Sec. 4123 PERA 411.56 6220. 34 4 6The Council of the City of Medina met in regular session on Tuesday, July 6, 1976 at 7:50 P.M. Members present: Mayor, Wayne Neddermeyer; Councilmen, Arthur Theis, Donald DesLauriers, William Reiser, Robert Franklin; Clerk Donna Roehl, Attorney, Richard Schieffer; Planning and Zoning Administrator, Anne Dorweiler. Motion by Robert Franklin, seconded by Arthur Theis to approve minutes of meeting of June 15th, as presented. 1. HAMEL FIRE DEPARTMENT Julius Dorweiler, Hamel Fire Chief, explained reasons: for their purchasing new fire truck. They have met with Corooran, Medina and Northwest Chamber of Commerce officials and have not gotten satisfaction regarding means with which to pay for new truck. All are sympath- etic but have not committed themselves. They will now begin to contact businessess and home owners in their area to determine needs and if no favorable results are received they may return the new truck. At the present time they have borrowed the amount of the purchase price at 8% interest. Motion by Robert Franklin, seconded by Donald DesLauriers to hold a special meeting on Tuesday July 27, at 8:00 P.M. to consider the Hamel Fire Department funding problem. Motion carried unanimously 2. PINTO DRIVE Memo read by Anne Dorweiler regarding status of Pinto Dr, and similar undedicrted roads. Roadway dedication is needed on Pinto Dr. because Donald Roehl has sold some of his property. Discussion of the Eisinger property and the need for an upgraded street at the time it is subdivided. Attorney stated that land dedication is necessary so that at a future date, when upgraded roadway is needed, there will be sufficient land available. Donald DesLauriers stated that the subdividers of the Eisinger should pay the major portion of upgrading Pinto Dr. as Donald Roehl does not need an upgraded road. Wayne Neddermeyer stated that it is a village road and any dedication of additional land by Donald Roehl should include his not having to pay for upgrading the road at a future date. Motion by Robert Franklin, seconded by Donald DesLauriers to request that Donald Roehl present a sketch of his proposed division and a dedication of 60 ft. along Pinto Dr, and request that the attorney work out an adaptation of driveway arrangement we have had in previous similar cases. Richard Schieffer felt that previous driveway agreements would not work in this case and that an easement should be given and upgrading of road left until later development. Anne Dorweiler felt that the city may have to get in the road building business and assess benefitted property. Robert Franklin asked that his motion be withdrawn. Donald DesLauriers withdrew the second. Motion by Robert Franklin, seconded by Donald DesLauriers to ask that Donald Roehl come in with a dedication of 60 feet of roadway through his property on Pinto Drive. Motion carried unanimously Robert Scott referred to a similar situation on Chestnut Rd. Donald DesLauriers stated that some sort of contract, for upgrading, be made with buyer and dedication be gotten from abutting property owners. Robert Scott stated that he would contact owners and try to secure easement dedication from them. 3. JERRY BERTHIAUME Mr. Berthiaume stated that he would like to build an establishment on Hamel Rd. and apply for an On -Sale liquor license. Discussion of what would be involved in the City issuing additional liquor licenses. Memo from Richard Schieffer was discussed regarding the necessity of a referendum to determine if Medina residents wish the city to issue additional licenses. Motion by Robert Franklin, seconded by Arthur Theis that the Medina City Council not call for a special election at this time, as there are, at present, sufficent liquor establish- ments in Medina. Donald DesLauriers stated that this could be put on the ballot and it would not mean 47 that Mr. Berthiaume would get a license, just that one could be issued. Robert Franklin stated that voters would want to know on what they were voting. Voting Yes, Robert Franklin, Gilliam Reiser. Voting No, Wayne Neddermeyer, Donald Des- Lauriers, Arthur Theis. Motion not carried. Mr. Berthiaume stated that he would secure signatures of residents who are in favor of his building a liquor establishment. 4. LEO LEVER Discussion of resolution regarding work, benefits, and salary of Mr. Leuer to maintain the Hamel and Independence Beach sewer and water systems. Mr. Leuer stated that extra help is needed when there are main breaks and when installing sewer rings. He also felt that travel expense should be more than 10 cents per mile. Motion by Robert Franklin, seconded by William Reiser to adopt Resolution No. 76-22, regard- ing conditions of employment for sewer and water superintendent, that travel expense be $50.00 per month, and that resolution becomes effective August 1, 1976. Motion carried unanimously 5. ANNE DORWEILER Mooney Lake Anne Borweiler explained that Plymouth is anxious for Medina do Orono to get involved in a petition to study drainage problems of Mooney Lake and that Bob Searles, Mayor of Orono and John Holmquist of Minnehaha Creek Watershed had been asked to present information. Mr. Holmquist explained that development in Plymouth is the main reason for rising level of Mooney Lake although the development in Medina and Orono have also contributed in a minor way to the rpoblem. Plymouth has asked that a study be done to determine the solution to the problem, which may mean diking or the construction of an outlet through Lake Lydiard to Long Lake. Medina and Orono could be assess if the project were to proceed. Mr. Searles stated that rono has taken the same posistion as Medina and that is that urban- ization of Plymouth has caused the problem and that Plymouth should attempt to solve it. Motion by Robert Franklin, seconded by William Reiser to adopt Resolution No. 76-23, regard- ing Mooney Lake water drainage problem. Motion carried unanimously Wayne Neddermeyer inquired as to the progress of Orono interceptor. Mr. Searles explained that he thought it