HomeMy Public PortalAbout23-03-28 Order: Alternative Procedure for Disposing of Abandoned Funds Watertown City Council ?, Administration Building 149 Main Street Watertown, MA 02472 ELEC I ED OFFICIALS: Phone: 617-972-6470 Mark S.Sideris, Order# l 1(J 2023 -0- /r0 Council President Vincent J.Picci>illi,jr., AN ORDER ACCEPTING THE PROVISIONS OF G.L. c.200A, §9A Vice President& REGARDING AN ALTERNATIVE PROCEDURE FOR DISPOSING OF District C Councilor ABANDONED FUNDS HELD IN THE CUSTODY OF THE CITY John M.Airasian, WHEREAS: at various times the City undertakes custody of funds of corporations, Councilor At Large organizations,beneficiaries or persons; and Caroline Bays, Councilor At Large WHEREAS: such funds, including uncashed overpayments,refunds, and unpaid wages, among others, may be unclaimed by the entity or individual entitled thereto and John G.Gannon, may be deemed abandoned if the owner or owners thereof cannot be located; and Councilor At Large Anthony Palomba, WHEREAS: the provisions of G.L. c. 200A allow for an extensive procedure for the Councilor At Large processing of funds unclaimed and ultimately deemed abandoned by the entity or individual entitled thereto, including notice,reporting to the Treasurer of the Nicole Gardner, Commonwealth, and a three-year waiting period; and District A Councilor Lisa J.Feltner, WHEREAS: the provisions of G.L. c. 200A, §9A provide an alternative procedure to District B Councilor address disposition of abandoned funds held in the custody of the City; and Emily Izzo, WHEREAS: such alternative process provides for appropriate notices to be issued to District D Councilor the entity or individual entitled thereto,with such funds, if remaining unclaimed and so deemed abandoned,to be placed in the City's Treasury to become available to the City; and WHEREAS: the provisions of G.L. c. 200A, §9A are subject to local acceptance by vote of the City Council pursuant to G.L. c. 4, §4. NOW THEREFORE BE IT ORDERED: That the provisions of G.L. c. 200A, §9A are hereby accepted,providing an alternative procedure to address disposition of abandoned funds held in the custody of the City.
