Brewster Town Office Building with members Joanne Hughes, Bill Porter, Nancy Ellis Ice, Victor
Staley and Bob Barnard present.

OLD BUSINESS
Minutes of May 15, 2009
Hughes: Motion to approve the minutes as corrected. Second by Barnard. VOTE 5-0-0.

Chairman Ed Lewis arrived and took over the agenda as follows
1. Merrimack Valley Holding Company
Mr. Peno contacted Nancy Ice that he could not attend this meeting due to work schedule but he will attend
Friday, July 17, 2009.
Mr. William Hoffman, representing Merrimack Valley Holding Co.
Things are moving forward clearing off the property. A number of boats have left as a matter of doing
business. About 12 abandoned boats have been removed separate from storage; about 6 boats are still
there. The committee noted that by July we should have a clear view as to what is happening on the site.
Ms. Hughes suggested we go with the July date but if Mr. Peno does not appear a fine should be assessed
for each remaining boat.
Hughes: Motion to fine Mr. Peno (Bay View Boat Hauling) beginning the date of the next meeting for each
boat left on the property. Second by -ce. VOTE: 6-0-0.
2. Antinarelli-Daniels application
Application and items submitted as requested. Mr. Antinarelli noted the DEP is continuing to process-no
timeframe has been established. Mr. Lewis noted the DEP has an outstanding issue with the operation. Mr.
Daniels said they are working with them.

Further discussion between Daniels, Antinarelli, Bennett and committee about what is actually happening on
the site.
Mr. Bennett recommended the following from Daniels and Antinarelli; 1) copy committee on any
communication with DEP, 2) inclusive of timelines and inspections, 3) annual groundwater sampling at four
(4) wells- next being September, 2009, 4) 6 month reports on how much has been removed.
The application can be written to add compliance with any and all town regulations.
Hughes: Motion to approve the Water Quality application in compliance with restrictions as well as in
compliance with any and all Town regulations. Certificate for 1 year based on the recommendation of Dave
Bennett; with no additional fees. Second by Barnard. VOTE: 6-0-0
3) Cape Sand and Recycling Sampling
Some confusion regarding testing; DEP permit committed to 7; sampled 9. Intent to sample semi-annual
when there is no problem. If a problem arises that well will be retested. There are 12 wells on the property;
8 are tested by DEP. May and November testing. Results should be received within 30 days of testing.
Hughes: Motion that future testing on 8 wells will be done in November and May with results to be returned
within 30 days of testing. Second by Barnard. VOTE: 6-0-0.
4) Bennett Environmental Assoc. Inc-bill
Ellis: Motion to accept and submit for payment bill from Bennett Environmental Assoc. Second by Staley.
VOTE: 6-0-0.
5) Notice of Responsibility-Pleasant Bay Nursing Facility + Rehab. Center
No comments at this time, it was discussed at last meeting
6) Prime Engineering- Cape Sand groundwater sampling
Discussed as #3
7) E-mail from Dave Bennett RE: memorialize understanding
Committee read a-mail; no discussion
8) Zisson and Veara letter re: Merrimack Valley Holding
No title found, continue to discuss with Town Administration.
According to all research-property does not front on Freeman's Way.
Zoning Board of Appeals upheld the Zoning Agents order regarding the property; all uses must vacate.
Suggestion was made that the Planning Board should re-assess uses in that district.
9) Captain's Golf Course inspection report
Plans are on file, no application received.

Outside seating not considered in Title V- 12 month use.
Other Business
1) Comprehensive Water Planning Committee- founded
Will meet Monday, June 22 at 4:30pm
2) Revised Bylaw- Sand + Gravel and Water Protection
Does it have to go back to Town Meeting for vote?
3) Communication .tower on Freeman's Way- notice regarding renewal
Do not want them to ignore, understand about septic but there are other issues.
