Mayor Tyrell called the regular meeting of the City Council 2. to order at 7:30 p.m. Rev. Delwin Thigpen of the First Methodist Church, Woodruff and Golden West, gave the invoc- 3. ation following which Mayor Tyrell led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen- Beckley, Briggs, Harker, Merritt, Tyrell ABSENT: None ALSO PRESENT: City Attorney Martin, Public Works Director Pizzorno, Planning Director Dragicevich, Traffic Engineer Envall and City Manager Koski. 5. APPROVAL OF MINUTES: a. Regular meeting of December 6, 1966. Councilman Beckley moved to approve the minutes of the regular meeting of December 6, 1966, Councilman Briggs seconded, and the motion carried unanimously. b. Regular meeting of December 20, 1966. The minutes were corrected to include the words "because of no agenda" Following the phrase that .a "quorum was not in attendance ". Councilman Merritt moved to approve the minutes of the regular meeting of December 20, 1966, as corrected, Councilman Beckley seconded, and the motion carried unan- imously. UNFINISHED BUSINESS: 6. ORDINANCE NO. 66 -214: 2nd read. Amending Sections 6402.1 through 6L:.02.9 of the Temple City Municipal Code re Business License Rates. City Attorney Martin read title to Ordinance No. 66 -214 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 6402.1 THROUGH 6402.9 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO BUSINESS LICENSE RATES, and advised that there was no change for this, the second reading. Council- man Harker moved to waive further reading and adopt Ordin- ance 66 -214, Councilman Merritt seconded and the motion was unanimously carried. 7. ORDINANCE N0. 66 -215: 2nd read. relating to Separate Bus- inesses, i.e., utility services as related to Business License requirements. City Attorney Martin presented Ordinance No. 66 -215 for second reading, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 6301 and the FIRST PARAGRAPH OF SECTION 6309 (b) OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO BUSINESS LICENSES. Councilman Merritt moved to waive fur- ther reading and to adopt Ordinance 66 -215, Councilman Harker seconded, and the motion carried unanimously. PUBLIC HEARING; 7:30 p.m. APPEAL TO COUNCIL FROM DENIAL BY PLANNING COMMISSION, VARIANCE CASE NO. 66 -200, Res. #66- 232PC, 5615 North Noel Drive Mayor Tyrell declared the public hearing open. He explained that this is a zone variance case, which request had been denied by the Planning Commission decision on November 8, 1966. Planning Director Dragicevich presented a report on the action of the Planning Commission. The appeal to the Council was filed within the legal period allowed. Mr. Robert Sisson, counsel for Mrs, Rosalie Masciangelo, 5615 North Noel Drive, gave reasons for requesting a variance. Others speaking in favor of the variance were Mr. Carl Breuer, 5563 Noel Drive and Mrs. Frances Galasso, 9125 E. Duffy. 988 Council Minutes, January 3, 1967, Page 2 Opposing the variance were Mr. Horace Mason, 5615 N. Noel Drive; Mr. Jackson, 5628 1/2 N. Noel Drive; and Mrs. Louise Coppolino, 5641 Loma. City Attorney Martin advised that written protests had also been received from Mr. and Mrs. Robert Leak and Mr. and Mrs. Arthur Johnson. City Attorney Martin presented four criteria that must be met: 1) that the property is unique or different, 2) an unnecessary hard» ship was imposed on the property to have to comply, beyond that intended by ordinance, 3) no damage to neighborhood lit general, and 4) not prejudicial to general plan of develop- ment of City, and advised that the five comments provided by counsel for Mrs. Masciangelo were not germain to the criteria. He advised also that if pre - existing legal use under the county were established, it would not be germain to the granting of a variance. It was moved by Councilman Harker, seconded by Councilman Merritt that this portion of the Public Hearing be closed. Motion carried unanimously. It was moved by Councilman Harker that the matter be contin- ued to January 17, 1967, at 7:30 p.m. when information relative to the actual use of the property, the date the use took place and its conflict or non - conflict with existing ordinances of that time might be presented. The motion was seconded by Councilman Merritt and unanimously carried. PUBLIC HEARING: 7:30 p.m. APPLICATION FOR ENTERTAINMENT LICENSE: "Camellia Family Billiard Room ", 9055 Las Tunas Drive. Councilman Tyrell requested that he be excused from the discussion of th.Ls item because of a possible conflict of interest. Councilman Harker accepted the chairmanship and moved that the Public Hearing be opened, seconded by Councilman Merritt and unanimously carried. Sgt. Gilman of the Sheriff's office reported on the investigation of premises and applicant, Jos. Anthony Grillo, . 