MINUTES OF PREVIOUS MEETINGS: Regular Meeting, September 18, 2001 Special Meeting, September 21, 2001 Special Meeting, October 1, 2001 PUBLIC HEARING 10. VACATION OF A PORTION OF APRICOT AVENUE Comments: The development of the Plaza Mexico requires the City to vacate the portion of Apricot Street extending from Fernwood Avenue to the southerly line of Lot 41 of the Modjeska Park Tract. This street vacation will allow the development to provide the additional parking spaces for the business. On October 1, 2001, City Council adopted Resolution 2001-103 declaring its intention to vacate this portion of Apricot Street. Recommendation: To recommend that the City Council hold the public hearing and adopt the attached resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ORDERING THE VACATION AND ABANDONMENT A PORTION OF APRICOT STREET, IN THE CITY OF LYNWOOD". 11. URGENCY ORDINANCE AMENDMENT TO THE LYNWOOD MUNICIPAL CODE REPELEALING SECTION 4-32.12 AND 4-32.13 Comments: The City Council of the City of Lynwood is desirous to expeditiously improve the health and welfare of the senior citizens and the handicapped of the community via providing them with improved transportation services. It has been determined that the most cost effective and feasible manner in which to do this is through an outside vendor. Staff is recommending the introduction of an urgency ordinance amendment to the Lynwood Municipal Code in order to immediately provide for improved demand response Dial a Ride Services for the senior citizens and handicapped citizens of the City of Lynwood by making an outside vendor eligible to operate here in the City. Recommendation: Staff respectfully recommends that the Mayor and Members of the Lynwood City Council, upon the completion of the public hearing, to approve an urgency amendment to the Lynwood Municipal code repealing of section numbers 4-32.12 and 4-32.13. CONSENT CALENDAR All matters listed under the Consent Calendar will be acted upon by one motion affirming the action recommended on the agenda. There will be no separate discussion on these items prior to voting unless members of the Council or staff request specific items be removed from the Consent Calendar for separate action. 12. APPROVAL OF CONTRACTUAL SERVICES AGREEMENT FOR THE PRINTING OF THE CITY'S MONTHLY NEWSLETTER, LYNWOOD 'N PERSPECTIVE Comments: To have the Lynwood City Council approve the contractual services agreement for the printing of Lynwood 'n Perspective. Recommendation: Staff respectfully requests that the Lynwood City Council approve the resolution authorizing the agreement between the City of Lynwood and Mybar Printing, Inc. 13. EXTENDING THE TERM OF CABLE FRANCHISE AGREEMENT Comments: To have the Lynwood City Council approve the resolution extending the term of the cable franchise agreement with AT&T Broadband until completion of the franchise renewal process. Recommendation: Staff respectfully recommends that the Lynwood City Council adopt the attached resolution extending the term of the cable franchise with AT&T Broadband for a period not to exceed April 16, 2002. 14. EQUIPMENTNEHICLES TO BE SURPLUSED FOR AUCTION Comments: The used equipment/vehicles replaced by the new program are to be declared surplus and auctioned publicly. Recommendation: Staff recommends for the City Council approve the sale of surplus vehicles/equipment and that the funds raised from the auction be returned to the Garage account. 15. AUTHORIZING TO SUBMIT FOR A BROWNSFIELDS JOB TRAINING AND DEVELOPMENT DEMONSTRATION PILOT PROGRAM Comments: To have the City Council approve and authorize an application for the above mentioned job training program that will be used for training residents of Lynwood and to adopt the attached resolution approving the preparation of the application. Recommendation: Staff recommends that the City Council adopt the attached resolution authorizing the submittal of the application for the Brownfields Job Training and Development Demonstration Pilot Program. 16. ORDINANCE SECOND READING Comments: "AN ORDINANCE OF THE CITY OF LYNWOOD ADDING A NEW CHAPTER 6.9 TO THE LYNWOOD MUNICIPAL CODE AND RELATING TO RECYCLING AND DIVERSION OF CONTRUCTION AND DEMOLITION DEBRIS" Recommendation: That Council review and adopt the Ordinance. 17. WARRANT REGISTER: Comments: City of Lynwood warrant register dated October 16, 2001 for FY 2001-2002. Recommendation: Staff recommends for the City Council to approve the warrant register. DISCUSSION ITEMS 18. SPECIAL PERMIT REQUEST TO ALLOW EXISTING MEDICAL CLINIC FOR WOMEN TO EXPAND TO PROVIDE MASSAGES AND THERAPEUTIC SERVICES 3737 MARTIN LUTHER KING JR. BOULEVARD, SUITE 401 Comments: The applicant is requesting approval of a special permit to allow an existing medical clinic for women to expand in order to provide massages and other therapeutic services. The subject business is located at 3737 Martin Luther King Jr. Boulevard, Suites 401A and 401 B in the HMD (Hospital,Medical,Dental) zone. Recommendation: Staff respectfully recommends that the City Council review the proposed special permit application, consider LMC standards and requirements, accept testimony from the applicant and the public, and choose to either approve or deny the application for a special permit pertaining to massage oriented services. Attached are resolutions to either approve or deny such special permit application. 19. REQUEST FOR SPECIAL PERMIT - TEEN CHALLENGE OF SOUTHERN CALIFORNIA Comments: Teen Challenge of Southern California is requesting permission to solicit in front of their organization from October 22, 2001 to November 2, 2001. Recommendation: That Council review and direct staff accordingly. 20. REQUEST FOR SPECIAL PERMIT - MED-PRO FAMILY CLINIC HEALTH FAIR Comments: Med Pro Family Clinic is requesting permission to hold a Health Fair Friday, November 2, 2001 in the medical center parking lot from 10:00 a.m. to 3:00 p. m. LYNWOOD CITY COUNCIL REGULAR MEETING SEPTEMBER 18, 2001 The City Council of the City of Lynwood met in a Regular Meeting at 11330 Bullis Road on the above date at 6:20 p.m. Mayor Richards presiding. Councilmen Byrd, Rea, Reyes, Sanchez and Richards answered the joint roll call for all agencies. Also present were City Manager Davis, City Attorney Thever, Project Manager Jackson, and City Treasurer Pygatt. City Clerk Hooper was absent. Project Manager Jackson announced that the agenda had been posted in accordance with the Brown Act. PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) NONE PUBLIC ORALS COMMUNICATIONS NONE Jack Keane questioned why Savannah Bright was not involved in the Fiestas Patrias Event, and why was her picture not put in the Fiestas Patrias Catalog. Believes it was unfair for Savannah Bright not to have been included. Sal AlaTorre stated he is praying for the people of the November 11th Terrorist Attack. Frank Calderon, 4010 Josephine -stated he is ashamed of the City of Lynwood, believes the City could have done more for the residents in informing them about the November 11th Terrorist Attacks, and also with helping them with some kind of list of numbers for any kind of help any one needed. Jim Green asked why Belize was not included in the Fiestas Patrias Event. Discussed the living wage clause, and the events in New York September 11tH Margaret Bright stated she is very upset and disappointed with the City Council for not including her daughter Savannah Bright to participate in the Fiestas Patrias Events. Melvin Lopez, 10902 Hulme -addressed City Council regarding problems with his neighbor's son. Also stated that this individual has tried to run over his son. He has tried to talk to the Sheriff's Department and they have not helped him in any way. Stated he is tired of the problems this individual has caused. Would like for the City Council to step up and do something about this individual. Mayor Pro Tem Sanchez stated he believes that someone is putting things in Margaret Bright's head. And also stated he is sorry if there were any misunderstandings between Savannah Bright and the Fiestas Patrias Event. Mayor Richards stated the City has tried to do there best in helping anyone relating to the Terrorist Attack and also for anyone that needs any kind of help. Also asked staff to provide the audience with the Lynwood Preparedness Literature. ,~,,, ... Item #9: MINUTES OF PREVIOUS MEETINGS: It was moved by Mayor Pro Tem Sanchez, seconded by Councilman Byrd and carried to approve the following minutes: Regular Meeting, August 21, 2001 Special Meeting, August 27, 2001 Regular Meeting, September 4, 2001 PUBLIC HEARING Item #10: APPROPRIATION OF SUPPLEMENT LAW ENFORCEMENT SERVICES FUNDS ALLOCATED BY AB 3229 (2001 BRULTE FUNDS) FOR FRONT LINE LAW ENFORCEMENT SERVICES It was move by Councilman Reyes, seconded by Councilman Byrd and carried to Open the Public Hearing. Councilman Reyes stated that the Item in the Agenda is worded different from the Resolution. He also questioned if it is legal to vote on an Item that is different from the Resolution. Mayor Richards stated to Councilman Reyes that the changes were made and it is a legal document to vote on. Councilman Byrd