would take perhaps 5 years before Medina Morningside could be served by sewer. Ron Winterhalter Discussion regarding Mr. Winterhalters filling on his property at Holy Name Lake. Mr. Holm- quist stated that it is the owners responsibility even if the city has been partially respon- sible. A permit is needed from Minnehaha Creek Watershed, the City of Medina and the DNR. He may be allowed to fill, leave what exists or they may require removal of what has been filled. Mr. Winterhalter stated that he would first of all seek a permit from the Watershed District. William Nelson Anne Dorweiler explained the need for variances from 3 sections of the zoning code to allow Mr. Nelson to build a home at Independence Beach. Motion by Donald DesLauriers seconded by Robert Franklin to grant a side yard, front yard, and lot size variance to William Nelson, as suggested by the Zoning Administrator. Motion carried unanimously John Gullickson Plat Discussion of agreement and bond for road construction in connection with plat as instituted by John Gullickson and which Leo Lund has assumed. Motion by Arthur Theis, seconded by Donald DesLauriers to enter into development contract with Leo Lund. Motion carried unanimously 44$. HENNEPIN COUNTY PARK RESEEVE Ed Sorgatz of park reserve explained that weeds were being taken care of by park personnel, to everyones satisfaction. He also explained that there would be minor changes in Park Ordinances such as extension of curfew hours for snowmobilers and amounts of beer that may be brought into the park. 7. 7. PLANNER Motion by Robert Franklin, seconded by Donald DesLauriers to hire Tom Loucks as planner to present Comprehensive Plan to the Metropolitan Council. Motion carried unanimously 8. DOCKSIDE INN LICENSES Motion by Donald DesLauriers, seconded by William Reiser to grant an on_sale liquor license to William Coleman, dba as Dockside Inn, for 1976-77. Motion carried unanimously Motion by Arthur Theis, seconded by Robert Franklin to grant an Off -Sale liquor license to William Coleman, dba as Coleman's Dockside Inn. Motion carried unanimously Motion by Robert Franklin, seconded by Arthur T}-eis to grant a Sunday Liquor license to William Coleman, dba as Coleman's Dockside Inn. Motion carried unanimously Motion by William Reiser, seconded by Donald DesLauriers to grant an On -Sale, Off -Sale non - intoxicating malt liquor license to William Coleman, dba as Coleman's Dockside Inn. Motion carried unanimously Motion by Donald DesLauriers, seconded by Arthur Theis to grant a Dance permit to William Coleman, dba as Coleman's Dockside Inn. Motion carried unanimously 9. DISK AND STEIN LICENSES Motion by Arthur Theis, seconded by William Reiser to grant a non intoxicating, On and Off sale, malt liquor license to Disk and Stein (David Olson). Motion carried unanimously 10. HAMEL STREET DANCE Motion by Arthur Theis, seconded by Donald DesLauriers to approve a dance permit for North- west Chamber of Commerce and Harold Winterhalter to hold a street dance in Hamel on August 6th. Motion carried unanimously Motion by Arthur Theis, seconded by Robert Franklin to grant an On -Sale non -intoxicating malt liquor license for August 6th, to Northwest Suburban Chamber of Commerce and Harold Winter - halter. Motion carried unanimously 11. TRUCK BIDS Explanation by Donald DesLauriers that bid of Town's Edge Ford had been low bid on a 1975 truck as per specifications. Discussion of cost of having snow plowing equipment mounted on truck, also that it will cost approximately $1070. to install box from old truck, sand- blast and paint. Motion by Donald DesLauriers, seconded by Arthur Theis to award bid on 1975 Ford truck to Town's Edge Ford for $17,528.00, one-half of payment to be made on delivery and one-half in 12 months at 10% interest or from local bank if interest rate is lower. Motion carried unanimously 12. BROCKTON LANE BLACKTOPPING Three quotes were secured for blacktopping Brockton Lane from Hamel Road south to fire hydrant near Desen Dorweiler's. Buffalo Bituminous, 526 feet, $4052 or $18 per ton R1.17. 0and Carlson, " 3539.25 or $ 15.73 per ton H.ryJohnson " 4000 C. S. McCrossan, 600 " 3430 all quotes were 26 feet in width Motion by Robert Franklin, seconded by William Reiser to award quote for blacktopping Brockton Lane to C.S. McCrossan, 26 ft. x 600 ft. at $3430. Motion carried unanimously 11. SIGN ORDINANCE ADMINISTRATOR Matter tabled until July 20th meeting and will ask Emil Jubert if he is interested in being administrator. 12. PERA, RANDALL MAYER Motion by Robert Franklin, seconded by Donald DesLauriers to adopt Resolution # 76-24, regarding participation of Randall Mayer in PERA Police and Fire Fund. Motion carried unanimously 49 13. CITIZENS LEAGUE Sniff Motion by Robert Franklin, seconded by William Reiser to adopt Resolution # 76-25, concerning request that Citizens League include special assessment study in their annual tax burden study. Motion carried unanimously 14. BILLS Motion by William Reiser, seconded by Robert Franklin to pay the bills, Order Checks # 6091 - 6155 in the amount of $28,443.93 and Payroll # 4096 - 4123 in the amount of $6220.34. Motion carried unanimously 15. RENNEPIN COUNTY PURCHASING Discussion of savings that could be realized by entering into agreement with Hennepin County to purchase numerous items for the city. Motion by Robert Franklin, seconded by Donald DesLauriers to enter into Cooperative Purchasing Agreement with Hennepin County. Motion carried unanimously 16. GREGORY SMITH Motion by Robert Franklin, seconded by Donald DesLauriers to request that Greg Smith attend City Council meeting to determine whether or not he should have an additional assessment on his property at Independence Beach. Motion carried unanimously 17. H U D BLOCK GRANT FUNDS Motion by Robert Franklin, seconded by Arthur Theis to request that HUD allow the following breakdown of funds for the City of Medina: Implementation of the Medina Comprehensive Plan--$3000; Medina Morningside Park land acquisition-4 3000; Upgrading Hamel Municipal Well-410,457.