8906 Fortson Drive, San Gabriel, advising that nothing was disclosed that would warrant denial of the application. Speaking in favor of the applicant were John Naylor, Realtor; and Mr. Merle Kavanaugh, both representing Mr. Edwards, ovw'se of the property; and Mr. James Cleff, 5440 Quakertown, Woody land Hills, representing the Brunswick Company whose equip- ment was to be installed. Mr. Grillo, applicant, was present:. and answered questions relative to his application and the future conduct of the business. Mr. Lou Gilbertson, 9232 Sparklett, also spoke in favor of the application. Opposing the application for entertainment license were Minnie Storey, 9032 Elm Avenue; Mae Storey, 9032 Elm Avenue; Mrs. Brandt, 9044 E. Elm; Mr. Richter, 9036 E. Elm; Mr. Ray Burger, 5417 N. Sultana and Mrs. Jack, 5822 N. Sultana, who were concerned because of the proximity of their homes to the business. Motion by Mr. Briggs to close Public Hearing, seconded by Mr. Beckley and unanimously carried. City Attorney Martin summarized the discussion and explained that it was the burden of the Council that the license must be granted unless there was specific reason to deny. It was moved by Councilman Beckley that the 'application of Jos. Anthony Grillo, 8906 Fortson Drive, San Gabriel for entertainment license "Camellia Family Billiard Room ", 9055 Las Tunas Drive, Temple City, be granted. Motion was seconded by Councilman Merritt and carried by the following vote: AYES: Councilmen- Beckley, Harker, Merritt NOES: Councilmen - Briggs ABSTAINING: Councilmen-Tyrell PUBLIC HEARING: 7:30 p.m. Re Interim Classification of Properties heretofore annexed as to zoning, Extension of Ord. No. 66x19 Councilman Tyrell moved to open the public hearing, seconded and carried. City Attorney Martin presented ORDINANCE No. 67 -217, AN ORDINANCE OF THE CITY OF TEMPLE CITY EXTENDING ORDINANCE 989 Council Minutes, January 3, 1967, Page 3 No. 66 -193, Mayor Tyrell asked if anyone in the audience wished to speak for or against the Ordinance. No one came forward. It was moved by Councilman Merritt, seconded by Councilman Harker, that the Public Hearing be closed. Motion carried. City Attorney Martin presented Ordinance No. 67 -217 for first reading. Councilman Merritt moved to waive further reading of Ordinance No. 67 -217, Councilman Harker seconded. A roll call vote was taken and the motion carried unanimously. No further action was taken as this was the first reading of the ordinance. ORDINANCE NO. 66 -205, 2nd reading. City Atty. Martin presented Ord. No. 66 -205, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 801 AND 901 OF THE TEMPLE CITY ZONING CODE RELATING TO SERVICE STATIONS AND DRIVE -IN RESTAURANTS. Councilman Beckley moved to waive further reading and adopt, Councilman Briggs seconded, and the motion carried unanimously 9. ORDINANCE NO. 66 -206. 1st reading, relating to kennels, small animal hospitals, veterinary offices and T.C. Zoning Code. City Attorney Martin presented Ord. 66 -206, AN ORDINANCE OF THE CITY OF TEMPLE CiTY AMENDING SECTION 1001 OF THE TEMPLE CITY ZONING CODE (Kennels), and explained that the wording of the ordinance should be changed so as not to include structures other than kennels, such as the main house on the property. This considera- tion was discussed by the Councilmen who agreed that it had not been their intention that other structures should be included. City Atty. Martin presented Ord. No. 66 -206, as amended, for first reading. It was moved by Councilman Merritt, seconded by Councilman Harker, to waive further reading of Ord. No. 66 -206. Motion carried unanimously. No further action was taken as this was the first reading of Ord. No. 66 -206, as amended. City Atty. Martin then presented Ordinance No. 67 -218, an Ordi- nance to amend Ord. No.. 66 -206, AN ORDINANCE OF THE CiTY OF TEMPLE CiTY AMENDING SECTION 1001 OF THE TEMPLE CITY ZONING CODE (Kennels), which ordinance incorporated the above mentioned changes as to structures. It was moved by Councilman Merritt that further reading of Ord. No. 67218 be waived, and that it be adopted as an urgency measure. Motion was seconded by Council- man Briggs and was unanimously carried. NEW BUSINESS: 10. SET PUBLIC HEARING. Appeal from Planning Commission Decision, Variance Case #66 -203, Heath & Co., applicant, 9635 E. Las Tunas. Mayor Tyrell, with Council approval, set the Public Hearing for January 17, 1967, at 7 :30 p.m. in the Council Chambers, on the above appeal. 