stated that if he has questions he gets with staff prior to the Meetings, this helps save a lot of time. Hearing no further discussion, it was moved by Councilman Byrd, seconded by Councilman Reyes and carried to close the Public Hearing. City Attorney Thever stated Council approved the changes at their last meeting. ORDINANCE NO. 1506 ENTITLED: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING ZONING ORDINANCE AMENDMENT N0.2001.01 AND THEREBY REPLACING AND COMPREHENSIVELY REVISING SECTION 25-33 OF THE LYNWOOD MUNICIPAL CODE PERTAINING TO SIGNS AND ADVERTISING DISPLAYS" ROLL CALL: AYES: COUNCILMEN BYRD, SANCHEZ, RICHARDS NOES: COUNCILMEN REA, REYES ABSENT: NONE DISCUSSION ITEMS Item #19: A RESOLUTION CONDEMNING THE TERRORISTS AND DECLARING A DAY OF MOURNING It was moved by Councilman Rea, seconded by Councilman Byrd to adopt Resolution: RESOLUTION NO. 2001.101 ENTITLED: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD CONDEMNING THE TERRORISTS WHO PLANNED AND CARRIED OUT THE SEPTEMBER 11, 2001 ATTACKS AGAINST AMERICA AND TO DECLARE A DAY OF MOURNING IN LYNWOOD" Mayor Richards stated he would like to have a thirty (30) day mourning. Councilman Rea stated he is profoundly sad with what happened, and believes this was a very sickening Terrorist Attack. Councilman Reyes stated he would like to honor and recognize the individuals who have helped in this tragedy. Councilman Byrd stated he is also very sad, and agrees with Councilman Reyes. Mayor Pro Tem Sanchez stated the Terrorist Attack has been very painful and emotional for our children, and would like to dedicate more time for children, helping them cope with the tragedy. City Manager Davis announced that the City has helped, and that we also have a lot of volunteers from the City to accommodate any kind of help needed. SUBSEQUENT NEED ITEM: • REQUEST FOR SPECIAL PERMIT: A SILENCE PROCESSION MARCH It was moved by Councilman Reyes, seconded by Councilman Byrd to hear the Subsequent Need Item. Councilman Byrd asked the City Manager to meet with Anthony Wright about problems with consultants in the area talking with tenants. Hooper, City Clerk LYNWOOD CITY COUNCIL SPECIAL MEETING SEPTEMBER 21, 2001 The City Council of the City of Lynwood met in a Special Meeting at 11330 Bullis Road on the above date at 8:40 a.m. Mayor Richards presiding. Councilmen Byrd, Reyes, and Richards answered the joint roll call for all agencies. Councilman Rea and Mayor Pro Tem Sanchez were absent. Also present were City Manager Davis, City Attorney Thever, Project Manager Jackson, and City Treasurer Pygatt. City Clerk Hooper was absent. Project Manager Jackson announced that the agenda had been posted in accordance with the Brown Act. PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) NONE Mayor Pro Tem Sanchez arrived at 8:45 a.m. PUBLIC ORALS COMMUNICATIONS Item #5: FY 2001-2002 BUDGET WORKSHOP • Public Safety -Sheriffs Contract & Fire Contract Assistant Fire Chief Burciaga presented to City Council the Fire Departments Budget. Also stated he would respond to any questions or concerns the City Council had. Mayor Richards questioned Assistant Fire Chief Burciaga on the use of sirens, and questioned if they are being abused by the fire personnel. Councilman Reyes requested an assessment on responding to false alarms, and to look into assessing fees for businesses with alarms. City Manager Davis stated he would bring this information back to Council. • Sheriffs Contract Captain Smith and Lt. Herek presented to City Council on Sheriffs Department Budget. Also stated they would respond to any questions or concerns the City Council had. Councilman Reyes stated he would like to purchase more anti graffiti cameras and supplies for the Sheriffs Department. Would like for the City of Lynwood to be Graffiti free. Councilman Byrd stated he is also satisfied with the use of the anti graffiti cameras it has helped to keep the City clean from Graffiti. Councilman Reyes also stated regarding limited parking issues he would like for the Police Officers to start giving tickets to the individuals that are parking over there limit time and also for-the for sale cars that are parked in front of businesses parking spaces. City Manager Davis stated he would make sure that staff works with this issue. Councilman Reyes questioned Lt. Herek on who is taking care of the towing services for the D.U.I.'s. And also stated he would like to know how much percentage the towing companies have to pay the City. Lt. Herek stated that the City has a total of five (5) towing companies and they try to rotate every towing company. Also stated that the towing companies give 5% percent to the City. Councilman Reyes stated he would like to recognize or give the Sheriff Explorers an award for an outstanding job. Captain Smith stated that the City is having a lot of gang related issues, but the Sheriffs Department is trying very hard to help reduce gangs. City Manager Davis stated that with the help of the community we could resolve this issue. Councilman Reyes stated he is very disturbed with illegal parking in residential zones. Councilman Byrd stated he agrees with Councilman Reyes on the illegal parking would like to start issuing a permit fee of $150.00 for parking temporarily in residential zones. Assistant City Manager Hempe stated that funds were funded for one Officer from the Sheriffs Department for the City of Lynwood. We now have four Officers that are serving the City of Lynwood and it has made a great impact for the City. Mayor Richards stated he would like to set a date in the month of October to take the Sheriff Explorers out to dinner. • Environmental Services Director of Environmental Services Joe Wang and Yadi Farhadi presented to City Council the Environmental Services Budget. Also stated they would respond to any questions or concerns the City Council had. Councilman Byrd stated he would like to have Agnes Street cleaned up and improved. Mayor Pro Tem Sanchez questioned the funding for the wheel chair ramps. Stated he would like to have more wheel chair ramps provided for the residents. Councilman Reyes believes there should be better plans for the handicap parking zones and the wheel chair ramps. Councilman Byrd believes the only way the City is going to accomplish any projects is by hiring qualified employees. Councilman Reyes agrees with Councilman Byrd on hiring qualified employees and making them full time. Mayor Richards asked staff about the status of the presentation on the "Parking Bureau". Mayor Richards requested staff bring back the Christmas Decoration Plans as a Subsequent Need Item for the next Special Meeting. DAVIS,III City Manager day of couo~oss MEMORANDUM To: ~"Honor e Mayor and Members of the Lynwood City Council From: Jim. i n, Director of Recreation & Community Services Date: Oct ber 16, 2001 Subject: URG~'1CY ORDINANCE TO THE LYNWOOD MUNICIPAL CODE REPEALING SECTION 4-32.12 AND 4-32.13 Purpose To introduce an urgency ordinance amendment to the Lynwood Municipal Code in order to provide for improved Dial a Ride Services for the residents of the City of Lynwood by making an outside vendor eligible to operate here in the City. Background The City of Lynwood has provided a demand response Dial a Ride Service for senior citizens as well as the handicapped of the community for over twenty (20) years. This service has been offered through the use of in-house City employees operated Monday through Saturday between the hours of 8:00 a.m. and 4:00 p.m. The City Council of the City of Lynwood is desirous to expeditiously improve the health and welfare of the senior citizens and the handicapped of the community via providing them with improved transportation services. It has been determined that the most cost effective and feasible manner in which to do this is through an outside vendor. The City's current ordinance dealing with this particular matter prohibits the use of such vendors as was selected by the City Council at their regularly scheduled meeting of June 19, 2001. City Council requested that staff investigate methods by which the program could be enhanced within its current budget parameters. Staff compared the current in-house operated program with that of a service provided by an outside vendor. Staff found that an outside vendor could provide a greatly expanded service to the citizens within current basic budget parameters. Staff then compared several different outside vendors. On June 19, 2001 City Council approved an agreement with Administrative Services Cooperative, Inc. (ASC) to provide Dial a Ride Services in Lynwood. ASC was chosen over the in- house program as they could provide atwenty-four (24) hour, seven- (7) day/week operation. ASC could also provide a quicker response to citizen requests along with such enhancements as monthly shopping excursions. Analysis Upon their selection by the City Council staff began working with representatives of ASC in order to process their application for business license and permit. During the process of working with ASC city staff found that the current Lynwood Municipal Code governing taxicabs in Lynwood prohibits owner or any