A RESOLUTION SETTING A PUBLIC HEARING FOR THE
UPDATE OF THE ODRINANCE CODIFICATION
Whereas, The City recognizes that it is required by law to comply with Codification on a
regular basis and;
Whereas the City Council of the City of Tiffin recognizes that for the past three (3) years
it needs to gather the approved Ordinances and forward them for Codification to be
compliant;
Now, therefore be it resolved by the City Council of the City of Tiffin, Iowa to approve
a public hearing on July 24, 2013.
On the`26th day of June, at a regular meeting of the Tiffin City Council, Ti4in, Iowa,
Councilperson Bartels introduced Resolution' No. 2013-128, A RESOLUTION
SETTING A PUBLIC HEARING FOR THE UPDATE OF THE ORDINANCE
CODIFICATION and made a motion for approval. Motion seconded by Councilperson
Ryan.
Ayes: Kahler, Ryan, Bartels, Upton, Phillips
Nays: none.
Absent: none.
Whereupon five Council members were present and voted approval and Mayor Berner
declared that the Resolution No. 2013-128, A RESOLUTION SETTING A PUBLIC

and signified his approval of the same by affixing his signature thereto.

A resolution to approve urban renewal plan amendment for the Tiffin Urban
Renewal Area

WHEREAS, as a preliminary step to exercising the authority conferred upon Iowa cities
by, Chapter 403 of the Code of.Iowa (the "Urban Renewal Law"), a municipality must -adopt a
resolution .finding that one or more slums, blighted or economic development -areas exist in the
municipality and that the rehabilitation, conservation, -redevelopmeni, development or a
combination thereof, of such area or areas is necessary in the interest of the public health, safety
or welfare of the residents of the municipality; and `
WHEREAS, this City Council by prior resolution established the Tiffin Urban Renewal
:Area (the "Urban Renewal Area") and adopted an urban renewal plan (the "Plan") for the
governance of projects and initiatives therein; and
WHEREAS; an amendment°(the "Amendment") to the Plan has been prepared which ,.
would facilitate the undertaking of new urban renewal projects • consisting of (i) using tax
increment financing in support of the City's 2013 Capital Improvement Projects; (ii) using tax
increment financing in support of the -City Park Improvements Project including paving at ,the
City's socee'r complex and fencing at the baseball diamonds; and (iii) using tax increment
financing to support a private developer in the development of an industrial'recycling plant in the
Urban Renewal Area; and (iv) using tax increment financing to support the improvement and
extension of public infrastructure in connection with the development of residential housing; and
WHEREAS, notice of a public hearing by the City Council of the City of Tiffin, Iowa, on.,

the proposed. Amendment was heretofore givenin strict compliance with the provisions of
.-Chapter 403 of the Code of Iowa, and the Council has conducted said hearing on June 26, 2013;
and
WHEREAS, copies- of the Amendment, notice, of- public hearing and .notice of- as
consultation meeting with respect to the Amendment were mailed to Johnson County'and the
Clear Creek -Amara Community School District; the consultation meeting was held on the 26th -
day of June, 2013; and responses to any comments or recommendations received following the
consultation meeting were made as required by law;
NOW, THEREFORE, It Is Resolved by -the City Council'of the City of Tiffin, Iowa, as
follows.
Section 1. The Amendment, attached hereto and made a part hereof, is hereby in all
respects approved. ,
Section 2. It is hereby determined by this City Council as follows:
A. The activities proposed under the Amendment conform to the general plan
`for the development of the City;

B. Proposed economic development under the Amendment is' necessary and
appropriate to facilitate the proper growth and development of the City in accordance

the extent of such conflict.

The City Council of the City of Tiffin, Iowa, met on June 26, 2013, at 6:30 p.m., at the s
Springmier Library in the CCA Middle School,. in the City for the purpose of conducting a public
hearing on a proposed urban renewal plan amendment. The Mayor..presided and the roll being
called the following members of the Council .were present and absent:
Present: Kahler; Ryan; Bartels, Upton, Phillips
Absent: none
The City Council investigated and found; that notice of the" intention of the Council to
,conduct a public hearing on the urban renewal plan amendment had been published according`to
law and as directed by the Council and that this is the time and place at which the Council 'shall ,
receive oral or.written objections froni any resident or property owner of the City. All written
objections, statements, and evidence -heretofore filed were reported:to the Council, and all ,oral
objections, statements, and all other exhibits presented were considered.

