HomeMy Public PortalAbout2016_03_08_R042 Initiating Amendments to the ZO re Repealing the H-2 Overlay District The Town of Leesburg, Virginia PRESENTED March 8, 2016 RESOLUTION NO.: 2016-042 ADOPTED March 8, 2016 A RESOLUTION: INITIATING AMENDMENTS TO THE LEESBURG ZONING ORDINANCE FOR THE PURPOSE OF REPEALING THE H-2 HISTORIC CORRIDOR ARCHITECTURAL CONTROL OVERLAY DISTRICT AND THE ASSOCIATED PROVISIONS IN THE ORDINANCE RELATED TO THE IMPLEMENTATION OF THE H-2 OVERLAY DISTRICT INCLUDING BUT NOT LIMITED TO: ARTICLES 2, 3, 7,AND 15. WHEREAS,the Town of Leesburg Zoning Ordinance (TLZO) was adopted with public input and for the purpose of protecting the health, safety, and welfare of Town residents and businesses by providing regulation of land uses; and WHEREAS, on August 9, 1988, the Town Council initiated a new article to the Zoning Ordinance which would create an architectural control district that encompasses parcels of land contiguous to arterial streets serving as gateways to the Town and its historic landmarks, buildings, structures and to the H-1 Old and Historic District; and WHEREAS, the intended development of this architectural control district was to enhance and protect the entrance corridors to the Town National Register Historic District by promoting design principles for non-residential development to create a better sense of transition between the H-1 Old and Historic District and the more contemporary outlying areas in Town; and WHEREAS, the adopting Ordinance (Ordinance 90-0-02) approved by Town Council on January 23, 1990 stated that: "The purpose of these historic corridor regulations is to implement the Town Plan goal of ensuring quality urban design compatible with Leesburg's historic, architectural and tourist resources through architectural control along the Town's arterial routes -2- A RESOLUTION: INITIATING AMENDMENTS TO THE LEESBURG ZONING ORDINANCE FOR THE PURPOSE OF REPEALING THE H-2 HISTORIC CORRIDOR ARCHITECTURAL CONTROL OVERLAY DISTRICT AND THE ASSOCIATED PROVISIONS IN THE ORDINANCE RELATED TO THE IMPLEMENTATION OF THE H-2 OVERLAY DISTRICT INCLUDING BUT NOT LIMITED TO: ARTICLES 2, 3, 7, AND 15. to the Old and Historic District. The protection of these vital corridors which form the traditional gateways to Leesburg's historic district will stabilize and improve property values; protect and enhance the town's attraction to tourists and visitors; and will support and stimulate complimentary development appropriate to the prominence afforded properties contiguous to Leesburg's major arterial routes. Benefits attributable to the promotion of superior design and appearance of structures constructed and altered along the town's arterial highways will ultimately promote the public health, safety and general welfare of the citizens of the town." ; and WHEREAS,the H-2 Overlay District currently includes the segment of East Market Street outside of the Bypass (1000 feet from the right-of- way centerline), West Market Street (300 feet from right-of-way centerline) and North and South King Streets (500 feet from the right-or-way centerline); and WHEREAS,the Town Council has concerns that the H-2 Historic Corridor Architectural Control Overlay District,through administration of the H-2 Design Guidelines, has generally not been effective in resulting in the quality architectural building and site design as was originally anticipated and can unnecessarily add complexity to the land development review process. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: -3- A RESOLUTION: INITIATING AMENDMENTS TO THE LEESBURG ZONING ORDINANCE FOR THE PURPOSE OF REPEALING THE H-2 HISTORIC CORRIDOR ARCHITECTURAL CONTROL OVERLAY DISTRICT AND THE ASSOCIATED PROVISIONS IN THE ORDINANCE RELATED TO THE IMPLEMENTATION OF THE H-2 OVERLAY DISTRICT INCLUDING BUT NOT LIMITED TO: ARTICLES 2, 3, 7, AND 15. SECTION I. Amendments to the Zoning Ordinance Sections 2, 3,7,and 15 and other sections as necessary are hereby initiated and referred to staff to repeal the H-2 Historic Corridor Architectural Control Overlay District and any associated provisions in the Zoning Ordinance that relate to the administration of that Overlay District; and SECTION II. The Planning Commission shall hold a public hearing to consider these amendments to the Zoning Ordinance and report its recommendation to the Town Council pursuant the Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended PASSED this 8th day of March, 2016.
