The Council of the City of Medina met in regular session on Wednesday, July 5, 1978, at
7:30 P.M.
Members present: Mayor, Wayne Neddermeyer; Councilmembers, Nancy Laurent, William Reiser,
Arthur Theis; Clerk, Donna Roeh1; Planning and Zoning Administrator,
Jeanne Mabusth; Chief of Police, Charles Hoover; Attorney, Richard
Schieffer; Public Works Director, Ron Duran; Engineer Lyle Swanson

1. PUBLIC WORKS DEPARTMENT
road repairs
Ron Duran reported that money budgeted for road repairs has been used.
Nancy Laurent advised that money set aside for capital outlay be used for additional road
materials.
Council advised road department to blacktop Willow Dr. south and finish road repairs in Medina-
Morningside.
Discussion of condition of Chippewa Rd.
Council advised removing ehe old culvert and replacing and building up the road in that area
with materials taken from ditch cleaning.
County -State Aid roads
Ron Duran reported that Cottonwood Trail and Hickory Dr. needed to be seal coated but could not
be done with County -State Aid funds
Lyle Swanson suggested getting together with Maple Plain to secure better quotes on seal -
coating.
Council requested that the engineer secure 2 quotes for the seal -coating of Pinto Dr., Sioux
Dr., Brockton Lane and Hunter Dr.
Discussion of the County -State Aid Read system.
Motion by Arthur Theis, seconded by fancy Laurent to authorize the City Clerk to request the
following Medina roads be added to the County -State Aid System:

2. ROAD IMPROVEMENTS, PUBLIC HEARING 8:00 P.M.
Wayne Neddermeyer explained that it is impossible to maintain the roads on the budgeted money
so if several roads could b e improved at one time then the remainder of the roads could be
kept up with the yearly budget.
Lyle Swanson explained that it would cost approximately $500,000 to rebuildand pave Hunter Dr.
south and north, Holy Name Dr., Hamel Rd. to Willow Dr. and Willow Dr. to Co. Rd. 24, Tamarack
Dr. would be upgraded and graveled.
He explained that these streets were selected because they carry the heaviest traffic and cost
the most to maintain.
r78 Phil Chenoweth, Financial Consultant, explained that a $575,000 bond issue would not deplete
the cities debt limit but would leave $250,000 for any other project.
The interest rate at the present time is 5.75%. This would raise the mill rate by 3.2 mills.
He cited some examples of tax increases: A farm with a market value of $75,000, taxes would
increase by $68.00; a home with a market value of $20,000, taxes would increase by $16.00
per year.
Joe Raskob: What about drainage?
L. Swanson: Ditches or whatever is needed in a particular area.
Vernon Roehl: What about Chippewa Rd.?
Neddermeyer: Road department has been advised to dig out the culvert and the ditches and
fill the low spot.
V, Roehl: What about the fences that we removed?
Neddermeyer: We found that the road easement was only 2 rods wide so we cannot get the work
done until we secure the necessary easements.
Tom Anderson: Good roads are necessary for safety and fire protection and will increase
property valuation of someone wishing to devlop his property. Could not some
of the costs be assessed to those properties benefiting directly from improvements
J. Raskob: What is the percentage of commercial valuation as compared to other?
Chenoweth: 20% on commercial and industrial and 80% on other properties.
Pat Headley: Who would do the work?
Neddermeyer: Work would be bid but first must go to a vote of the people. He asked for a
show of hands, for and against a bond issue.for road improvements.
Vote was 22 for and 10 against.
Kathy Rensmann: What is the time table for the improvements?
Neddermeyer: Would want to go to a vote of the people as soon as possible.
Roman Lesniak: If sewer and water were not done in Medina Morninside would the entire city
pay for the street improvements?
Neddermeyer: The city would pay for street improvements but I would not want to put in a
street in Medina Morninside without sewer so therefore the streets and sewer
would be assessed as in Hamel and Independence Beach.
Al Engleman: Medina Morninside paid for streets once; Independence Beach did not. Now
we should pay for them again.
K. Hansmann: What if a bond issue does not pass?
N. Laurent: Would have to raise the mill rate. At the present time we will have to use
money budgeted for capital improvements to keep up with repairs.
R. Schieffer: A city has the authority to assess for utilities and associated street im-
provements, those streets are thought of as serving a subdivision. Thru
streets are considered collector streets and all should pay for them.
Motion by Theis, seconded by Laurent to close the Public Hearing.
Motion declared carried

3. MEDINA MORNINSIDE IMPRO aI TS
Wayne Neddermeyer stated that in conversations with Orono they have indicated that they may
be willing to pay for half of the 15" sewer line and the lift station.
Also Fred Keller has expressed interest inmewering his property south of Medina Morninside.
This would lower the assessments per lot.
Pat Healdy reported the results of the petition that had been circulated, as follows;
42 for storm sewer, sanitary sewer, water improvements and street restoration
5 for storm sewer, sanitary sewer and street restoration
1 for no improvements
3 for street improvements
2 for other (not specified)
Lyle Swanson reported that he would need authority to proceed with preliminary plans.
Motion by Theis, seconded by Reiser to approve a resolution accepting the petition and
ordering preparation of preliminary plans.

Motion by Laurent, seconded by Theis to authorize the attorney to prepare the above
resolution wihich will be numbered 78-24.