driver of any taxicab to enter into any contract, agreement or understanding between themselves by the terms of which the driver pays to the owner a fixed or determinable sum for the use of the vehicle. ASC currently has a lease type agreement with its drivers. (Sections 4-32.12 and 4-32.13) ASC is currently operating Dial a Ride Services in various surrounding communities. ASC operates in these communities via the use of these lease agreements with its drivers. It then would appear that these agreements might be the standard practice in taxicab type operations. Because of the fact that the City Council is desirous of enhancing the Dial a Ride Services that are available to the citizens of the City of Lynwood as expeditiously as possible and with the fact that it appears that our current Lynwood Municipal Code (Sections 4-32.12 and 4-32.13) would prohibit us from entering into relationships with vendors who enter into the kinds of agreements that are standard practice in the taxicab industry. For this reason we are currently unable to enhance our Dial a Ride Service. Page 2 It then would appear necessary to repeal sections 4-32.12 and 4-32.13 of the Lynwood Municipal Code. In doing this, we would then be able to enter into a relationship with ASC and in this way be able to enhance our services. Conclusion/Recommendation Staff respectfully recommends that the Mayor and Members of the Lynwood City Council, upon the completion of the public hearing, to approve an urgency amendment to the Lynwood Municipal Code repealing of section numbers 4-32.12 and 4-32.13. No taxicab for which a permit shall been issued pursuant to this Section shall be operated by anyone but the owner or any employee of the owner"; and WHEREAS, Lynwood Municipal Code Section 4 - 32.13 provides: "Agreement Between Owner and Driver of Lease of Taxicab Prohibited: It shall be unlawful for the owner or any driver of any taxicab to enter into any contract, agreement or understanding between themselves by the terms of which the driver pays to the owner a fixed or determinable sum for the use of the vehicle"; and WHEREAS, the City of Lynwood cannot issue taxicab driver permits under the current state of the law to taxicab drivers having agreements with vehicle owners requiring payment for the use of the vehicle or who operate as independent contractors; and WHEREAS, the residents of the City of Lynwood have been and are continuing to be deprived the full availability of taxicabs since many companies have drivers who operate as independent contractors or who have agreements requiring payment for the use of the companies' vehicles; and WHEREAS, many elderly and disabled residents of the City of Lynwood depend on the availability of taxicabs for transportation to, from and throughout the City and without which such residents are unable to get to doctor appointments, buy groceries, go shopping or otherwise meet their daily transportation needs; and WHEREAS, the City of Lynwood is unable to implement a reduced fare or free taxicab dial-a-ride program offering transportation for elderly and disable residents unable to afford regular fares; and WHEREAS, a present health, safety and public welfare emergency exists for the reasons given above due to the lack of available taxicabs meeting all the requirements of the City's existing codes; NOW, THEREFORE, the City Council of the City of Lynwood does hereby ordain as follows: Section 1. The private patrol licensee shall file a written application in the office of the Chief of Police, upon forms furnished by the Chief of Police, containing all of the information required by subsection 4-31.2 and shall be signed by the private patrol licensee, or an officer, partner or manager of the private patrol licensee. b. No applicant shall commence to operate or do business in the City until he has paid his business license tax as required by subsection 4-7.9 and has complied with all of the provisions of the section required as prerequisite to operating as a private patrol operator or operating a private patrol service in the City. c. The Chief of Police shall cause all applications to be filed and indexed in his office and to be maintained there until such time as they may be destroyed in the manner provided by law. d. No such applicant shall commence to operate or do business in the City if the Chief of Police, or other person perforniing the functions of said office, detenmines him to be of bad moral character. e. The phrase "bad moral character" used in the proceeding paragraph shall include, but shall not be limited to, conviction of any felony or any other crime involving moral turpitude. (Code 1972 27-g; Ord. # 1016, 1-4) 4 - 32 TAXICABS. 4 - 32.1 Definitions. As used in this section: Cruising shall mean the driving of a taxicab on the streets, alleys or public places of the City in search of, or soliciting, passengers for hire. Driver shall mean and include each person in charge of driving or operating any taxicab, either as agent, employee or otherwise. Driver's license shall mean the permission granted by the traffic authority to a person to drive a taxicab upon the streets of the City. Holder shall mean a person to whom a permit has been issued pursuant to this section. *State law reference: Commercial passenger vehicles, Vehicle Code, 16500. 4-32 LYNWOOD CITY CODE Manifest shall mean a daily record prepared by a taxicab driver of all trips made by the driver, showing the time and place of origin, destination, number of passengers and the amount of fare of each trip. Owner shall mean every person having the ownership, use or control of any taxicab who operates or proposes to operate the taxicab as a business within the City. Permit shall mean the authority issued to an owner authorizing him to operate or have operated a specific number of taxicabs upon the public streets of the City. Rate card shall mean a card issued by the Traffic Authority in each taxicab which contains the rates of fare then in force. Taxicab shall mean a motor vehicle regularly engaged in the business of carrying passengers and their baggage for hire, having a seating capacity of less than six (6} persons and not operating on a fixed route irrespective of whether or not the operations extend beyond the City. Taximeter shall mean a meter instrument or device attached to a taxicab which measures mechanically the distance driven and the waiting time upon which the fare is based. Traffic Authority shall mean the Chief of Police of the City. Waiting time shall mean the time when a taxicab is not in motion from the time of acceptance of passengers to the time of discharge, but does not include any time that the taxicab is not in motion if due to any cause other than the request, act or fault of a passenger. (Code 1972 31-14) 4 - 32.2 Proof of Financial Responsibility. Holders shall be required to file with the City council and thereafter keep in full force an effect, proof of compliance with Section 16500 of the State Vehicle Code. The holder shall file an endorsement of the proof of compliance with the City Clerk, wherein it is provided that the insurance policy or other security shall not be canceled by the insurer or a t the request of the insured until the City shall have notice in writing at least ten (10) days immediately prior to the time when such cancellation shall become effective. Notice of such cancellation shall be addressed to the City Clerk at City Hall. (Code 1972 31-15) 4 32.3 Required Service. a. Scope. Each person engaged in the taxicab business in the City operating under the provisions of this section shall render an overall service to the public desiring to use taxicabs. b. All Calls For Service To Be Answered: Holders of permits issued pursuant to this Section shall answer all calls received by them for service inside the City as soon as they can do so and, if services cannot be rendered within a reasonable time, they shall then notify the prospective passengers how long it will be before the call can be answered and give the reason therefor. (Code 1972 31-16, 31-17) 4 - 32.4 Refusal To Provide Required Service, Violation; Revocation Of Permit: Any holder of a permit issued pursuant to this Section who shall refuse to accept a call anywhere in the City at any time when the holder has available cabs or who shall fail or refuse to give overall service, shall be deemed a violator of this Section and the permit granted to the holder shall be revoked at the discretion of the Traffic Authority. (Code 1972 31-18) 4 - 32.5 Continuous Operation of Authorized Taxicabs: The holder shall use or operate continuously the number of taxicabs authorized by his permit issued pursuant to this Section for the purpose of transporting individuals for hire upon trips originating within the City. (Code 1972 31-19) 4 - 32.6 Manifests: a. Every driver subject to this Section shall maintain a daily manifest upon which are recorded all trips made each day, showing time and place of origin and destination of each trip and amount of fare and all completed manifests shall be returned to the owner of the taxicab by the driver at the conclusion of his tour of