11. RESOLUTION NO. 67 -690: Re Legislation in support of law enforce- ment. The City Manager presented Reso. No. 67 -690, A RESOLUTION RE: LEGISLATION AFFECTING LAW ENFORCEMENT, supporting law enforcement agencies of Los Angeles County In their fight against crime. Councilman Beckley moved to adopt Resolution No. 67 -690, Council- man Merritt seconded, and the motion carried unanimously. 12. TRAFFIC COMMISSION RECOMMENDATIONS, DEC. 7, 1966 A. Item 5 - Lower Azusa Road between Arden Dr. & Pal Mal Ave. Recommended No Stopping at any Time" restrictions be placed on Lower Azusa Road between Arden Drive & Pal Mal Ave. in front of the Midway Shopping Center, with channelization movement for more effective use of Lower Azusa Road and pro- tected movement into Midway Shopping Center. Traffic Engi- neer Envall advised that the City of El Monte was cooperating in this restriction. Councilman Merritt moved approval of the recommendation, seconded by Councilman Harker and unanimously carried. 990 Council Minutes, January 3, 1967, Page 4 B. Item 6 - Muscatel `.venue & Hermosa Drive: Recomffi n e t at tig ter enforcement relative to excessive speeds on Muscatel Avenue be requested instead of four -way stop at this location; and remedial steps to include the relocation of existing "Stop" bar pave- ment markings on Hermosa Drive at west approach to Muscatel Avenue to a point 3 feet east of present loc- ation and placement of "Watch for Through Traffic" signs. Traffic Engineer Envall advised that these were interim recommendations pending further checks of the location relative to the request for a four -way stop. Motion by Councilman Beckley to approve recommendation, seconded by Councilman Briggs and unanimously carried. C. Item 10 - 9415 Las Tunas Drive: Recommended that a commercial vehicle loading zone be placed on the north side of Las Tunas in front of Temple City Bedding Company, with red curb to be removed and curb to be replaced to make solid curbing. Motion by Councilman Harker, seconded by Councilman Merritt to approve recommendation, unanimously carried. D. Item 8 - Lower Azusa Road and Alessandro: ecommen•e• a •rea in e center ine striping of Lower Azusa Road at Alessandro at the entrance of Miller Bros. Float Company. Traffic Engineer Envall advised that whether it was a dedicated street or not (and this was dedicated), it still is defined as a street and should have a break in the striping. Motion by Councilman Briggs to approve the recommendation, seconded by Councilman Merritt, and unanimously carried. E. Item 9 - Rosemead Boulevard: Recommended installation of time limit parking between 7 a.m. and 6 p.m., Sundays excepted, with signs and sign posting at the location of Main's :antiques, 5647 Rose- mead Boulevard. Traffic Engineer Envall advised that thi would complete the restricted area on both sides of Rosemead Boulevard from Las Tunas to Broadway. Motion by Councilman Merritt, seconded by Councilman Harker and unanimously carried that the recommendation be approved. F. 3- Wheeler Parking Vehicle: Recommended to continue to utilize the 3- wheeler parking vehicle from the Sheriff's Department on a 40 -hour week basis with every effort made to have the vehicle equipped with radio operated equipment, in lieu of the metermaid service. Following a discussion on the matter, Mayor Tyrell requested that the matter be placed on the agenda for study session on Thursday evening at 7:30 p.m. with the Traffic Commission invited for joint study on the matter. 13. RESOLUTION NO. 67 -691: appointing temporary employees, Rec- reation Department. City Manager Koski presented resolution No. 67 -691, A RESOL- UTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINT- ING TEMPORARY EMPLOYEES. Motion by Councilman Merritt, seconded by Councilman Beckley to adopt the resolution No. 67-691, and the-motion was unanimously carried. 14. RESOLUTION NO. 67 -692: Warrants & Demands City Manager Koski presented Resolution No. 67 -692 A RESOL- UTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $18,967.50, DEMAND NOS. 9005, 9006 & 9065 through 9138. Councilman Beckley moved to adopt Resolution No. 67 -692, Councilman Briggs seconded, and the motion was unanimously carried. 991 Council Minutes, January 3, 1967, Page 5 15. SET PUBLIC HEARINGS: a. Curb and gutter, north side of Garibaldi Ave., St. James to Oak Avenue, b. Sidewalk, north side of Garibaldi, St. James to Oak Ave. c. Curb and gutter, south side of Wooley Ave., Sultana to Livia d. Curb and gutter, south side of Le Rosa Ave., Agnes to Baldwin Avenue.' e, Curb and gutter, north side of La Rosa Ave,, Agnes to Baldwin Avenue. Public Works Director Pizzorno presented items a, b, c, d, and e, recommending that Public Hearings be set for Tuesday, January 17, 1967, at 7:30 p.m. Motion by Councilman Harker, seconded by Councilman Merritt that Public Hearings be set for Tuesday, January 17, 1967, at 7 :30 p.m, in the Council Chambers. Motion carried unanimously.. 