RESOLUTION NO. 2016-R162 ADOPTED December 13, 2016
A RESOLUTION: AWARDING THE STREET MILLING AND RESURFACING
CONSTRUCTION CONTRACT TO FRANCIS O. DAY COMPANY,
INC. OF ROCKVILLE, MARYLAND IN THE AMOUNT OF $1,297,500
AND APPROPRIATING PROJECT FUNDING
WHEREAS, the current renewable annual contract for milling and resurfacing was not renewed due
to the high competition and volatility of pricing for asphalt work, and the contract was re -bid; and
WHEREAS, the total amount that will be spent on this contract in any one year will vary and will
depend on the budgeted amount for that year; and
WHEREAS, in response to a public solicitation for the construction bids for this Street Milling and
Resurfacing Contract, the town received five bids on November 2, 2016 from the following firms:
• Francis 0. Day Company. Inc. $1.413.650.00
• Superior Paving Corporation $1,449,940.00
• Arthur Construction Company. Inc. $1,462,200.00
• Commonwealth Paving, Inc. $1,732,030.00
• Finley Asphalt & Sealing $1,776,914.00
WHEREAS, this is a unit price contract; and
WHEREAS, the quantities used for bid comparison are estimates; and
WHEREAS, the awarded contract is based on the unit price bid times the quantities included in the
bid documents; and
WHEREAS. the Department of Public Works & Capital Projects' street milling and resurfacing
budget for Fiscal Year 2017 is $412,500; and
WHEREAS. the Town has been award Primary Extenstion Funding from the Virginia Department
of Transportation in the amount of 5885.000; and
WHEREAS, the contract will be awarded in the combined amount of the street milling and
resurfacing budget for Fiscal Year 2017 of $412,500 and Virginia Department of Transportation Primary
Extension funds of $885.000. totaling $1,297,500; and

WHEREAS, the bids were evaluated by the Director of Public Works & Capital Projects and the
Chief Procurement Officer in accordance with the Town's Procurement Policy; and
WHEREAS, Francis 0. Day Company, Inc. of Rockville, Maryland was determined to be the
lowest responsive and responsible bidder; and
WHEREAS, this contract will be for an initial period of one year and renewable up to four
additional consecutive one-year periods.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION 1. An additional appropriation in the amount of $885,000 to the Department of Public
Works & Capital Projects' street milling and resurfacing budget is made for Fiscal Year 2017 street
maintenance, consisting of funding of $885.000 in Primary Extension Paving funding received from the
Virginia Department of Transportation.
SECTION II. The Milling and Resurfacing Construction Contract is hereby awarded to Francis 0.
Day Company, Inc.
SECTION 111. The Town Manager is authorized to execute this contract in the amount of
$1,297,500 for street maintenance.