duty. b. The forms for each manifest shall be furnished to the driver by the owner of the taxicab and shall be of a character approved by the Traffic authority. c. Each holder of a permit issued pursuant to this Section shall retain and preserve all drivers' manifests in a safe place for at least the next calendar year following the can ent calendar year, and the manifests shall be available to the Traffic Authority. (Code 1972 31-20) 4 - 32.7 Cruising: No driver subject to this Section shall cruise in search of passengers except in such areas and at such times as shall be designated by the Traffic Authority. Cruising areas and times shall only be designated when the Traffic Authority finds that taxicab cruising would not congest traffic or be dangerous to pedestrians and other vehicles. (Code 1972 31-21) 4 - 32.8 Additional Passengers: No driver subject to this Section shall permit any person other than the person first employing the taxicab to occupy or ride in the taxicab unless the person first employing the taxicab shall consent to the acceptance of additional passengers. (Code 1972 31-22} 4 - 32.9 Drivers Not To Sell Intoxicating Liquors Or Solicit For House Of III Repute: It shall be unlawful for any driver subject to this Section to engage in selling intoxicating liquors or solicit business for any house of ill repute. (Code 1972 31-23) 4 - 32.10 Operation From Place Other Than Authorized Stand Or Garage: It shall be unlawful for any taxicab to be operated from any place in the City except a stand authorized by the City Council or Traffic Authority in accordance with this Section or Chapter 7 or from a private or public garage or parking space on private property. (Code 1972 31-24) 4 - 32.11 Operation By Females: Repealed. (Code 1972 31-25; Ord. #1436.1) 4 - 32.12 Operation By Person Other Than Owner Or Employee: Recommended for Repeal (Code 1972 31-26) 4 - 32.13 Agreement Between Owner And Driver For Lease Of Taxicab Prohibited: Recommended for Repeal (Code 1972 31-27) 4 - 32.14 Soliciting Patronage: It shall be unlawful for the owner, driver or other employee or agent of a taxicab to solicit patronage of persons assembled at the scheduled stop of any common carrier or at intermediate points along any established route of such a carrier or at a stand of another taxicab owner when persons have assembled for the purpose of using the service of a common carrier or vehicle of another owner. However, this Subsection shall not be construed to prohibit or interfere with response to any call for a taxicab made by telephone or by signal from a pedestrian. (Code 1972 31-28) 4 - 32.15 Provisions Of This Section To Be In Lieu Of Other Licensing Provisions: All persons who shall come within the purview of and are subject to the terms of this Section shall be excepted from this Chapter. (Code 1972 31-29) 4 - 32.16 Appeals From Administrative Determinations: a. Within thirty (30) days after the rejection of an application for a driver's license pursuant to this Section or the decision of the Traffic Authority prescribing new or different rates for the use of taxicabs, the applicant, permittee or licensee may file a written appeal with the City Clerk stating in detail the reasons why the application for a driver's license should be granted or why the decision of the Traffic Authority prescribing new or different rates for the use of taxicabs should be revoked notwithstanding the action of the Traffic Authority to the contrary. b. Within twenty-four (24) hours of the receipt of the written appeal, provided for by paragraph a., the City Clerk shall advise the Traffic Authority of the appeal and within the same period will fix a date and time for the hearing of the appeal by the Council and notify the applicant, penmittee or licensee and the Traffic Authority thereof by registered mail, which date must not be more than ten (10) days from the date the appeal is filed with the City Clerk. c. Upon receipt of notice that an appeal has been filed, the Traffic Authority shall furnish the council with a written report of the reasons for the rejection of the driver's license. The filing of his written report based upon his investigation of the complaint that the rates being presently charged are excessive in accordance with this section shall be deemed sufficient compliance with this subsection insofar as an appeal from the decision of the Traffic Authority fixing new or different rates is concerned. d. The Council shall deny the appeal and affirm the decision of the Traffic Authority if it finds the applicant has failed to comply with any of the provisions of this section or the laws of the United States or of the State, the violations of which reflect unfavorably on the fitness of the permittee or licensee to offer public transportation. e. The decision of the Council shall be final. (Code 1972 31-30) PART A. OWNERS' PERMITS 4 - 32.17 Permit Required; Issuing Authority. No person shall operate or permit a taxicab owned or controlled by him to be operated as a vehicle for hire upon the streets of the City without having first obtained a permit from the Council if it is an original application, or from the Traffic Authority if it be an application for the renewal of a penmit. (Code 1972 31-36) 4 - 32. 18 Application. An application for a permit required by this section shall be filed with the City Clerk upon forms provided by the City, containing such information as may be provided by the rules and regulations of the Traffic Authority or the Council pertinent to the operation of the taxicab business and as to the character and quality of the service; the application shall be verified under oath. (Code 1972 3 I -37) 4 - 32.19 Prerequisites to Issuance. No permit shall be issued under Part A until the following minimum conditions are complied with: a. The applicant has not been convicted of a felony or of a crime involving moral turpitude or of reckless driving or driving while under the influence of intoxicating liquor. b. The applicant is a citizen of the United States or one who has regularly declared his intention to become a citizen and is more than twenty-one (21) years of age. c. The applicant has complied with all the provisions of this section including satisfactory evidence that the minimum requirements for liability insurance required by this section have been met; however, if the applicant produces evidence satisfactory to the Council that the liability insurance required by this section will be procured prior to the actual commencement of operations, then the permit maybe issued conditioned upon its becoming effective at such time as the requirements of this section relating to liability insurance are met. (Code 1972 31-38) 4 - 32.20 Permits Held Prior to Adoption of Section. The establishment of the public convenience and necessity shall not be necessary for granting the same number of permits held by the applicant under the same name and color scheme on the date preceded by this section for the expiration of permits and the permit shall be classified as a renewal, and the applicant shall be guaranteed a permit provided he complies with Part A pertaining to renewal of permits. (Code 1972 31-39) 4 - 32.21 Action on Applications for Original Permits. a. Upon the filing of an application for an original permit to be issued pursuant to Part A the Council shall fix a time and place for a public hearing thereon. Notice of the hearing shall be given to the applicant and to all persons to whom permits have heretofore been issued. Due notice shall also be given to the general public by posting a notice of such hearing in the lobby of the City Hall. Any interested person may file with the City Clerk a memorandum in support of or in opposition to the issuance of a permit. b. Upon receipt of an application for an original perrnit to be issued pursuant to Part A the City Clerk shall refer the application to the Traffic Authority who shall investigate and report in writing to the Council before the time set by the City Clerk for the hearing upon the application, upon the following matters: 1. Discussion: The City has published Lynwood `n Perspective since February 1993. Now in its eighth year, Lynwood `n Perspective continues to provide pertinent information of interest to the public, including city services, programs and events for the entire community. It is atwo-color, six- page, bilingual monthly publication, mailed to 14,600 households in Lynwood. A total of 15,000 copies are printed. Analysis: Lynwood `n Perspective requires a tight production schedule, compelling staff to act swiftly to determine the cost of printing the publication for the next 12 months. For the last two years, Mybar Printing, Inc. has printed the Lynwood `n Perspective newsletter and continues to provide the highest quality of professional printing services in a quick turnaround. Each year printing costs increase due mainly to the printing industry's escalating cost of materials such as paper. To counter the possibility of an increase in printing costs, staff approached Mybar Printing, Inc. to pursue the opportunity of renewing the existing agreement at no