4. HAMEL TEST WELL
A copy of the purchase agreement was given to Bab and Joe Raskob. 7

Richard Schieffer explained conditions of the agreement: 9000 sq. ft. at 75 cents per
square foot for a total of $6750. $500 is to be paid down,$100 of which, has already been
paid. The city will pay 12 equal installments of $643.68 per month.
Joe Raskob stated that they would be spreading the special assessments over their remaining
property.
Motion by Reiser, seconded by Laurent to authorize the Mayor and Clerk tossign the purchase
agreement.
Motion declared carried
5. HOWARD SCHABER, SEWER LINE PROBLEM
Discussion of the bill for minor repairs of sewer line due to a sewer back-up problem.
Council advised that if the problem lies with the city the entire bill be paid by the city
when the entire corrections are made.
6. MINNEAPOLIS GAS COMPANY
Motion by Reiser, seconded by Laurent to adopt Resolution 78-25 allowing the Minneapolis
Gas Company to install gas lines in the Hunter Farms Addition.
Motion declared carried
. EUGENE DABROWSKI CABIN
'eanne Mabusth reported that Mr. Dabrowski has contacted the Loretto Fire Department and will
be burning down the cabin on his property at Independence Beach within 30 days.
8. LYDIA HEIL CABIN
Lydia Heil reported that the property had been sold and the new owners have removed the cabin
on the former Ted Pollock property.
9. MARIE PETERSON
Motion by Theis, seconded by Reiser to grant a 20 ft. variance to Marie Peterson to allow
construction of a house on Lots 17 and 18, Block 7, Independence Beach. House to be 30 ft.
from the property line. Variance granted because of small lot size.
Motion declared carried
Mrs. Peterson reported that she would be converting the outdoor toilet into a tool shed.
10. GORDON HENDERSON
Motion by Theis, seconded by Laurent to grant a variance to Gordon Henderson for the construct-
ion of a garage on Lot 7 and 8, Block 24, Independence Beach. Garage to be 20 ft. from the
rear lot line. Variance granted because of slope of property.
Motion declared carried.
11. CHARLES PANGIER
Mr. Pangier appeared to request the sodding of a 10 x 360 foot strip fo property that had
been disturbed during the Independence Beach sewer and water construction project. The
property had been seeded but the seedhad not held.
Lyle Swanson reported that he did not feel the property was a lawn at that time and thus
was not sodded.
Richard Schieffer suggested setting adollar amount for the work and pay when completed, if
Council felt that the city wp responsible.
Motion by Laurent, seconded by Theis to pay Charles Pangier $150 for the sodding of the
10 x 360 foot strip of property along Fern St., amount to be taken from the Independence
Beach construction fund.

12. GREG DUBAY
Mr. Dubay discussed his request for a sign variance to allow the placement of a sign to iden-
tify his business in the Medina Creekside Addition.
Council suggested a directional sign near Hwy. 55.

O 0 in size, in a proper location off Hwy. 55 and Pinto Dr.

13. GERALD TWEED
Mr. Tweed appeared to explain to Council his business operation on Hackamore Rd. as a re-
sult of a request from Corcoran residents in the area.
Be stated that his is a small cement contracting business, he has 4 trucks and a backhoe.
Be added that he will try to park his vehicles so as not to be visable to nearby residents.
14. INDEPENDENCE HEIGHTS SEWER SMELL
Discussion of a petition that had been received regarding anEapparent sewer smell in the
Independence Heights area. This problem has been reported and discussed previously.
Lyle Swanson reported that there is aa harmless smoke test that can be conducted on the
lines which will determine where the problem lies.
Motion by Laurent, seconded by Reiser to authorize the engineer to conduct a smoke *est on
the Independence Heights sewer lines on Saturday July 15th and to notify the residents prior
to the test.

15. PEET - JOHNSON
Discussion of an apparent flooding problem caused by the construction of a road by Mr. Johnson.
Council asked that Jeanne Mabusth and Chuck Hoover investigate the problem.
16. TAX REVIEW
Motion by Reiser, seconded by Theis to authorize Hennepin County to handle the proceedings
with regards to Rolling Green Country Club and Remele Farms.
Motion declared carried
17. WAGES
Motion by Laurent, seconded by Theis to pay Scott Mabusth $2.50 per hour for mowing grass
and $5.00 per hour when working on the roads; Also to pay Richard Krotzer 5.50 per
hour for part time work on the sewers.

18. BILLS
Motion by Theis, seconded by Laurent to pay the bills; Order checks # 7476-7524 in the amount
of $22,275.72 and Payroll checks # 4955-4980 in the amount of $7195.54.

19. CIGARETTE LICENSE
Motion by Theis, seconder 'Dy Reiser to issue a cigarette license to K and K Bait for the
remainder of calendar year, 1978.

20. JOHN DYKHOFF
Discussion of the sewer back-up in Mr. Dykhoffts house.
Lyle Swanson reported that there is a valve costing approximately $250.00 t.:at could be
installed in Mr. Dykhoffts home to avoid future problems.
Motion by Reiser, seconded by Theis to authorize the engineer to install a valve in the
John Dykhoff home for $250.00.
Motion declared carried
21. HAMEL WELL
Lyle Swanson reported that the State Health Department always looks for the worst situation
that could happen. He added that a pump can be put in the test well and that a temporary
line run to the hydrant and the state will approve. •
Council advised the engineer to tell the state that we are moving with all reasonable sppe
and that because of HUD regulations we will proceed only as fast as the law allows.
