HomeMy Public PortalAbout2016_12-13_R170 Leegate-HotelThe Town of Leesburg, Virginia PRESENTED: December 13. 2016 RESOLUTION NO.2016-R170 ADOPTED: December 13. 2016 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2013-0014, LEEGATE FOR A HOTEL UP TO 140 ROOMS IN THE B-4 ZONING DISTRICT WHEREAS, Leegate LLC and Stanley Martin Companies, LLC have requested Special Exception approval to permit a hotel with up to 140 rooms and 70 feet in height on property identified as Loudoun County Parcel Identification (PIN) numbers 148-15-1619 and 189-10- 6250; and WHEREAS, the property is zoned B-4, Mixed -Use Business District; and WHEREAS, the Planning Commission held two separate duly advertised Public Hearings, first on December 18, 2014 and second on June 4, 2015. The Commission recommended denial at the meeting on June 4, 2015; and WHEREAS, staff recommends denial of the application; and WHEREAS, the Town Council held a duly advertised Public Hearing on November 15, 2016; and WHEREAS, Town Council has determined that the approval criteria of Zoning Ordinance Section 3.4.12 have been satisfied; and WHEREAS, Town Council has determined that the proposal will serve the public necessity, convenience, general welfare and good zoning practice. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that Special Exception application TLSE-2013-0014, Leegate - Hotel, is hereby approved to permit a hotel -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2013-0014, LEEGATE FOR A HOTEL UP TO 140 ROOMS IN THE B-4 ZONING DISTRICT with up to 140 rooms and 70 feet in height on property identified as Loudoun County Parcel Identification (PIN) numbers 148-15-1619 and 189-10-6250 subject to the following conditions: 1. Substantial Conformance: This special exception use shall be developed in substantial conformance with the Leegate plan set entitled "Leegate Zoning Map Amendment and Special Exception" dated March 1 1. 2012 and revised through November 21, 2016, prepared by Bowman Consulting Group, Ltd. 2. No Expressed or Implied Waivers: Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning, Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or as shown as approved by Town Council on the Special Exception Plat and supporting documents.
