ORDINANCE AMENDING CHAPTER 7 OF THE LYNWOOD MUNICIPAL CODE TO PROHIBIT DRIVING OF TRUCKS ON LONG BEACH BOULEVARD AND PARKING OF TRUCKS ON PROPERTY ALONG LONG BEACH BOULEVARD Comments: On November 7, 2000 City Council adopted the urgency Ordinance No. 1499 prohibiting the driving of trucks on Long Beach Boulevard and parking of trucks on property along Long Beach Boulevard. Staff now request that the City Council hold the public hearing and introduce the permanent ordinance relative to this matter. Recommendations: It is recommended that the City Council hold the public hearing and introduce the attached ordinance amending Chapter 7 of the Lynwood Municipal Code, Vehicles and Traffic. CONSENT CALENDAR All matters listed under the Consent Calendar will be acted upon by one motion affirming the action recommended on the agenda. There will be no separate discussion on these items prior to voting unless members of the Council or staff request specific items be removed from the Consent Calendar for separate action. 11. DISABILITY RETIREMENT OF STEPHEN P. STEWART Comments: The Workers' Compensation Appeals Board declared Stephen Stewart a permanent and stationary injured safety employee January 29, 1990. Mr. Stewart was assigned to a mandatory permanent modified program as a Management Aide in the Fire Department a position he held up to October 31, 2000 upon the transition to Los Angeles County for fire services. Recommendations: That the City Council adopt the attached resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE DISABILITY RETIREMENT OF STEPHEN P. STEWART PURSUANT TO SECTION 21156 OF THE GOVERNMENT CODE." 2 12. WARRANT REGISTER: Comments: City of Lynwood warrant registers for December 28, 2000 and January 2, 2001 FY 2000-2001. REQUEST FROM AT&T BROADBAND FOR CITY OF LYNWOOD TO WAIVE FRANCHISE FEES ON AT&T ROAD RUNNER CABLE MODEM SERVICES Comments: To inform the Lynwood City Council of the letter from AT&T Broadband requesting the City of Lynwood to waive the franchise fees on AT&T road Runner cable modem services. Recommendation: Staff respectfully recommends that the Lynwood City Council review the attached draft letter to AT&T Broadband for approval and provide further direction to staff. 14. BACKGROUND: During the recent months, the City Council has become more and more concerned with the increase of commercial truck traffic on Long Beach Boulevard, particularly construction trucks that use Long Beach Boulevazd as a connector for the Alameda Corridor from the I-105 Freeway. City Council also raised concern about lazge commercial trucks pazking on private property along Long Beach Boulevazd, which represent a nuisance to the community. On November 7, 2000, City Council adopted urgency Ordinance No. 1499 prohibiting the driving of trucks on Long Beach Boulevard and parking of trucks on property along Long Beach Boulevard. ANALYSIS: Since the urgency ordinance is only valid for a limited time, the law requires that the City hold a public hearing, introduce and adopt a permanent ordinance relative to this matter. Staff has published the Notice of Public Hearing on the local newspaper (see attached copy of Proof of Publication). AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING SECTION 7-17.1 OF, AND ADDING SECTIONS 7-17.2 AND 7-17(~ TO THE LYNWOOD MUNICIPAL CODE WHEREAS, the City of Lynwood is a general law city located in the County of Los Angeles, and organized and existing under and by virtue of the laws and constitution of the State of California; and WHEREAS, the right to operate motor vehicles - a potentially dangerous undertaking - in public places is not a natural and unrestrained right, but rather a privilege subject to reasonable regulations enacted under the police power and in the interest of public safety; and WHEREAS, the legislative power to regulate travel over public roads is thus extensive and may be exercised in any reasonable manner to conserve the safety of travelers and pedestrians; and WHEREAS, pursuant to California Vehicle Code Section 21, a local government may, in the interest of the public welfare, enact and enforce an ordinance relating to the use of motor vehicles on public roads when authorized by State law to do so; and WHEREAS, California Vehicle Code Section 35701 allows a City to prohibit, by ordinance, the use of a street by any commercial vehicle so long as appropriate signs aze erected indicating the streets affected by the ordinance or those not affected; and WHEREAS, California Vehicle Code Section 21101 