A RESOLUTION: DIRECTING TOWN STAFF TO ACCEPT REVISED PROFFERS AND
CONCEPT PLAN AND TO ADVERTISE A PUBLIC HEARING TO
CONSIDER REZONING APPLICATION TLZM 2013-0006
(CRESCENT PARKE)
WHEREAS, at its regular business meeting of July 26, 2016, and after duly advertised
public hearings, the Leesburg Town Council denied the Crescent Parke rezoning application,
TLZM 2013-0006; and
WHEREAS, at the Town Council's regular business meeting of September 27, 2016, a
Motion to Rescind the decision to deny the Crescent Parke rezoning application TLZM 2013-0006
was approved by a majority of Town Council based upon the applicant's commitment to revise the
proffers and concept plan to address the concerns of the Town Council and the public; and
WHEREAS, in order to allow the public to address the Town Council on the revised
proffers and concept plan, a duly advertised public hearing should be scheduled as early as
possible and in conformance with Va. Code §15.2-2204; and
WHEREAS, to allow the Town Council to discuss the revised proffers and concept plan
prior to the public hearing, the application should be scheduled as a work session item prior to the
duly advertised public hearing.
THEREFORE, RESOLVED, the Council of the Town of Leesburg in Virginia:
1. Directs staff to accept revised proffers and concept plan for TLZM 2013-0006 and be
prepared to present and evaluate those revised proffers and concept plan at a work
session and a duly advertised public hearing;
2. Directs staff to advertise a public hearing on TLZM 2013-0006 for October 25, 2016,
and to advise the applicant to take all other steps necessary for proper notice of the

public hearing contained in Town of Leesburg Zoning Ordinance § 3.1.9 (Public
Hearing Notices);
3. Schedule the Crescent Parke application to be discussed at the Town Council Work
Session on October 24, 2016;
4. Invite members of the Planning Commission to attend the public hearing to address the
Town Council as petitioners on the revised proffers and concept plan; and
5. The applicant will submit the revised application materials, including the proffers and
the concept plan, to staff by close of business on Monday, October 3, 2016. Should
these application materials not be submitted by the applicant by that date, the
application will be advertised for the next public hearing date on November 15, 2016,
subject to application materials being submitted no later than close of business October
14, 2016.
