOWN CODE AMENDMENTS AND A PERMIT
PROCESS TO AUTHORIZE AND REGULATE OUTDOOR DINING,
INCLUDING THE SERVICE AND CONSUMPTION OF ALCOHOLIC
BEVERAGES, ON TOWN SIDEWALKS AND PUBLIC RIGHT-OF-
WAY.
WHEREAS, the widening and expansion of Town sidewalks has occurred in the
downtown as a result of the Downtown Improvements Capital Improvement Project; and
WHEREAS, downtown restaurant owners have inquired about utilizing these expanded
sidewalks for outdoor dining including the service and consumption of alcoholic beverages; and
WHEREAS, in order to permit outdoor dining on the Town's sidewalks, an application and
permitting process is advisable, similar to the application and permitting process for use of the
Town's streets; and
WHEREAS, in order to permit outdoor dining on the Town's sidewalks, including the
service and consumption of alcoholic beverages, sections of the Town Code which currently
prohibit encroachments and the consumption of alcohol in public, must be amended.
THEREFORE, RESOLVED,the Council of the Town of Leesburg in Virginia directs the
Town Attorney to prepare amendments to the Town Code and a permitting process to authorize
and regulate outdoor dining, including the service and consumption of alcoholic beverages, on
Town sidewalks and Town owned right-of-way.
