Members present: Mayor, Wayne Neddermeyer; Councilmembers, Arthur Theis, Nancy Laurent, Thomas Crosby, William Reiser; Clerk, Donna Roehl; Planning and Zoning Administrator, Jeanne Mabusth Regarding minutes of June 21, 1977; Donald Gaspar Plat, page 143, Item 2: Motion by Thomas Crosby, seconded by William Reiser to approve Resolution 77-22 subject to: installation of a shallow trench septic system acceptable to city engineer and a 20 ft. wide drainage easement be shown on the western lot. Motion carried unanimously Motion by arthur Theis, seconded by Nancy Laurent to accept the minutes of June 21, 1977 as corrected. Motion carried unanimously 1. HIRING OF NEW UTILITIY AND ROAD DEPARTMENT EMPLOYEES Ron Duran introduced Paul Ogland whom he recommended as new employee for the Sewer and Water Department. He stated that they had interviewed several applicants and felt that Mr. Ogland was the most qualified. Moyion by Nancy Laurent, seconded by Thomas Crosby to hire Paul Ogland as sewer and water department employee for a 6 month probationary period at $5.00 per hour, employment to take effect July 18, 1977. Motion carried unanimously Ron Duran introduced Leroy Giese as new employee for street department. He explained his qualifications and recommended that he be hired. Motion by Arthur Theis, seconded by William Reiser to hire Leroy Giese as road department employee for a 6 month probationary period at $5.00 per hour, employment to take effect July 11, 1977. Motion carried unanimously 2. MEDINA MORNINGSIDE WATER RATES Ray Bergerson and Marlon Haugen appeared to request that the Water Supply Co. be allowed to raise the water rates at Medina Morningside from 800 to $1.60 per 1000 gallons, plus several other considerations. Discussion of charging the city 8100 per year for each.fire hydrant. Council felt hydrant charges should be built into the water system overhead. Nancy Laurent inquired as to why the street remains un repaired since a water main break during the past winter. Mr. Bergerson stated that he was not aware of the problem and would check it out. Richard Schieffer stated that the city should have complete financial statements to make a comparison. Marlon Haugen asked if it would be possible to work with a council member on the request. Thomas Crosby stated that he would be willing to go over the financial statements and make a comparison. He also asked that consideration of the request be discussed at a meeting at which he was present and that he may not be able to attend the July 19th meeting. Matter was tabled until it could be studied. NORTH - SOUTH ROAD Discussion as to work that had previously been done regarding a north -south road through Medina. Clerk was asked to contact Craig Spencer from Hennepin County and invite him to the August 2nd meeting to discuss the Counties timetable, etc. 4. FLOOD INSURANCE PROGRAM, MODEL ORDINANCE Jeanne Mabusth stated that within 6 months Medina will need a Flood Insurance Ordinance and she she requested that the engineer and the attorney be asked to assist in its development. Council agreed that this should be done. 5. PARK FEES Jeanne Mabusth presented information regarding Corcorans park fees; 5% of the selling price of property selling as determined by the city engineer. Willis Kohnen, city assessor, has informed her that land is valued at from $1500 to $4000 148per acre and that the valuations should be checked once a year. Motion by Thomas Crosby, seconded by Arthur Theis that current park fee be superseded by: Park fee shall be 5% of fair market value of property subject to payment of park fee as determined by city assessor. That City may, at its option, accept land in lieu of park fee, offered by applicant. That commercial property pay park fee at 5% fair market value as determined by assessor at time of final site approval, and that platting code be amended appropriately. Motion carried unanimously 6. NORTHWESTERN BELL TELEPHONE, BURY CABLE Request from Northwestern Bell Telephone Co. to bury cable at Co. Rd. 24 and Apache Dr. Motion by Nancy Laurent, seconded by Arthur Theis to approve Resolution 77-28 approving burial of cable on Co. Rd. 24 and Apache Dr., subject to approval of the Public Work Director. Motion carried unanimously 7. BOAT RAMP, LAKE INDEPENDENCE Ron Duran stated that Arthur Theis had authorized the repairs of the parking space near the boat ramp. Clerk was advised to take charges out of the Park Fund. 8. CIRCUIT RIDER ADMINISTRATOR Nancy Laurent presented information on Circuit Rider Administrator who would work with a number of cities to attend meetings, find out what grants are available and help with administration problems. She did not know what salary this person would receive. She stated they would need to know if Medina were interested because of the division of costs among the interested municipalities. 9. CITY COUNCIL SALARY INCREASE Wayne NedP'ermeyer stated that he felt that councilmembers should have a salary increase to $75 per month and the Mayor's salary should be increased to $100 per month. Thomas Crosby felt that increase should be accomplished by election and not the way that the State legislature and the U.S. Congress vote pay raises. Richard Schieffer stated that Council may increase its' salary but increases do not take effect until the January following an election. Wayne Neddermeyer asked that the matter be tabled until members had checked the League of Cities schedule of salaries. 