16. COMMUNICATIONS: A. City Manager Koski presented a letter from the Temple City Baha i Community, urging the joining of the City Council of the City of Temple City in proclaiming the third Sunday of January 1967 as WORLD RELIGION DAY,togethrr with other governmental agencies throughout the United States. Councilman Merritt moved adoption of the Proclamation, setting Sunday, January 15, 1967, as WORLD RELIGION DAY, seconded by Councilman Briggs and the motion carried unanimously. 1 B. City Manager Koski presented a special notice from the Los Angeles County Division of the League of California Cities, and City Officials, advising that the regular meeting of the LosAngeles County Division of the League of California Cities set for January 5, 1967 had been cancelled. The notice also called attention to the regular meeting scheduled for January 19, 1967 to be held at the Santa Anita Race Track in Arcadia. Mayor Tyrell requested that councilman wishing to make reservations should do so through Mrs. Marj, Woodruff, Chief Deputy City Clerk. 17. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward, 16. MATTERS FROM CITY OFFICIALS: A. Councilman Merritt requested staff action on the following items: 1. A stop sign at the alley at Camellia, south of Las Tunas (behind Texaco station) was in need of maintenance. 2. An increased number-of vehicle violations involving improper use of one -way alleys, particularly on north side of Las Tunas between Temple City Boulevard and Camellia had been noted. B. Two items presented by Public Works Director Pizzorno, appraisal on Broadway construction, and the report on Baldwin Ave. construction scheduled for completion on January 6, 1967, were discussed briefly. Mr. Pizzorno advised that because of rains and certain other delays the contractor was requesting a time extension to January 13, 1967 for the Baldwin Avenue project. Motion by Councilman Harker to extend the time of the construc- tion on Baldwin Avenue to January 13, 1967 was seconded by Councilman Merritt and unanimously carried. Further discussion of the public works projects were referred to the adjourned meeting of the Council to be held on January 5, 1967, at 7:30 p.m. 992 1 1 1 Countil Minutes, January 3, 1 967, Page 6 C. Traffic Engineer Envall reported on the proposed re- construction of the island area at Temple City Bouleme rd and Ellis Lane, near the entrance of Miller Dial Company. He advised that trucks cannot properly make the turn to gain access to the property. A meeting is being arranged with Mr. Miller of Miller Dial Company to discuss the matter. Mayor Tyrell, with the consent of the Council, placed the matter in abeyance until Mr. Envall could meet with Mr. Miller on the problem. D. City Manager Koski called attention to the noon luncheon meeting scheduled for Wednesday, January 11, 1967 at the Hunter's Inn, when the members of the Council were to meet with Supervisor Bonelli, his field representative, and other county officials. E. City Manager Koski presented a request for modification of basement to separate air - conditioning unit from the working area where printing equipment was being placed, It has moved by Councilman Briggs, seconded by Councilman Merritt that the alterations be approved as outlined. Motion was unanimously carried. F. City Manager Koski presented a letter from the Building Contractor's Association protesting the adoption of the $35 flat fee for contractor's license. It was concurred by Council that a reply should be sent explaining the reason for the fee schedule. G. City Manager Koski presented a request from the Parks and Recreation Commission for a joint study session with the Council, with the suggested date of January 16, 1967. It was agreed by all present that the joint study session would be advantageous and should be so set. 19. ADJOURNMENT: Councilman Harker moved to adjourn the meeting to Thursday, January 5, 1967, at 7:30 p.m. Motion was seconded by Councilman Merritt and unanimously carried, adjourning the meeting at 10 :35 p.m. Next meeting of the Council is the adjourned meeting, Thursday, January 5, 1967, at 7:30 p.m. and next regular meeting to be held Tuesday, January 17, 1967 at 7:30 p.m., both in the Council Chambers of the City Hall, 5938 Kauffman Avenue, Temple City,' ATTEST: /f7 / „ City Clerk lb, 993
