HomeMy Public PortalAbout11 November 16, 1971 TC Minutes• TOWN OF YARROW POINT The regular meeting of the council of the Town of Yarrow Point was held on November 16, 1971 at 8:00 P. M. at the Town office, 470S 91st Avenue N. E., Yarrow Point. Those in attendance were Richard K. Sandaas, Mayor; Councilmen Clark Phillips, Robert Brett, Minor Lile; Engineer Alan Newbill, Chief Albert Anglin, Mrs. Stabler and a gentlemen with her, Mr. and Mrs. Brevik, Robert Raitz and Lorraine Diede. Arthur Hitchings was also in attendance. The meeting was called to order by the Mayor. Discussion took place on the minutes of the previous meeting. The following corrections were noted: 1. The name of the company hired to do the work on the Hansen-Cruver drainage problem is Trico Construction, Inc., not Tri Co. 2. The work was "remove the existing grass and install 2' thickened edge on the west side of Mrs. Robert's driveway, etc." 3. The motion to do this work was not passed unanimously - Robert Brett voted against it. 4. Alan Newbill was added to the list of those in attendance at the 10/19/71 council meeting. A motion was then made to accept the minutes, seconded by Clark Phillips and passed unanimously. 3. Police Report. Chief Anglin reviewed the report presented. Discussion. Chief Anglin stated that a letter had been received from Judge Wartnik continuing to allow Chief Anglin to prosecute unless there is legislative change in the future. approval had been granted He stated that/the police officers of Medina-x to be given a 5.5% pay raise in 1971. Parking on rights of way will continue to be surveyed. Mention was made the the contract for 1972 between Medina and Yarrow Point for police services will be mewritten in regard to boat patrol. 4. Robert Raitz - interest in obtaining commercial activity permit. 'EMT. Raitz stated he had determined that no state license is necessary for day care under 4 hours. He and his wife intend to conduct 2% hours in the a. m. and 2k hours in the afternoon. State legislation does not apply to them." (In checking with the licensing department - they state that no license would be required by Mr. Raitz since no child will remain an the premises at any one time over 4 hours for educational u oses. If this was a childm-caring or baby-sitting service - a license would be needed no matter how long the child was there).Anyi 0 Page 2 - Minutes of Council. meeting 11/16/71 Mr. Raitz stated that he had discussed.the matter with his one neighbor and that neighbor did not indicate what he thought - pro or con. Mr. Brett suggested granting such a permit by motion Minor File stated that there should be assurance that no liability would be incurred by the Town It was suggested that Mr. Raitz check with the Fire Marshal Clark Phillips voted to withhold his vote until the Town Attorney had been contacted in regard to possibility of liability by Town. The Council suggested to Mr. Raitz that when his plans are resolved he present his request in writing indicating contact with the Fire Marshal, designating the activity, hours and number of children, supervision, etc. 5. Treasurer's Re ort was discussed 6. Engineer's lbport 1. Pool of water on N. F. 47thStreet to be checked by Alan 2. fie reported three Towns (Hunts. Point, Clyde Hill, Yarrow Point+)) have written a letter to Huntly W. Grant, State Aid Engineer of District #7 in regard. to Points Drive and proposed federal Aid. Another letter was written to the Puget Sound Governmental. Conference who acts as a clearning house for such Federal Aid projects. The .breakdown on the prospectus, -;submitted in regard to source of funds is as follows:.Federal $173,390 State $80,650 Local $8,97,0 3. Drainage ordinance to be pursued. 7. Side Line Boundaries '- The Mayor stated that this matter is going rather slowly at the moment. It appears some people do not want to pay a share of costs - It is a legal problem and John Roberts is checking Hiram Patterson has indicated he might want to sell his property. Side line boundary matter explained to Mr. Brevik. Discussion. 8. England Road - Court Case continued until 12/9/71 9. Petition to vacate N. E. 42nd Place dated October 19, 1971. Notice of hearing posted 10 28 71 accor ing to RCW 35-79-020. A hearing as per Resolution #98.passed at the October 19th meeting of the Council was held. Discussion. There was no opposition from anyone in attendancev Proposed Ordinance #175 entitled "An Ordinance approvirig the vacation of N.E. 42nd Place" was discussed. After discussion, a motion was made by Robert Brett, seconded by Clark Phillips and passed unanimously to adopt this ordinance. (Over) * nor from any one in writing At the June 20, 1967 council meeting Arthur Granberg and Walter Stabler asked . that the council consider correcting an error, in their opinion, which appeared on the final linen of Morningview Plat. The error, they stated, was that the wording Eeducated to the public forever, etc.".was included when it had been understood from the time -the plat was first.presented.for approval..that..the road would be an easement road only. Easement documents had been signed by the owners -and accepted by the Town. The Town of Yarrow Point acknowledged to Arthur Granberg and Walter Stabler by letter dated 7/5/67 that the Town would -consider a petition to vacate N. E. 42nd Place in exchange for an easement providing that all costs of the vacation proceedings and necessary recording fees would be paid by the owners of Morningview Plat. 0 0 Page 3 - Minutes of Council meeting 11/16/71 10. Budget for 1971. Reviewed again in detail. Fire & Library costs discussed, briefly - as per letter from L. Joe Miller, City Manager of Bellevue Information presented on the Public Employees Retirement System for the benefit of the Council in their determination of the Town's participation 1. In January 1972 Statewide City Employees Retirement system will merge with Public Employees Retirement System 2. Whatever the employee pays in - that money gathers interest and is always paid back - to the employee or their beneficiary - even though you drop out before the retirement period arrives. 3. What the employer pays in to it is not refundable --.goes to benefit others 4. All employees must belong if they work more than 70 hours per month This would include future employees 5. Council would pass Resolution 6. If the employee leaves the employ in say _ 2 years - he or she could draw out their investment plus interest - and that would end it or they could choose to leave it in until the employee was 60 and neither the Town or the former employee would pay additional - except the Town would have to continue to pay the $13.32 approx. arrears per month for a total. of 180 months. At age 60.an employee is guaranteed a minimum of $130.00 per month - if they continue working until that time. benefits from 7. Annuity what the employee pays in 11. 8. Dr. Milton Freeman as a fourth memb�rrof the._B©ardiof Adjustment The Council confirmed the above -mentioned appointments 12. New Business Richard Sandaas read a letter received from L. Joe Miller in regard to the purchase of Yarrow Bay for a proposed park site. 13.