increase in cost, and foregoing the informal bid process. Mybar Printing, Inc. responded by submitting a price quotation for the exact amount as the previous agreement of $ 27,456.00 for 12 issues of Lynwood `n Perspective. Fiscal Impact: Funds for printing the Lynwood `n Perspective newsletter are identified in the City's 2001 /2002 Budget for Lynwood Information Incorporated. Recommendation: Staff requests that City Council approve the attached resolution authorizing the renewal of an agreement between the City of Lynwood and Mybar Printing, Inc. for the printing of the monthly newsletter for fiscal year 2001/2002. AGREEMENT This Agreement is made by and between the City of Lynwood, a municipal corporation, hereinafter referred to as "City," and Mybaz Printing, Inc. hereinafter referred to as "CONTRACTOR." The CITY and the CONTRACTOR, for the consideration hereinafter set forth, mutually agree as follows: 1. CONTRACTOR shall perform everything required to be performed and shall provide and furnish all the labor, materials, necessary tools, expendable equipment and all utility and transportation services required for the following work in accordance with the following specifications: Printing twelve (12) issues of the City's monthly newsmagazine known as "LYNWOOD `N PERSPECTIVE," of which 15,000 copies per issue will be printed; 801b. Topkote Dull Book Six (6) pages, 25.5" x 11", still folding down to 8.5" x 11" Folded copies equal 6 pages in 2 PMS colors of the CITY's choosing; Number of halftones varies from 3 to 6; All copy will be provided on computer disk; 15,000 copies of the newsletter will be delivered to the mailing firm, of these 14,600 copies will be folded and prepared for mailing; the mailing firm will deliver the remaining 400 copies to the City. 2. Contractor shall perform all said work and furnish all of said material at its own cost and expense and shall perform all work in a workmanlike and professional manner. 3. The CITY agrees to pay CONTRACTOR, for printing the CITY's newsletter and for pre-sorting, the sum of TWO THOUSAND TOW HUNDRED EIGHTY- EIGHT DOLLARS ($2,288.00) per issue of 15,000 copies, totaling TWENTY SEVEN THOUSAND FOUR HUNDRED FIFTY-SIX DOLLARS ($27,456) for twelve issues. 4. The CONTRACTOR shall perform the work relating to each issue of the monthly newsletter within five (5) to seven (7) working days of receipt of the camera- ready copy, provided that there are no major modifications requested by the CITY. 5. This Agreement may be amended only by the written consent of both the CITY and the CONTRACTOR; and failure on the part of either party to enforce any provisions of agreement shall not be construed as a waiver of the right to complete enforcement of such provision or provisions. 6. The CITY and the CONTRACTOR each binds itself, its successors, assigns and legal representatives, in respect to the performance of all covenants and obligations contained in the Agreement. Neither party to the Agreement shall assign this Agreement without the written consent of the other, nor shall the CONTRACTOR assign any monies due or to become due to it hereunder without the previous written consent of the CITY. Any attempted assignment of this the previous written consent of the other party shall be null and void. 7. The CONTRACTOR shall indemnify and hold harmless the CITY its officers, agents and employees, against any and all damages to property or injuries to or death of any person or persons, including property and employees or agents of the CITY, and shall defend, indemnify and hold the CITY harmless from any and all claims, demands, suits, actions or proceedings of any kind or nature, including, worker's compensation claims, by anyone whomsoever, attributable to or arising out of the negligent acts, errors or omissions of the CONTRACTOR, or its employees, agents or subcontractors. 8. The CONTRACTOR warrants to the CITY that all work performed hereunder will be of good quality, free from errors and omissions and in conformance with the specifications. All work not conforming to these requirements, including substitutions not properly approved and authorized, may be consider defective. 9. If the CONTRACTOR is adjudged a bankrupt, or if it makes a general assignment for the benefit of its creditors, or if a receiver is appointed on account or insolvency, or if the CONTRACTOR disregards laws, ordinances, rules, regulations or orders of any public authority having jurisdiction, or otherwise in breach of any provision of this Agreement, the CITY may, without prejudice to any other right or remedy, and after giving the CONTRACTOR seven (7) days' prior written notice, terminate the engagement of the CONTRACTOR, and the CITY may complete the work by whatever method it my deem expedient. In such case, the CONTRACTOR shall not be entitled to receive any further payment until the work is completed. Following completion of the work, the CONTRACTOR shall be entitled to receive no more than payment for the work performed prior to the date of the breach. 10. CITY and CONTRACTOR retain the right to terminate the Agreement, without cause, upon thirty (30) days' written prior notice to the other party. 11. This Agreement constitutes the entire agreement between the parties hereto, and neither party has been induced to enter into this Agreement by reason of any promise, representation, statement or warranty other than as herein contained. 12. This Agreement shall become effective immediately upon its execution by the City of Lynwood and the CONTRACTOR and shall continue in full force and effect until twelve (12) issue of the monthly newsletter have been published, unless earlier terminated by the CITY or the CONTRACTOR as provided for in Section 10. Davis, III, City Manager Johonna Howard, Public Relations Officer SUBJECT: Extending the Term of Cable Franchise Agreement PURPOSE: To have the Lynwood City Council approve the resolution extending the term of the cable franchise agreement with AT&T Broadband until completion of the franchise renewal process. BACKGROUND: The extension of the existing cable franchise agreement expires on October 16, 2001; however, the franchise renewal process is not completed. Staff has met with representatives of AT&T Broadband to discuss the feasibility of partnering to develop a prototype internet access center within the Lynwood community. At the meeting, staff was informed by AT&T Broadband that a venture of this type was feasible but required research, as well as input from its internet technology division. Since this initial meeting, AT&T Broadband has shown little interest in assisting the City in the development of the prototype. Also, upon the completion of the City's Telecommunications Needs Assessment Study conducted by Telecom Planners, Inc., staff was directed by City Council to schedule a technology workshop. The workshop was held on August 16 - 18, 2001. The workshop included a cable franchise discussion in which a cable franchising expert informed City Council that AT&T Broadband intends to sell its franchise. It was recommended to City Council, as a strategy for improved negotiations, to continue extending the existing cable franchise agreement with AT&T Broadband until the franchise changes ownership. Meanwhile, failure to extend the existing cable franchise agreement would result in its expiration before a cable franchise is approved. Without an extension of the existing cable franchise agreement, AT&T Broadband is likely to invoke the formal renewal procedure under federal law provided from in Section 626 of the 1984 Cable Act. ANALYSIS: Based on information provided at the technology workshop, it would be advantageous for the City to continue extending the existing cable franchise agreement with AT&T Broadband until it is under new ownership. It is not known when AT&T Broadband will be purchased by another owner; however, Lynwood City Council must approve the transfer of cable ownership and this would provide additional leverage for negotiating the terms of the franchise. RECOMMENDATION: Staff respectfully recommends that the Lynwood City Council adopt the attached resolution extending the term of the cable franchise with AT&T Broadband for a period not to exceed April 16, 2002. CITY OF LYNWOOD LOS ANGELES COUNTY, CALIFORNIA RESOLUTION NO# A RESOLUTION OF THE CITY OF LYNWOOD EXTENDING THE TERM OF A FRANCHISE WITH AMERICAN CABLESYSTEMS OF CALIFORNIA, INC., AT&T BROADBAND PENDING COMPLETION OF NEGOTIATIONS FOR A FRANCHISE RENEWAL WHEREAS, American Cablesystems of California, Inc., Media One ("Franchisee") is the duly authorized holder of a franchise ("Franchise") that authorizes the operation and maintenance of a cable television system within the city of Lynwood ("the City"); and WHEREAS, the City's Franchise and Franchisee was granted October 15, 1981, and was due to expire on October 14, 1996; and WHEREAS, the Lynwood City Council has extended the term of the existing cable franchise agreement with AT &T Broadband a number of times, while in the process of negotiating a new franchise agreement; and WHEREAS, the period for the current extension of the existing cable franchise agreement is due to expire on October 16, 2001, however the cable franchise renewal process will not be completed by this date; and WHEREAS, Section 626 of the Federal Cable Communications Policy Act of 1984 (47 U.S.C. 546) (the "1984 Cable Act"), establishes provisions concerning the renewal of cable television franchises by franchise authorities; and WHEREAS, the City and the Franchisee mutually agree that they will be unable to complete the cable franchise renewal process by the extension day of October 16, 2001; and WHEREAS, it is considered to be in the best interest of the City, the Franchisee, and cablesystem subscribers to extend the Franchise term pending completion of the renewal process. