HomeMy Public PortalAbout2016_12-13_R173 Cornwall Commons Parking ModificationThe Town of Leesburg, Virginia PRESENTED: December 13. 2016 RESOLUTION NO. 2016-R173 ADOPTED: December 13, 2016 A RESOLUTION: APPROVING ZONING ORDINANCE MODIFICATION TLOM-2016- 0009, CORNWALL COMMONS PARKING MODIFICATION; TO PERMIT SINGLE-SPACE GARAGE UNITS TO COUNT TOWARD REQUIRED PARKING IN A 19 -UNIT AGE RESTRICTED RESIDENTIAL DEVELOPMENT ON 1.2 ACRES IN THE MC, MEDICAL -HOSPITAL ZONING DISTRICT WHEREAS, application has been filed by Paul Reimers of Gibson -Cornwall LLC, requesting a zoning ordinance modification to permit single-space garage units to count toward required parking in a 19 -unit age restricted residential development on property identified as Loudoun County Parcel Identification (PIN) number 230-17-651; and WHEREAS, the property is zoned MC, Medical -Hospital Center District; and WHEREAS, staff recommends approval subject to conditions; and WHEREAS, the Town Council held a duly advertised Public Hearing on December 13, 2016; and WHEREAS, Town Council has determined the proposed modification meets the interim waiver standards as set forth in Zoning Ordinance Section 3.18 and that the modification requested is justified due to the urban infill nature of the project; and WHEREAS, Town Council has determined that the proposal will serve the public necessity, convenience. general welfare and good zoning practice. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that Zoning Ordinance modification application TLOM-2016-0009, Cornwall Commons Parking Modification, is hereby approved to permit single -garage spaces to count as required parking -2- A RESOLUTION: APPROVING ZONING ORDINANCE MODIFICATION TLOM-2016- 0009, CORNWALL COMMONS PARKING MODIFICATION, TO PERMIT SINGLE-SPACE GARAGE UNITS TO COUNT TOWARD REQUIRED PARKING IN A 19 -UNIT AGE RESTRICTED RESIDENTIAL DEVELOPMENT ON 1.2 ACRES IN THE MC, MEDICAL -HOSPITAL ZONING DISTRICT spaces for town houses in a 19 -unit age restricted residential development identified as Loudoun County Parcel Identification (PIN) number 230-17-6511, subject to the following conditions: 1. Garage Conversion: The Homeowners Association documents shall include a provision that will prohibit any garage space from being converted to any type of habitable and/or living space or be used principally for other than storage of vehicles. 2. No Expressed or Implied Waivers: Approval of this interim waiver modification does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council herein. Final plats, site plans and construction drawings are subject to applicable Town regulations. PASSED this 13`s day of December, 2016 David S.
