4. In the event negotiation is successful, the Mayor and City Clerk/Administrator are hereby
authorized to execute and attest easement agreements and agreements in lieu of
condemnation, subject to council approval. The City Attorney is hereby directed to take all
necessary action to complete said transactions, -as required by law.

5. ,In the event the necessary property rights for the Project cannot be acquired by negotiation,
the City Attorney is hereby, authorized and directed to initiate condemnation proceedings for
acquisition of any and all property rights necessary to fulfill the functions of the Project, as
provided by law, subject to Council approval. t
ON THE 28t11 day of August, 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Kahler introduced RESOLUTION AUTHORIZING THE ACQUISITION OF
EASEMENTS NECESSARY TO PROVIDE WATER SERVICE TO HICKORY KNOLL
SUBDIVISION, and made a motion for approval. The motion was seconded by Councilperson
Bartels.
Ayes: Phillips, Upton, Bartels, Ryan, Kahler
Nays: None.
Motion carried.
WHEREUPON, the Mayor declared that the RESOLUTION AUTHORIZING THE
ACQUISITION OF EASEMENTS NECESSARY TO PROVIDE WATER SERVICE TO
HICKORY KNOLL SUBDIVISION, be adopted' and signified his approval of the same by
affixing his signature hereto. f
PASSED, by the Council on the 28th day of August 2013, and approved by the Mayor on the 3rd
day of September 2013. J