similarly allows a City to prohibit, by ordinance or resolution, the use of particulaz highways by certain vehicles; and WHEREAS, commercial trucks driven on Long Beach Boulevazd in the City of Lynwood have posed substantial inconveniences and hazards to other traffic on this street, particulazly when the commercial trucks turn, back into the street, or break down; WHEREAS, these inconveniences and hazards may intensify during and after construction of the Alameda Corridor; and WHEREAS, California Government Code 38773 allows the City to summarily abate both current and potential nuisances; and WHEREAS, California Civil Code Section 3479 includes, in its broad definition of what constitutes a regulable nuisance, anything which is indecent or offensive to the senses, obstructs the free use of property so as to interfere with the comfortable enjoyment of life or property, or unlawfully obstructs the free passage or use, in the customary manner, of any public street or highway; and WHEREAS, pursuant to Government Code Section 38771, the City Council may declaze, by ordinance, whalt constitutes a nuisance; and _ _ WHEREAS, tucks parked on commercial property along Long Beach Boulevazd interfere with the provision of emergency services when, by their presence, they prevent police, fire fighters, and pazamedics from easily accessing the reaz entrances of neazby buildings; and WHEREAS, trucks parked along Long Beach Boulevard aze also aesthetically unattractive; and WHEREAS, for these reasons the City Council declares the parking of such trucks on commercial property along Long Beach Boulevazd to be a nuisance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY ORDAIN IS FOLLOWS: Section 1. That Section 7-17.1 be rewritten to read as follows: 7-17.1 Establishment and Designation of Truck Traffic Routes. The streets and highways in the City hereinafter identified are designated as truck traffic routes, and the Traffic Engineer shall cause signs to be erected giving notice thereof: Alameda Street Atlantic Avenue Drury Lane Imperial Highway Martin Luther King Jr. Boulevazd Norton Avenue from Drury Lane to Santa Fe Avenue Santa Fe Avenue from Martin Luther King Jr. Boulevazd to Norton Avenue Stanford Avenue Wright Road from Duncan Avenue to Martin Luther King Jr. Boulevazd Section 2. That a new Section 7-17.2 be added, to read as follows: 7-17.2.OPERATING COMMERCIAL VEHICLES ON LONG BEACH BOULEVARD PROHIBITED. (a) Notwithstanding anv other provision of this Code, it shall be unlawful for anv person to operate commercial vehicle weighing 8,500 pounds or more or having a width equal to or greater than eighty-four (84) inches as measured at the widest portion of the body, not including mirrors or other extensions, or having a height of eighty-four (84) inches or more, for an distance along any part of Long Beach Boulevazd in the City of L nwood. (b) This prohibition shall be noticed by the City Traffic Engineer in accordance with Section 7-18 of this Code. (c) This prohibition does not apply to commercial vehicle which temporarily turns onto Long Beach Boulevazd as an unavoidable result of an emergency which threatens life or safety and for such time as is necessary for the emergency to pass (d) For purposes of this section, the term "commercial vehicle" has the same meaning as in Vehicle Code Section 260(a) : Specificall , a vehicle of a type required to be registered under the Vehicle Code, used or maintained for the transportation of persons for hire, compensation, or profit or designed, used, or maintained primarily for the transportation of grope Passenger vehicles which aze not used for the transportation of persons for hire, compensation, or profit and housecazs are not commercial vehicles, nor is any vznpool vehicle. That a new Section 7-17(j) be added to the Lynwood Municipal Code to read as follows: (j) Pazking of commercial vehicles on property located along Long Beach Boulevazd prohibited. (1) It is unlawful to park or leave standing any commercial vehicle weighing 8,500 pounds or more or having a width equal to or greater than eighty-four (84) inches as measured at the widest portion of the body, not including mirrors or other extensions, or having a height of eighty-four (84) inches or more, on any part of any pazcel of property any side or portion of which is located along Long Beach Boulevazd in the City of Lynwood. (2) This prohibition shall not apply to any vehicle: (a) which is immobile due to emergency, accident or mechanical breakdown. Such vehicles may