A RESOLUTION:
INITIATING TOWN CODE AMENDMENTS AND A PERMIT PROCESS TO
AUTHORIZE AND REGULATE PLACEMENT OF TABLES, SEATING AND
OTHER NONFIXED AMENITIES ON TOWN SIDEWALKS AND TOWN
OWNED RIGHT-OF-WAY.
WHEREAS, the widening and expansion of Town sidewalks has occurred in the downtown as a
result of the Downtown Improvements Capital Improvement Project; and
WHEREAS, downtown restaurant owners must apply for a permit in order to offer outdoor dining
where the service and consumption of alcoholic beverages is offered; and
WHEREAS, other store and restaurant owners have placed tables, seating and other nonfixed
amenities on Town sidewalks in the public right-of-way; and
WHEREAS, there is currently no permit requirement for these items to be placed on sidewalks and
in the public right-of-way; and
WHEREAS, the application for and issuance of permits will help reduce crowded conditions and
allow the Town to better manage its sidewalks; and
WHEREAS. A -frame and other types of signs are regulated by the Town of Leesburg Zoning
Ordinance and will not require a special permit beyond that set out in the sign ordinance.
THEREFORE. RESOLVED. the Council of the Town of Leesburg in Virginia directs the Town
Attorney to prepare amendments to the Town Code and a permitting process to authorize and regulate the
placement of all tables, seating and other nonfixed amenities not regulated as a sign under the Town of
Leesburg Zoning Ordinance on Town sidewalks and Town owned right-of-way.