The Urban Renewal Plan (the "Plan") for the Tiffin Urban Renewal Area (the "Area") is
being amended for the _purpose of identifying new urban renewalprojects projects to ,be undertaken
r therein.
1) Identification of Projects. `s By virtue of this amendment, the list of authorized
-urban renewal projects in the.. Plan is hereby amended to include the following project
descriptions:
A)
Name of Project:- City Park Improvements Project (the ",City Park Project")
Name of Urban Renewal Area: `Tiffin Urban Renewal Area

Date of Council Approval of Project: June 26, 2013
Description of City Park Project: The City approved the City Park Project in an
amendment to the Plan on November 28, 2102 (the "November 2012 Amendment"). In
addition to improvements set forth in the November 2012 Amendment, the City Park
Project will include paving, improvements at, the City's soccer, complex and the
installation of fencing at the City's baseball diamonds. The City Park Project will
enhance the quality of life in the City; thereby resulting in residential and commercial
growth in the Area.
Description -of Properties to be Acquired in Connection with City Park Project: The
City.w7will acquire such easement territory and right-of-way as are necessary to
successfully undertake the City, Park Project.

Description Use..of TIF for the City Park Project: It is anticipated that the City will
spay for the City Park Project with either borrowed funds or the proceeds- of.an internal
advance of City funds on -hand. In either case, the'City's obligation will be repaid with
incremental property tax revenues. It is anticipated that the City's use of incremental
property tax revenues for City Park Project will not exceed $600,000

Description of Old Towi Watermain Improvements Project: - The City identified
certain properties -situated in Old Town as blighted properties (the `Blighted Properties")
in the Area in the November 2012 Amendment. The Old Town Watermain
Improvements Project will consist of'the construction of new watermains and necessary
appurtenances for the alleviation of blight on the Blighted Properties.,
Description of Properties, to be Acquired in Connection with Old Town Watermain
Improvements Project: The City will acquire such easement territory and right-of-way
as are necessary to successfully undertake the Old Town Watermain Improvements,

Project: It is anticipated that the' City will pay for the Old Town Watermain.
Improvements Project with either borrowed funds or the proceeds of an internal advance

property tax revenues for Old Town Watermain Improvements Project will not exceed
$200,000.

Description of Island Removal at Roberts Ferry Road Project: The Island Removal
at Roberts Ferry Road Project will consist of replacing the. islands situated on Robert's
• Ferry Road lying north and south of lits intersection. with Oakdale Boulevard with flat
PCC � pavement and will include such other work incidental thereto inchiding painting
pavement markings.
Description of Properties oto be Acquired in Connection with Island Removal' at
Roberts. Ferry Road Project: The City will acquire such easement "territory and right-
of-way as are necessary to successfully undertake the Island Removal at Roberts Ferry
Road Project.
Description of Location and' Use of TIF for the Island Removal at Roberts Ferry
Road Project: It is anticipated that the City will pay for the Island Removal at Roberts
Ferry Road Project with either borrowed funds or the proceeds of an internal advance of
City funds on -hand. In either case, the City's obligation will be repaid with incremental
property tax revenues. It is anticipated that the City's use of incremental property tax
revenues for Island'Removal at Roberts Ferry Road Project will not exceed $70,000.

residential and commercial growth in the Area.-

Goldfinch Drive and,other work incidental thereto.

Overlay Project: The City will acquire such easement territory and right-of-way as are
necessary to successfully undertake the Roberts Ferry Road Overlay Project.

Jasper Avenue and other work incidental thereto..

Project: The City will acquire such easement territory and right-of-way`as are necessary
to successfully undertake the Jasper Avenue North Project.
Description of Location and Use of TIF for the Jasper Avenue North Project: It is

Description of Kimberlite Street Extension Project: The Kimberlite Street'
M Extension Project will consist of the extension of Kimberlite Street from its dead end to
the parking lot at City Park including PCC paving and curb and gutter. The Kimberlite
Street Extension Project will also include the construction of an asphalt parking lot at the
.. end of Kimberlite Street at City Park and the construction of PCC pavement sidewalk
along the new extension of Kimberlite Street to City Park.

Extension Project: The City will acquire such easement territory, and right-of-way as
are necessary to successfully undertake the Kimberlite Street Extension Project.
Description of Location and Use of TIF for the Kimberlite Street Extension Project:
It is anticipated that the City will pay for the Kimberlite Street Extension Project with
either borrowed funds or the proceeds ,of an internal advance of City funds on -hand. In
either case, 'the City's obligation will be repaid with incremental property We revenues. It ,

Street -Extension Project will not exceed $325,000.