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES RESOLVE AS FOLLOWS: Section 1. The fifteen (15) year Franchise which began October 15, 1981, by and between the City and Franchisee, as amended, is hereby further amended to extend its term until April 16, 2002. Section 2. FACTS: 1. In July, 2000 the U.S. Environmental Protection Agency issued a Brownfields Economic Redevelopment Initiative seeking proposal for a Brownfields Job Training and Development Demonstration Pilot Program. 2. Each approved Pilot Program will be funded up to $200,000 over a period of two years. 3. Applications for the Program are due Friday, October 19, 2001. 4. The goal of the Pilot Program is to facilitate the cleanup of Brownfields sites contaminated with hazardous substances and prepaze the trainees for future employment in the environmental field. ANALYSIS: This Pilot Program offers the City of Lynwood an excellent opportunity to follow up on the Hazwoper 40 Program created eazlier this year. It is our understanding that we aze the only City in Southern California to create a successful privately funded training program and provide job opportunities. The training will be done in Lynwood, for Lynwood residents. This will allow such residents to participate in the environmental work associated with the new commercial and retail projects being planned and constructed throughout the City. Additionally, the training that these individuals receive will allow them to work on projects outside of the City, which includes most cities in the country. The training, therefore has extended value. RECOMMENDATION: Staff recommends that the City Council adopt the attached resolution authorizing the submittal of the application for the Brownfields Job Training and Development Demonstration Pilot Program. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE SUBMISSION OF A BROWNFIELDS JOB TRAINING AND DEVELOPMENT DEMONSTRATION PILOT PROGRAM APPLICATION TO THE UNITED STATES ENVORNMENTAL PROTECTION AGENCY WHEREAS, the City of Lynwood has determined job training and employment opportunities are high priority areas of economic development; and WHEREAS, the City of Lynwood has demonstrated its belief in the program by creating and supporting a successful private sector Hazwoper 40; and WHEREAS, Lynwood citizens will have the opportunity of participating in a new growing industry. NOW, THEREFORE, the City Council of the City of Lynwood does hereby resolve as follows: Section 1. As part of its job training and job opportunity expansion program the City Council approves the submittal of a Brownfields Job Training and Development Demonstration Pilot Program application to the U.S. Environmental Protection Agency. Hooper, City CIerIQ Subject: ORDINANCE SECOND READING COMMENTS: The following Ordinance was first read September 18, 2001: AN ORDINANCE OF THE CITY OF LYNWOOD ADDING A NEW CHAPTER 6.9 TO THE LYNWOOD MUNICIPAL CODE AND RELATING TO RECYCLING AND DIVERSION OF CONSTRUCTION AND DEMOLITION DEBRIS" RECOMMENDATION: That Council review and adopt the Ordinance. r~ Ordinance No. AN ORDINANCE OF THE CITY OF LYNVVOOD ADDING A NEW CHAPTER 6.9 TO THE LYNWOOD MUNICIPAL CODE AND RELATING TO RECYCLING AND DIVERSION OF CONSTRUCTION AND DEMOLITION DEBRIS WHEREAS, the City of Lynwood ("City") is a general law city in the State of California; and WHEREAS, the City is committed to protecting the public health, safety, welfare and environment; and WHEREAS, in order to meet these goals it is necessary that the City promote the reduction of solid waste and reduce the stream of solid waste going to landfills; and WHEREAS, pursuant to the California Waste Management Act (California Public Resources Code Sections 40000 et seq.), the City is required to prepare, adopt and implement source reduction and recycling elements to reach reduction goals; and WHEREAS, the California Waste Management Act also requires the City to substantially reduce volume of waste materials going to landfill, under the threat of penalties of $10,000 per day; and WHEREAS, debris from demolition and construction of buildings represents a large portion of the volume presently coming from the City; and WHEREAS, debris from city projects represents a large portion of volume presently coming from thecity; and . WHEREAS, much of said debris is particularly suitable for recycling; and WHEREAS, the City's commitment to the reduction of waste and to compliance with state law requires the establishment of programs for recycling and salvaging construction and demolition materials; and WHEREAS, the City recognizes that requiring demolition and construction debris to be recycled and reused may in some respects add modestly to the cost of demolition and in other respects may make possible some cost recovery and cost reduction; NOW, THEREFORE, the City Council of the City of Lynwood, California, does hereby ordain as follows: Section 1. Anew Chapter 6.9 is hereby added to the Lynwood Municipal Code, to read as follows: Chapter 6.9 Recycling and Diversion of Debris from Construction and Demolition 6.9.1 Definitions a. "Applicant" means any individual, contractor, firm, Iimited liability company, association, partnership, political subdivision, government agency, municipality, industry, public or private corporation, or any other entity whatsoever who applies to the City of Lynwood for the applicable permits to undertake any construction, demolition, or renovation project within the City of Lynwood. b. "Construction" means the building of any facility or structure or any portion thereof including any tenant improvements to an existing facility or structure. c. "Construction and Demolition Debris" means used or discarded materials removed from premises during construction or renovation of a structure resulting from construction, remodeling, repair, or demolition operations on any pavement, house, commercial building, or other structure. ,••. .•., d. "Conversion Rate" means the rate set forth in the standardized Conversion Rate Table approved by the City pursuant to this Article for use in estimating the volume or weight of materials identified in a Construction and Demolition Waste Reduction and Recycling Plan. e. "Covered Project" shall have the meaning set forth in Section 9.6.2 of this Article. f. "Demolition" means the decimating, razing, ruining, tearing down or wrecking of any facility, structure, pavement or building, whether in whole or in part, whether interior or exterior. g. "Divert" means to use material for any purpose other than disposal in a landfill. Diversion credit is given for source reduction (waste reduction), recycling, and composting. h. "Diversion Requirement" means the diversion of at least fifty (50) percent of the total Construction and Demolition Debris generated by a Project via reduction (source reduction), reuse or recycling, unless the Applicant has been granted an Infeasibility Exemption, in which case the Diversion Requirement shall be the maximum feasible diversion rate established by the City of Lynwood Department of Environmental Services. i. "Noncovered Project" shall have the meaning set forth in Section 9.6.2 of this Article. j. "Project" means any activity which requires an application for a building or demolition permit or any similaz permit from the City of Lynwood. k. "Recycling" means the process of collecting, sorting, cleansing, treating, and reconstituting materials that would otherwise become solid waste, and returning them to the economic mainstream in the form of raw material for new, reused, or reconstituted products which meet the quality standards necessary to be used in the mazketplace. 1. "Renovation" means any change, addition, or modification in an existing structure. m. "Reuse" means further or repeated use of Construction or Demolition Debris. An example is the reuse of crushed concrete as road base or as aggregrate on the construction site. n. "Salvage" means the controlled removal of Construction or Demolition Debris from a permitted building or demolition site for the purpose of recycling, reuse, or storage for later recycling or reuse. o. "Construction and Demolition Waste Management Plan" means a completed form, approved by the City of Lynwood for the purpose of compliance with this Article, submitted by the Applicant/Contractor for any Covered or Noncovered Project that indicates the estimated diversion that the ApplicanUContractor anticipates in diverting from disposal, as part of the permit/application process. p. "Construction and Demolition Waste Management Report" means a completed form, approved by the City of Lynwood for the purpose of compliance with this Article, submitted by the Applicant/Contractor for any Covered or Noncovered Project that documents the disposal and diversion tonnages and destinations. q. "City's recycling staff means Senior Building Inspector in the Building and Safety Division and Civil Engineering Associate in the Engineering Division. 