Incorporate Disparity Study into CBA.1. Disparity Study incorporated as Section III of the CBA signed on December 4, 2013. Compliant 1. Recommend MSD stay with plans for conducting a Disparity Study update within five (5) years of the implementation of program changes (August 1, 2013) to ensure its Diversity Program is in alignmnet with current local market conditions. 2. Address 55 Recommendations of Disparity Study and report progress. 2. MSD has addressed and/or completed 52 of the 55 recommendations. Two of the remaining Recommendations, Expedited Subcontractor Payments and Publish Prime Contractor Payments, will be implemented with the MWBE Software. The last remaining Recommendation, Establishing a Direct Purchase Program, is under advisement for future consideration. Compliant 2. Within 6 months of CBA, MSD to establish program budget for training. Program evaluation to occur before end of FY2016. 1. Ordinance 13974 established program budget of $150,000 within 6 months through end of FY2016. Need to continue program will be evaluated prior to end of FY2016. Compliant 1. Bud Training Program continues through FY2017 (June 30, 2017). Recommend assessment of BUD Training Program prior to the end of 2016. 2. Collaboration in seeking additional Job Training funds through end of FY2016. 2. Included in scope of 3rd Party Monitor, Kwame agrees to identify opportunities for additional training funding to MSD and CBA Signatories. Compliant 2. MSD has tasked 3rd Party Monitor to seek out opportunities for available training funding through grants, collaborations with government agencies, community organizations and advocacy groups. Recommend CBA Signatories to collaborative with MSD on efforts to seek and secure additional job training funds from their perspective organizations. 3. Administration: MSD to select a Government funded Agency or RFP training program within 6 months. MSD to establish program reporting requirements. 3. MSD RFP 5474 Job Training Program issued June 2014. SLATE was selected to administer the Job Training Program in partnership with Building and Construction Trades Council of St Louis. MSD established initial Program Development and Implementation Plan to include program development, implementation, recruitment, outreach and scheduling. 1st MSD Bud Class held 4/13/15- 6/1/15; 6 Trainees; 3 Employed, 2 Seeking Employment; 1 Incomplete. Next class scheduled for 9/14/15. MSD Contractor requirements expanded as of 8/5/15 to use Bud Training for Good Faith Effort. Compliant 4. Recommend MSD add a website link on its Diversity website page directing applicants and contractors directly to SLATE's BUD Training Program. Recommend MSD and SLATE continue partnership to host quarterly Contractor Information Sessions for the BUD Program. MSD BUD Job Training Program (Section IV) 2 MSD Community Benefits Agreement Compliance Scorecard CBA Sections CBA Target Objectives MSD Actions Scorecard Rating Recommendations 1. Within 6 months of CBA, MSD to establish budget for a FSH program with an established Government funded training agency or issue RFP. Re- evaluation to occur by June 30, 2016. Program requires establishment of eligibility listing, contractor participation and incorporation into MSD CIRP Program as a contract requirement. 1. Ordinance 13730, adopted October 10, 2013, established SLATE to administer FSH Program with an annual budget of $150,000 within 6 months of CBA (effective through end of FY2016). Prior to June 30, 2016, re-evaluation of the program will take place. Contract requires program development and implementation phases with the established government funded agency (SLATE). Compliant No further recommendations 2. During the life of the CBA, MSD to require participation in the FSH Program on all CIRP contracts awarded after CBA. MSD to establish program reporting requirements. 2. MSD updated Diversity Program requirements effective on Oct. 1 2014, to establish contractor participation in the FSH Program. MSD increased Diversity staff to effectively establish and monitor CBA programs and effectively monitor CIRP contracts for compliance with all diversity requirements. Compliant 2. Program established initial eligibility listings. MSD incorporated FSH Program as part of the Diversity Program requirements for contractors beginning Oct 2014. Contractor requirements expanded as of 8/5/15 to use FSH for Good Faith Effort.Compliant 3. Recommend MSD and SLATE enhance the current reporting and tracking systems for updating and reporting MSD's contractor performance under the program and applicant's referral status in a timely manner. Recommend SLATE update the eligibility list monthly. Recommend MSD partner with SLATE to host quarterly contractor information sessions for the FSH Program. MSD to update it's Diversity Program to be in alignment with Disparity Study results and address recommendations as a result of the Disparity Study. 