Name of Project: Big Country Seeds Expansion Project (the "Big Seeds Project")'

Date of Council Approval of Big Seeds Project: , June 26, 2013%
Description of Big Seeds Project: Big Country Seeds (the "Company") has
proposed-- to undertake the expansion of its seed processing facility situated at 1050
Greenfield Drive (the "Development Property") in the Area. The expansion will double
in size the Company's existing physical plant, add industrial/recycling operations and add
four (4) new jobs. It has lieen, requested that the City provide tax increment financing
assistance to the Company in support of the efforts to improve the Development Property.
Description of Public Infr'astructu're: It is not anticipated that the, City will install
public infrastructure in connection with the Big Seeds Project.
Description of Properties to be Acquired in Connection with Big Seeds Project: it is
not anticipated that the City will acquire real property in connection with the Big Seeds
Project.
Description of Use of TIF: The City intends to enter into a Development Agreement
with the Company with respect to the Big Seeds Project and to provide economic r
development"payments (the "Payments") thereurider. The Payments will be funded with
incremental property tax revenues to be derived from the Development Property. It is
anticipated that.the City's.total commitment of incremental property tax revenues with
respect to the Big Seeds Project will not exceed $250,000.

Name of Project: Housing Subdivision Support Project

Description of, Housing Subdivision Suppoyrt Project: A private developer (the
"Developer") has proposed to undertake the development of high end residential homes
on certain real property situated in the Area and bearing Johnson County Property Tax
Identification Parcel Numbers 0627377001 and 0634201001- (the "Property"). The City
desires to provide support to the Developer by using tax increment financing to support
'the construction of the public infrastructure necessary for the development of housing on
the Property. The addition of new residential housing in the City will enhance the quality
of life in the City thereby resulting in commercial and residential growth in the City.
Description of Properties to be Acquired in Connection with Project: It is not
anticipated that the City will acquire real .-property in connection with the Housing
Subdivision°Support Project.
Description of Use of TIF: It is anticipated that the City will enter into a development
agreement with the Developer, pursuant to which the City will provide payments
thereunder funded with incremental property tax, revenues to be derived from the
properties in the Area. It is anticipated that the City's use of incremental property tax
' revenues for Housing Subdivision Support Project will not exceed $80,000.
LMI Set Aside: Pursuant to the provisions of Section 403.22 of the Code'of Iowa, the
City will make provision for low and moderate income family housing assistance in an
amount'not less than 39.5% of the TIF Revenues applied toward the Housing Subdivision
Support Project.
2) Required Financial Information. The'following information is provided in
accordance with the requirements'of Section 403.17 of the.Code of Iowa:

The City Council of the City, of Tiffin, Iowa, met on July 10th, 2013,, at 6:30 p.m; at the
Tiffin City Center, Tiffin; Iowa. =
The meeting was called, to order ,by the Mayor, and, the roll was called showing the
following members of the City Council present and absent:
Present: JoAnn Kahler, Mike Ryan; Jim Bartels, Peggy Upton, Royce Phillips
Absent: None '
This being the time 'and place specified for 'taking action' on' theproposal to enter into a
loan agreement in a principal amount' not. to exceed' $400,000 related to constructing
improvements to City.Hall, the City Clerk announced thafrio written objections had been placed
on file. Whereupon, the Mayor called for any written or oral objections, and there being none,.
the Mayor closed the public hearing.
After due consideration and discussion, Council Member Ryan introduced'the following
resolution and moved its'adoption, seconded°by-Council Member Bartels. The Mayor put the
question upon the adoption of said resolution, and the roll being called, the following Council •

NOW, THEREFORE, It Is Resolved by the City Council of the City of Tiffin, Iowa, as
follows:
Section 4. The City Council hereby approves the Supplemental Loan Agreement and
declares that this resolution constitutes the "additional action" required by Section 384.24A of
the Code of Iowa. It is hereby ordered that the proceeds received from the issuance of the Bonds.
be expended `to pay the costs of the Improvements authorized in connection with the
Supplemental Loan Agreement in an amount not to exceed $400,000.
Section 2. All resolutions -and orders or parts thereof in conflict with the provisions
of this resolution, to the extent of such conflict, are hereby repealed.
Section 3. This resolution shall be in full force and effect immediately upon its
adoption and approval, as provided by law.