remain parked for the period of time needed to either render the vehicle again safe and fit for travel; or to remove the vehicle to a garage or other location at which it can be so made. In no event, however, shall such a vehicle remain pazked for more than eight (8) hours. (b) which is pazked in connection with and in aid of the performance of a service to or on property on which the vehicle is pazked, and for such time as is reasonably necessary to complete such permitted service. (c) which is in the process of loading or unloading. (3) For purposes of this section, the term "commercial vehicle" has the same meaning as in Vehicle Code Section 260(a) : Specifically, a vehicle of a tune required to be registered under the Vehicle Code, used or maintained for the transportation of persons for hire, compensation, or profit or designed, used, or maintained primarily for the transportation of property. STEWART OBJECTIVE: To have the City Council approve the disability retirement of Stephen P. Stewart pursuant to Section 21156 of the Government Code. BACKGROUND: On February 7, 1988, the City of Lynwood City Council per Resolution No. 89-39, approved a Letter of Understanding between the City of Lynwood and the Lynwood Firefighters' Association establishing a Mandatory Permanent Modified Program. The intent of the program was to bring injured firefighters back to work in a modified position which would meet the medical restrictions of the employee. The Workers' Compensation Appeals Board declared Stephen Stewart a permanent and stationary injured safety employee January 28, 1990. Mr. Stewart was assigned to the position of Management Aide in the Fire Department a position he held up to October 31, 2000 upon the transition to Los Angeles County for fire services. Mr. Stewart has applied for a disability retirement from the City of Lynwood. Section 21025 of the California Government Code provides that, in the case of a local safety member, the governing body of the contracting agency employing such member shall determine whether the member is incapacitated for the performance of duty. Section 21025 requires that the determination be made within six months of the request from PERS. RECOMMENDATION: That the City Council adopt the attached resolution entitled, "A Resolution of the City Council of the City of Lynwood Approving the Application for Disability Retirement of Stephen P. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE APPLICATION FOR DISABILITY RETIREMENT OF STEPHEN P. STEWART PURSUANT TO SECTION 21156 OF THE GOVERNMENT CODE WHEREAS, the City of Lynwood (hereinafter referred to as Agency) is a contracting agency of the Public Employee's Retirement System; and WHEREAS, the Public Employee's Retirement Law requires that a contracting agency determine whether an employee of such agency in employment in which he is classified as a local safety member is disabled for purposes of the Public Employee's Retirement Law and whether such disability is "industrial" within the meaning of such Law; and WHEREAS, an application for disability retirement of Stephen P. Stewart employed by the Agency in the position of Firefighter has been filed with the Public Employees' Retirement System; and WHEREAS, the Lynwood City Council has reviewed the medical and other evidence relevant to such alleged disability; and WHEREAS, there is not a possibility of third party liability; and WHEREAS, the primary disabling condition is orthopedic; and WHEREAS, advanced disability pension payments will not be made. NOW, THEREFORE, BE IT RESOLVED, that the Lynwood City Council find and determine that Stephen P. Stewart is incapacitated within the meaning of the Public Employee's Retirement Law for performance of his duties in the position of Firefighter; and BE IT FURTHER RESOLVED THAT THE Lynwood City Council find and determine and it does find and determine that such disability is a result of injury or disease arising out of and in the course of employment. BE IT FURTHER RESOLVED THAT A PETITION was filed with the Workers' Compensation Appeals Board for a determination pursuant to Section 21166, Government Code; and a copy of such determination is attached; and BE IT FURTHER RESOLVED that the member was separated from his employment in the position of Firefighter after expiration of his leave rights under Section 21164, Government Code, effective October 31, 2000 and that no dispute as to the expiration of such leave rights is pending. And, to fiuther inform the Lynwood City Council that AT&T