9.6.2 Covered and Non-Covered Projects a. Covered Projects: All construction, demolition, and renovation projects in which the total costs aze, or aze projected to be, greater than or equal to $50,000 ("Covered Projects") shall comply with this Article. b. Noncovered Projects: Applicants for construction, demolition, and renovation projects within the City whose total costs are less than $50,000. "Noncovered Projects" shall be encouraged to divert at least fifty (50) percent of all project-related construction and demolition debris. c. Compliance as a Condition of Approval to Proceed: Compliance with the provisions of this Article shall be listed as a condition of approval to proceed for any building or demolition or public works permit issued for a Covered Project. 6.9.3 Infeasibility Exemption a. Application: If an Applicant/Contractor for a Covered Project experiences unique circumstances that the Applicant/Contractor believes make it infeasible to comply with the Diversion Requirement, the Applicant may apply for an exemption at the time that he or she submits the Construction and Demolition Waste Reduction and Recycling Plan. The Applicant/Contractor shall indicate on the Construction and Demolition Waste Reduction and Recycling Plan the maximum rate of diversion he or she believes is feasible for each material and the specific circumstances that he or she believes make it infeasible to comply with the Diversion Requirement. b. The City's recycling staff shall review the information supplied by the Applicant and may meet with the Applicant to discuss possible ways of meeting the Diversion Requirement. Based on the information supplied by the Applicant/Contractor, the City of Lynwood's recycling staff shall determine whether it is possible for the Applicant/Contractor to meet the Diversion Requirement. c. The City's recycling staff determines that it is infeasible for the Applicant to meet the Diversion Requirement due to unique circumstances, he or she shall determine the maximum feasible diversion rate for each material and shall indicate this rate on the Construction and Demolition Waste Reduction and Recycling Plan submitted by the Applicant. The City's recycling staff shall return a copy of the Construction and Demolition Waste Reduction and Recycling Plan to the Applicant marked "Approved for Infeasible Exemption". d. Denial of Exemption: If the City's recycling staff determines that it is possible for the Applicant to meet the Diversion Requirement, he or she shall so inform the Applicant/Contractor in writing. The Applicant/Contractor shall resubmit a Construction and Demolition Waste Reduction and Recycling Plan. If the Applicant/Contractor fails to resubmit the Construction and Demolition Waste Reduction and Recycling Plan, or if the resubmitted Construction and Demolition Waste Reduction and Recycling Plan does not comply with the requirements of the plan, the City's recycling staff shall deny the Construction and Demolition Waste Reduction and Recycling Plan. 6.9.4 Diversion Measurement The methodology used to calculate diversion is based on the Title 14, California Code of Regulations, Article 6.1 Solid Waste Generation Study, Section 18722 et seq. and is consistent with California Integrated Waste Management Board measurement protocols. The following equation defines the "Generation-Based Diversion Quantification Methodology": Generation = Disposal + Diversion Diversion Rate (%) = Diversion Tons Generation Tons 6.9.5 Recycling Fee Requirement Upon approval of the Construction and Demolition Waste Reduction and Recycling Plan, and before commencement of any physical activities, the Applicant/Contractor shall deposit the following amounts with the City's Recycling staff. ,..», ,~-~. Value of Job Recycling Fee Requirement $50,000 to $99.999 3.0 $100,000 to $249,999 2.5 $250,000 to $499,999 2.0 $500,000 to $999,999 1.5 $1,000,000+ 1.0 After completion of the job and submission of the "Construction and Demolition Waste Recycling and Disposal Report Form", the "Recycling Fee" will be refunded in proportion to the amount of materials diverted through waste reduction and recycling. The calculation for determining the amount of the recycling fee to be refunded to the Applicant/Contractor is based on the following formula: Amount of Refund = (Diversion Rate on Report Forml x (Recycling Fee Paid) 50% The refund is not to exceed the amount of the Recycling Fee Paid. The City of Lynwood Department of Environmental Services can make a determination that the minimum diversion rate can be raised at a later date as waste reduction and recycling infrastructure is expanded. The formula will be adjusted accordingly. Section 2. Except as hereby amended, said Lynwood Municipal Code as amended shall be and remain in full force and effect. Section 3. If any section, subsection, sentence, clause, phrase, or portion of this ordinance or the application thereof to any person or circumstances is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof nor other applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. Section 4. This Ordinance shall be posted in at least three public places within the City of Lynwood and shall be effective from and after thirty (30) days following its adoption. PURPOSE The applicant is requesting approval of a special permit to allow an existing medical clinic for women to expand in order to provide massages and other therapeutic services. The subject business is located at 3737 Martin Luther King Jr. Boulevard, Suites 401A and 4016 in the HMD (Hospital, Medical, Dental) zone. BACKGROUND On September 10, 2001, the Planning Division received a preliminary business license application from Oasis Day Spau/Professional Medical Clinic at the above-identified location. The application requests approval to extend medical clinic services by providing therapeutic massages and beauty treatments to their patients, pre-natal patients and customers. The item was continued from the October 2, 2001 City Council meeting. The subject properly is located in the Centurywood Medical Building, on the north side of Martin Luther King Jr. Boulevard between Carson Drive and Benwell Drive. The subject property totals approximately 43,060 square feet and is developed with a six (6) story medical office building and two-story parking structure. The applicant has a valid business license for "Professional Medical Clinic For Women, Inc." located in Suites 600 and 601. The massage and beauty services extension is currently operating in Suites 401A and 4018. Attached is a copy of floor plans for the fourth floor and sixth floor of the Centurywood building. DISCUSSION For the past ten (10) years, Professional Medical Clinic for Women, Inc, has been located at 3737 Martin Luther King Jr. Boulevard on the sixth floor, Suites 600 and 601. The business is a group medical practice specializing in obstetrics and gynecology, and providing services in family practice, pediatrics and mental health. The business has been expanded to the fourth floor to create Oasis Day Spau that offers a variety of therapeutic services as an extension of their medical ofFces. Such services include massage, skin care, manicures, weight reduction, diet, and exercise. The staff includes doctor's, massage therapists, cosmetologists and trainers. The business operates Monday through Friday from 8:00 a.m. to 5:00 p.m. and Saturday mornings, and consists of eight (8) stafF members. Attached for City Council consideration are applicable staff licenses, certificates, and diplomas, as well as service and product correspondence. LMC Section 4-8.8(m)(1} identifies massage parlors as a use that requires a special permit approved by the City Council. LMC Section 4-26 sets forth requirements and standards for massage establishments to include but not be limited to signs, building code, sanitation, maintenance and permits. LMC Section 4-27 sets forth requirements and standards for massage technicians to include permits, background investigation, and qualifications. The attached resolution of approval includes conditions that are verbatim from Sections 4- 26 and 4-27 of the LMC. RECOMMENDATION Staff respectfully recommends that the City Council review the proposed special permit application, consider LMC standards and requirements, accept testimony from the applicant and public, and choose to either approve or deny the application for a special permit pertaining to massage oriented services. The subject business and all improvements shall comply with all applicable regulations of the Lynwood Municipal Code, the California Building