LEEGATE STRUCTURED PARKING DECK B IN THE B-4 ZONING DISTRICT. WHEREAS, Leegate LLC and Stanley Martin Companies. LLC ("Leegate") have requested a Special Exception approval to permit a structured parking facility for a maximum of 992 parking spaces and a maximum height of 50 feet within the mixed use development known as "Leegate" which is located at the southwest quadrant of East Market Street and Battlefield Parkway; and WHEREAS. Parking Deck B is located on the eastern portion of the property identified as Loudoun County Parcel Identification (PIN) number 148-15-1619; and WHEREAS, the property is zoned B-4, Mixed -Use Business District; and WHEREAS. the Planning Commission held two duly advertised Public Hearings on December 8, 2014 and June 4, 2015. The Planning Commission recommended denial at the meeting on June 4, 2015; and WHEREAS, staff recommends denial; and WHEREAS. the Town Council held a duly advertised Public Hearing on November 15, 2016; and WHEREAS. Town Council has determined the proposed special exception use meets the special exception standards for a structured parking garage as set forth in the Zoning Ordinance; and -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2013-0004, LEEGATE STRUCTURED PARKING GARAGE B IN THE B-4 ZONING DISTRICT. WHEREAS, Town Council has determined that the Use Standards of Zoning Ordinance Section 9.3.18 and the Approval Criteria of Zoning Ordinance Section 3.4.12 have been satisfied: and WHEREAS, Town Council has determined that the proposal would both serve the public necessity, convenience, general welfare and good zoning practice. THEREFORE. RESOLVED by the Council of the Town of Leesburg in Virginia that Special Exception application TLSE-2013-0004, Leegate Structured Parking Deck B is hereby approved to permit up to 992 parking spaces on a parcel identified as Loudoun County Parcel Identification (PIN) number 148-15-1619 subject to the following conditions: 1. Substantial Conformance: This special exception use shall be developed in substantial conformance with the Leegate plan set entitled "Leegate Zoning Map Amendment and Special Exception" dated March 11. 2012 and revised through November 21, 2016, prepared by Bowman Consulting Group, Ltd. 2. No Expressed or Implied Waivers: Approval of the special exception does not express or imply any waiver of modification of the requirements set forth in the Subdivision and Land Development Regulations (SLDR), the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specially approved by the Town Council or the Land Development Official or as shown on the approved Special Exception Plan and supporting documents.