Broadband intents to discontinue, effective January 2001, the payment of franchise fees on cable modem service based on a recent court decision in AT&T v. City of Portland. BACKGROUND: The City of Lynwood received a letter from AT&T Broadband in which it expressed its intent to discontinue the portion of franchise fees paid to local franchising authorities relative to cable modem service (AT&T Road Runner). Its decision is based on the recent Ninth Circuit Court of Appeal ruling in ATdcT v. City of Portland, in which the court questioned whether local franchising authorities have the right to assess cable service franchise fees on cable modem service revenue. Also, because the Federal Communications Commission ("FCC") is in the process of determining whether or not cable modems for Internet services provided by cable operators is indeed a "cable service." Because of the Portland decision, AT&T Broadband believes that the City of Lynwood would potentially be exposed to future refund liability, if it continues to assess franchise fees on cable modem service revenue. AT&T Broadband is therefore requesting the City of Lynwood to waive the franchise fees on cable modem service until the FCC makes a determination as to whether cable modem service is a "cable service". To appropriately respond to AT&T Broadband, staff contacted Attorney William Rudell of the law firm of Richards, Watson & Gershon, who has provided special counsel to the City relative to cable franchise matters. ANALYSIS: Attorney William Rudell, being thoroughly familiar with the recent court decision in AT&T v. Citx of Portland has drafted a letter to ATBcT Broadband on behalf of the City of Lynwood for the review and approval of the Lynwood City Council in which to provide further staff direction. The letter identifies the likely concerns of the City of Lynwood relative to the financial impact the discontinuance of payment of franchise fees ~n cable modem service would have, and asks AT~T Broadband to respond to the following pertinent questions: How many subscribers to cable modem service does AT&T Broadband currently in the City of Lynwood? 2. What is the monthly amount of franchise fees received from subscribers who have cable modem service? 3. The letter indicates that the City of Lynwood expects AT&T Broadband to keep track of all franchise fees that would otherwise be paid on cable modem service and to provide quarterly reports of the amount. As you know, we have been providing cable modem service to subscribers as a cable service and paying the City of Lynwood a 5°r6 franch~e fes on that revenue (which fee we pass through to subscribers as authorized under federal law). Under the Ninth Circuit Court of Appeal's recent decision in ATBT v. Citv of Partland,~ it appears that the Ninth Circuit Court does not consider this to be a °cable service." Thus. at least in the Ninth Circuit. there is a serious question as to whether local franchising authorities have the right to assess cable service franchise fees on cable modem service revenue. Currently, the Federal Communications Commission {"FCC") has a proceeding under way that may ultimately help resolve this issue.2 In addition, there is other pending litigation, and courts outside this Circuit have rendered opinions that might lead to a conclusion different from the apparent conclusions in the Portland decision. Nonetheless, in light of the P Ian decision, there is some risk that the City of Lynwood would be exposed to potential refund liability in the future, should it continue to assess franchise fees on cable modem service revenue. At least one local government has determined to eliminate this risk by waiving the franchise fee on cable modem service at this time. Other local governments, while continuing to assess the fees, have decided to deposit them into an escrow type account so that such fees will be available for refund at such time as a court of competent jurisdiction or the FCC determines whether a refund is necessary. Given the uncertain nature of the law regarding franchise fees on cable modem service, we believe that it is in the best interests of the City of Lynwood, as well as ATBT Broadband, to waive these franchise fees {and suspend the pass-through of such fees to subscribers) until this issue is settled. Suspension of franchise fees on ATBT Road Runner is particularly important in states within the Ninth Circuit, because of the existence of state consumer protection laws which often give rise to class action or other litigation.