Code, and the Los Angeles County Fire Code. BUSINESS LICENSE REQUIREMENTS 6. The business establishment and all staff members shall comply with all provisions of Lynwood Municipal Code Section 4-26 as follows: a) Every person conducting or managing a massage parlor or any other place where fomentations, massage, electric or magnetic treatment, alcohol rubs, Russian, Swedish, or Turkish baths are administered or given, or any public bathing place which has in connection a steam room, dry or hot room plunge, swimming pool, shower bath, or sleeping accommodations, or any school of massage which performs any such activity for any member of the public for any form of consideration or gratuity, shall first procure a license, and for each of such places pay an annual permit fee in the amount set forth in Section 408 of this chapter. b) A permit shall not be issued pursuant to this chapter unless an inspection reveals that the establishment complies with each of the following minimum requirements. c) A recognizable and readable sign shall be posted at the main entrance identifying the establishment. Such sign shall comply with all requirements of all City ordinances. d) Minimum lighting shall be provided in accordance with the Building Code, and in addition, at least one (1) artificial light of not less than forty (40) watts shall be provided in each enclosed room or booth where massage services are being performed on a patron. e) Minimum ventilation shall be provided in accordance with the Building Code. f) Adequate equipment for disinfecting and sterilizing instruments used in performing the acts of massage shall be provided. g) Hot and cold running water shall be provided at all times. h) Separate closed cabinets shall be provided for the storage of clean and soiled linen, and shall be plainly marked, "clean linen" and "soiled linen." i) All walls, ceilings, floors, pools, showers, bathtubs, steam rooms, and all other physical facilities shall be in good repair. j) In any establishment in which massage services are rendered only to members of the same sex at any one (1) time, such persons of the same sex may be placed in a single separate room or the operators of the massage establishment may elect to place such persons of the same sex in separate enclosed rooms or booths having adequate ventilation to an area outside said room or booth while massage services are being performed. k) Adequate bathing, dressing, locker, and toilet facilities shall be provided for patrons. A minimum of one (1) tub or shower, one (1) dressing room containing a separate locker for each patron to be served (which locker H:\WO RDFI LE\PLANNINGUtESOSlreso.council.massagemlk.doc -2- shall be capable of being locked) as well as a minimum of one (1) toilet and one (1) washbasin shall be provided by every massage establishment, provided however that is male and female patrons are to be served simultaneously at the establishment, separate bathing, a separate massage room or rooms, separate dressing and separate toilet facilities shall be provided for male and female patrons. I) A minimum of one (1) separate washbasin shall be provided in each massage establishment for the use of employees of any such establishment, which basin shall provided soap or detergent and hot and cold running water at all times and shall be located within or as close as practicable to the area devoted to the performing of massage services. In addition, there shall be provided at each washbasin, sanitary towels placed in permanently installed dispensers. m) Every establishment for which this section requires a license shall be maintained and operated in conformity with the following subsections. n) A person shall not enter, be or remain in any part of a massage parlor or premises licensed as such while in the possession of, consuming, or using any alcoholic beverage or drugs. The licensee, manager, and every supervising employee shall not permit any such person to enter or remain upon such premises. o) All walls, ceilings, floors, pools, showers, bathtubs, steam rooms, and all other physical facilities for the establishment shall be in good repair and maintained in a clean and sanitary condition. p) Wet and dry heat rooms, steam or vapor rooms, or steam or vapor cabinets, shower compartments, and toilet rooms shall be thoroughly cleaned each day the business is in operation. Bathtubs shall be thoroughly cleaned after each use. q) Clean and sanitary towels and linens shall be provided for each patron of the establishment or each patron receiving massage services. No common use of towels or linens shall be permitted. r) A permittee or person required by this section to obtain a permit shall not hire or employ a massage technician unless such massage technician possesses a valid, subsisting permit required by this chapter. s) This section does not apply to any treatment administered in good faith in the course of the practice of any healing art personally by any person licensed to practice any such art or profession under the provisions of the Business and Professions Code of the State of California or any other statute of this State. 7. "Massage technicians" shall comply with Lynwood Municipal Code Section 4-27 at all times. Massage technician shall mean any person, male or female who administers to any person, for any form of consideration or gratuity, a massage, alcohol rub, fomentation, bath, electric massage procedure, manipulation of the body or similar procedure, including a student at a school of massage who administers such a procedure to any person who pays for or gives a gratuity for such, whether the payment or gratuity is to such student or to the school. Following are standards pursuant to Lynwood Municipal Code Section 4-27: a) Every massage technician shall first procure a permit and pay a fee in the amount set forth in subsection 4-8.8m of this chapter. b) In addition to any other requirements of this chapter an application for a permit required by this section also shall show: 1) The two (2) previous addresses, if any, immediately prior to the present address of the applicant. H:\WO RDFI LE\PLANNf NGIRESOS1reso.counciLrnlssagemlA.doc -3- . ~ ~ ~ .-~ 2) Written statements of at least five (5) persons that the applicant is of good moral character. 3) Written proof that the applicant is over the age of eighteen (18) years. 4) Applicant's height, weight, color of eyes and hair. 5) Two (2) portrait photographs at least two (2") inches by two (2") inches. 6) Business, occupation, or employment of the applicant for the three (3) years immediately preceding the date of the application. 7) The license history of the applicant, whether the applicant has had a license for any business or similar activity issued by this or any other City, by any County, or by the State revoked or suspended, the reason therefore, and the business activity or occupation subsequent to such action of suspension or revocation. 8) All convictions, except for minor traffic violations, and the reasons therefore. 9) A certificate from a medical doctor stating that the applicant has, within thirty (30) days immediately prior been examined and found to be free of any contagious or communicable disease. 10)Such other identification and information necessary to discover the truth of the matters hereinabove specified as required to be set forth in the application. Nothing contained herein shall be construed to deny the Sheriff the right to take fingerprints and additional photographs of the applicant, nor shall anything contained herein be construed to deny the right of the Sheriff to confirm the height and weight of the applicant. ' c) The applicant shall furnish with his/her application a diploma or certificate of graduation form a recognized school wherein the method, profession, and work of massage technician is taught; or d) Furnish with his/her application a diploma or certificate from a school outside of the State of California which substantially complies with the educational requirements of Section 29025 of the Education Code of the State, or e) Have had not less than five (5) years of experience as a practicing massage technician and furnish proof thereof. f) Any department which has as one (1) of its duties the investigation of this activity or enforcement of this chapter shall have the right to verify for authenticity the information supplied pursuant to this subsection. g) This section does not apply to any treatment administered in good faith in the course of the practice of any healing art personally by any person licensed to practice any such art or profession under the provisions of the Business and Professions Code of the State of California or any other statute of this State. BUILDING AND SAFETY DIVISION 8. All construction shall meet or exceed the minimum building standards that are referenced in the following codes: The Uniform Building Code - 1997 edition; The Uniform Plumbing Code - 1997 edition; The Uniform Mechanical Code - 1997 edition; The Los Angeles County Fire Code 1999 edition; The National Electric Code - 1996 edition; All as amended by the California Building Code of 1998.