10. COMPREHENSIVE PLAN Jeanne Mabusth inquired as to the status of a planner and the need for one. Thomas Crosby stated that Metro Council had disregarded the comments on the systems statement had had been sent to them by Medina and he asked Ms. Mabusth to find out from them the reasons for their action. He also felt that we need an expert to help us and perhaps we should wait for several months to find out what happens with those cities eager to have their plans approved. 11. PLANNING COMMISSION MEMBERS Thomas Crosby stated that he would discuss with Mike Scherer the possibility of his serving on the Planning Commission and he also would talk with Ron Roy as to his plans. 12. HOLY NAME DRIVE Nancy Laurent presented two motions for discussion regarding upgrading of Holy Name Dr. Motion by Nancy Laurent, seconded by Arthur Theis to request the engineer to prepare plans and specifications for Holy Name Dr. with the understanding that the city could still abandon the project if they so wished. Motion carried unanimously Motion by Nancy Laurent, seconded by Arthur Theis to request the engineer to prepare percentage formula for cost of assessment for Holy Name Dr. which will be fair to both the city and the property owners. Motion carried unanimously Thomas Crosby stated that Medina does not have sufficient funds for the entire project and must assess the entire city or affected property owners to complete the project. Robert Raskob stated that roads cannot be fixed using general revenue but a bond issue 149 is needed. Nancy Laurent stated that to bond, a vote of the people must be taken, and this would cost money. Rochie Begin asked what would be done with the road in the meantime. Various alternatives were discussed. Motion by Thomas Crosby, seconded by Arthur Theis to authorize spending up to $1000 for labor and material to repair Holy Name Dr., as determined by the Road Commissioner and the Public Works director, with an effort that material used be of the type that can be used for long term raod improvements. Motion carried unanimously 13. CITY HALL LANDSCAPING Motion by Thomas Crosby, seconded by William Reiser to authorize expenditure of $250 to continue the landscaping around the city hall. Motion carried unanimously 14. BILLS Thomas Crosby asked Richard Schieffer b comment on the criminal cost portion of his bill. Richard Schieffer stated that there are inadequacies in the enforcement procedure and that the city must prosecute those tagged by the State and the County. Discussion of the bill of Leo Leuer for "balance of vacation." Determination was made that there was vacation time accrued. Motion by Thomas Crosby, seconded by William Reiser to apy the bills including Mr. Leuer's, with a restrictive endorsement stating that it is the final payment for all, due from the city. Order Checks # 6793-6847 in the amount of $23,320.40 and Payroll Checks #4545-4570 in the amount of $7004.35. Motion carried unanimously 15. TAX PETITIONS Discussion of options available to defend tax cases by City property owners. Richard Schieffer stated that we can have the County defend us or we may do it ourselves. Clerk was requested to contact Wayne Johnson for information regarding what Medina would pay the County for defense. 16. TAX FORFEIT PROPERTY Discussion of request from Hennepin County to release 3 tax forfeit parcels. Clerk will determine which Medina Morningside lot has gone tax forfeit. Discussion of city property becoming tax forfeit. Richard Schieffer stated that in dis- cussions with Willis Kohnen, Mr. Kohnen felt that it was not his job to file tax abftements. He suggested the Council should give Mr. Kohnen instructions as to what to do. Motion by Thomas Crosby, seconded by Nancy Laurent to authorize the Attorney to instruct Willis Kohnen as to the necessary forms to file regarding tax abatement on city owned property. Motion carried unanimously 17. BASE RADIO STATION Discussion of the purchase and manning of a base station for the Public Works and other departments. Motion by Nancy Laurent, seconded by Wayne Neddermeyer to purchase a base station, antenna and point to point channel for $595. Motion carried. Voting No, Thomas Crosby 18. VOCATIONAL TECHNICAL SCHOOL Discussion of letter from Vo Tech and in particular the paragraph referring to plans for building and a previous court case. Thomas Crosby indicated that if left unanswered it may be construed to mean that activities and plans are approved. He requested that the attorney respond to the letter, if he shares the opinion that their activities need city approval and if the legal case cited in the letter applies to this situation. Wayne Neddermeyer indicated that the City should be telling them what they can do rather than asking them what they are doing. 150 19. PERSONNEL Nancy Laurent asked if she could work with Bill Clelland on a job description policy. Motion by Thomas Crosby, seconded by William Reiser to authorize Nancy Laurent to work with Bill Clelland on job descriptions and personnel policy. Motion caf'ried unanimously 20. HIGHWAY 55 SAFETY Discussion of letter received from Mr. Rasmussen regarding accidents on Loretto and Hamel. He stated that statistics show that there have been that area in a 2 year period. Chit Hoover stated that it is very well patrolled by the State, County Discussion, also, of drivers passing in "No Passing" zones. Motion by Thomas Crosby, seconded by Arthur Theis to adjourn.