1. MSD adopted goal recommendations of the Disparity Study into its Diversity Program effective as of August 1, 2013. MSD immediately began consideration and actions to address the 55 recommendations as a result of the study. Compliant No further recommendations 2. MBE/WBE Utilization: Conduct outreach to MWBEs, include MWBEs and relevant business organizations in pre-bid conferences, unbundling, funding and capacity building activities, all of which promotes non-discrimination of M/WBE's. 2. MSD has a targeted outreach plan which promotes utilization of MWBEs. Primes are required to focus on MWBE participation of M/WBE's by meeting Diversity goal requirements in pre-award, during contract performance and upon contract completion and are evaluated during each of these contract phases to ensure compliance. Diversity program requirements are a component of all pre-bids held. MSD Small Contractor Program focuses on M/WBE utilization by providing more bidding opportunities and relaxed bonding requirements on projects under $25,000. MSD monitors and evaluates M/WBE participation in initial bidding and final contract stages of CIRP Program projects. Evaluation requirements were expanded as of 8/5/15 to include evaluation of workforce in final evaluations and annual contractor renewal evaluation processes. Compliant 2. Recommdnd MSD locate and participate with more professional organizations involving women and minorities to promote continued growth in participation on it's CIRP professional services and construction projects. 3. Low Interest Loan Program 3. MSD Ordinance No. 13857 authorized MSD participation in the Contractor Loan Fund Program with an investment of $250,000. The program was launched May 27, 2015. Compliant 3. Recommend MSD to reinvest any profits recognized from the Contractor Loan Fund Program back into the program should the program prove to be beneficial to increasing the capacity and participation of M/WBE's. Develop education and internship program in conjunction with public schools within MSD service area. Program to introduce the work of MSD through tours and internships at MSD facilities. 1. MSD participated in three educational/internship opportunities which facilitated participation from students from publis schools within MSD's service areas: St. Louis Internship Program, SIUE ERTC Program, and MSD's DEC educational programs such as Enviroscape. 3 high school Interns did 8 week internships at MSD ($7,200); 4 $3500 Scholarships ($14,000) for the 2015/2016 ERTC Program to four low income minority males of the MSD service area; MSD DEC has outreach activities scheduled for 2015/16 school year which involves SLPS and other public school of the MSD service area. Compliant 1. Recommend MSD re-introduce facility tours as an educational component to increase awareness of MSD within public schools of the MSD service area. 2. Continue community education efforts desiged to inform public about various activities such as those with SLPS. Education will include prospective career opportunities arising out of various programs. 2. MSD agrees to further pursue opportunities for collaboration within SLPS utilizing its current DEC programs such as Enviroscape. Compliant 2. Recommend MSD to expand DEC's outreach of educational programs such as the EnviroScape Program to include all public schools in its service area. MSD to comply with MO Prevailing Wage Law (MPWL) and the MSD Charter Plan. MSD shall apply to all contracts the St Louis Living Wage Ordinance to cover occupations not covered by MPWL. 1. MSD presented Resolution 3116 to its Board of Trustees on 11/14/13 to adopt the St Louis Living Wage Ordinance as a contract requirement on MSD CIRP projects. Form CBA Monitoring Oversight Committee with 3 selected by MSD and 3 selected by Signatories. Committee to meet quarterly to report on progress of compliance with CBA terms focusing on Job Training, First Source Hiring, MBE/WBE participation and workforce inclusion. 1. Monitoring Oversight Committee established on January 29, 2014 consisting of 3 Signatories and 3 MSD Staff. MSD began quarterly reporting of compliance with CBA May, 2014.Compliant No further recommendations 2. MSD to ensure all aspects of CBA are effectively monitored by MSD's in-house staff and/or Independent 3rd Party Monitor. MSD to start RFP selection process for an Independent 3rd Party Monitor within 6 months and establish budget. 2. Upon execution of CBA, MSD established monitoring and reporting of compliance with CBA in May, 2014 by it's in-house Diversity staff. MSD consulted with CBA signatories to develop a scope of services for the RFP 5473 selection process for an Independent 3rd Party Monitor. In RFP process, Kwame Building Group was selected as 3rd Party Monitoring Consultant to perform through June 30, 2016. Compliant No further recommendations 3.
