HomeMy Public PortalAbout2006-16 - AMENDMENT - RIGHT -OF-WAY PERMITSORDINANCE 2006 -�(- AN ORDINANCE AMENDING SECTION ORDINANCE 2003 -4, AMENDING ARTICLE 4 OF THE GREENCASTLE CITY CODE REGARDING RIGHT -OF WAY PERMITS WHEREAS, Ordinance 2003 -4 set out the instructions to apply for a permit to construct within the public rights —of -way in the City of Greencastle; and WHEREAS, the former ordinance required that all permit activity would be conducted through the office of the City Engineer, and the City would like to change that to the office of the Street Department. NOW THEREFORE be it ordained by the Common Council of the City of Greencastle that it hereby amends Ordinance 2003 -4, amending Article 4 of the Greencastle City Code by adopting the attached Instructions for Application for Permit to Construct in Public Rights -Of -Way of Greencastle, Indiana. This Ordinance shall have full force and effect upon passage of the Greencastle Common Council and its approval by the Mayor. Morrow, PE, City Engineer Effective January 10, 2007 PRIOR TO ANY WORK within the City of Greencastle's public rights -of -way (ROW), the owner or contractor shall obtain a permit. Article 4 of the City Code as amended by ordinances #1998 -26, #1999 -16 and #2003 -4 govern the permit process for work activities within the City right -of -way (ROW). Applicants shall use the latest forms for requesting permission to construct in the public ROW. The Property Owner or Contractor employed by the Owner may apply for permits. Applications for permits may be obtained from: " Street Department at 502 North College Street, " " City of Greencastle Website Refundable Fees: At the completion of the work activity, the permitee shall close out the permit by requesting the Street Department to inspect and approve the work activity. When the permit is closed, performaihce bonds may be released if requested, in writing. Individual Performance Bond'. the applicant shall post a surety to guarantee the quality of the work. Individual permits may be obtained by posting a performance bond or cashiers check as follows: For Trench��Excavations (minimum 1 horizontal square foot per activity): 1. 0 to 2 feet deep; $4.80 per horizontal square foot 2. 2 to 4`.feet deep; $6.40 per horizontal square foot 3. 4 to��6 feet deep; $7.00 per horizontal square foot 41 6 #0 8 feet deep; $7.60 per horizontal square foot 5. Greater than 8 feet deep; $8.60 per horizontal square foot For Driveway Work 1. 0 to 12 lineal feet of driveway width; $1,500.00 2. 12 to 24 lineal feet of driveway width; $3,000.00 3. Greater than 24 feet of driveway width; $4,500.00 " Instructions for Permit to Work in Public ROW page 1 of 4 City of Greencastle, Indiana Annual Performance Bond: In lieu of an Individual Performance Bond, persons or contractors that anticipate many projects within the ROW are encouraged to post an annual Performance Bond in the amount of $7,500. Annual Performance Bonds shall be presented to the City Clerk. Annual permits do not alleviate the contractor from obtaining a permit for individual work locations. Non- Refundable Fees: $100 shall be paid per activity. Activity: Each activity shall include, but not be limited to: 1. a single continuous trench, 2. a single driveway, 3. a single continuous sidewalk, 4. a single drill location, 5. a single day of a lengthy excavation/tunneling project, 6. a single project at City Engineer/ Street,Commissioner's discretion, 7. or other work activities occurring within the ROW. Insurances: The limits of liabilities for insurance shall provide the following coverage for not less than the following amounts or greater where required by Law: 1. Workers Compensation: a. State: Statutory is b. Employer's Liability: $100,000.00/$500,000.00/ $100,000.00 2. Contractor's Liability Insurance a. General Aggregate: $2,000,000,00. The City of Greencastle shall be named as an:additional insured with certificates of insurance to be provided,to the!City of Greencastle with a thirty (30) day cancellation provision. b. Products - Completed :Operations Aggregate: $2,000,000.00 "per job" aggregate c. Personal and Advertising Injury (Per person/organization): $1,000,000.00 d. Each.Occurrence (Bodily Injury and Property Damage): $1,000,000.00 e. PropertyyDamage liability insurance will provide Explosion, Collapse and Underground coverage: $1,000,000.00 1'. Umbrella Liability: i. General Aggregate: $1,000,000.00 ii. Each Occurrence: $1,000,000.00 Notification The permitec shall provide a minimum of three (3) business days before starting work. Failure to provide adequate notice may be grounds for revocation of permit and permittee maybe disqualified from applyine for and obtaining another permit for one (1) year. Instructions for Permit to Work in Public ROW page 2 of 4 City of Greencastle, Indiana " If any or all of a street is expected to be blocked, the pennitee is responsible for notifying the Putnam County 911 Dispatch Center. If this blockage is expected to occur during a school day, the Greencastle School Corporation Bus Barn shall also be contacted. Violations and Penalties Any person violating the provisions of this chapter or who shall fail to comply with any of the requirements of this chapter commits a Class D Ordinance violation and shall be fined in any sum not exceeding $100.00 for each day of violation of this chapter. Standards: The City has standard details and specifications for work that is,to be completed within the ROW. All work within the ROW is required to conform to latest version of these standards. Copies of these documents are available in the City'Engineer's office, Street Department, or on the City's website. Safety: The permittee shall bear the sole responsibility for workers and traffic safety. At a minimum, the permitee shall comply with all applicable Indiana OSHA requirements and the Indiana Manual of Uniform Traffic Control Devices ( IMUTCD). A copy of the IMUTCD is available in the City Engineer's office or the Street Department. Driveways: Location of driveways may be subject to restriction by City Engineer and /or Street " Commissioner. Contact City Engineer and/or Street Commissioner if location is in the vicinity of an intersection or other traffic hazard. Failure to have location approved may result in permitee being required to remove driveway at permittee expense. Utility Locates: Indiana Underground Plant Protection Services (IUPPS) aka Holey Moley will contact the City Se'iver and��Water Utilities as well as the local private utilities of Vectron Gas, Verizon Telephone, Cinergy Electric, and Insight Communications Cable TV. Just call I- 800-S8 at least "2 Full Working Days" but not more than 20 calendar days prior to the start of your excavation's` Flowable Fill: Unless a compactioti and4esting plan is pre - approved by the City Engineer and /or Street Commissioner, all ezeavations under pavement within the right -of -way is required to be backfilled with flowable fill. Flo%vablc fill shall be manufactured, delivered, and installed in accordance with INDOT specifications for either type 2 or type 3 Flowable Fill materials. ADA Standards: The City has an ADA policy that includes work by private individuals in the public right - of -way. The City Engineer's office and Street Department have information that pertains to the proper ADA specifications that will be enforced. This information includes slopes, " textures, colors, and other pertinent data.
