Present: Mayor, Thomas Anderson; Councilmembers, Sarah Lutz, William Reiser, Thomas Crosby, Wilfred Scherer; Clerk -Treasurer, Donna Roehl; Planning and Zoning Director, JoEllen Hurr; Police Chief, Charles Hoover; Public Works Director, Ron Duran; Engineer, Dave Hansing; Attorney, Richard Schieffer 1. ADDITIONAL AGENDA ITEMS Council agreed to discuss the following items: Botnan Subdivision 2. MINUTES OF JUNE 16, 1981 Motion by Reiser, seconded by Scherer to approve minutes of June 16, 1981, as presented. Motion declared carried 3. MINUTES OF JUNE 23, 1981 Motion by Reiser, seconded by Scherer to approve minutes of June 23, 1981, as presented. Motion declared carried 4. PUBLIC WORKS DEPARTMENT Independence Beach Lift Station Repair Ron Duran presented quote from Tri State Drilling for $4647. to replace two grinder pumps in the Independence Beach lift station on Lakeshore Ave. He stated that existing pumps cannot be replaced as they are obsolete and there have been numerous outages at that site since the lift station was installed in 1975• Motion by Reiser, seconded by Scherer to purchase two grinder pumps and control panel for $3819 plus additional installation costs for a total of $4647. Motion declared carried Hunter Farms Park Ron Duran presented quotes for trees and planting for Hunter Farms park according to plans included in cities Comprehensive Plan. Quotes were as follows: Dundee Nursery, $7196; Sutherland Nursery, $6852. Council -suggested getting quotes from Midland Nursery and Steve Hancock. Motion by Scherer, seconded by Crosby to table the matter until July -21st. Motion declared carried 5. POLICE DEPARTMENT Organization Discussion of hiring Karen Olson to prepare job descriptions and goals and objectives at a cost of $47.00 per hour, not to exceed $1000. Discussion of the need for schedule revisions and additional officers and the possibility of the city developing goals and objectives and Karen Olson writing job descriptions for patrolmen and director. William Reiser stated that he would call a meeting to develop goals and objectives. Motion by Scherer, seconded by Lutz to hire Karen Olson to prepare job descriptions at a cost not to exceed $1000. Motion declared carried \� Hennepin County Dispatching Charges Charles Hoover presented letter from Hennepin County regarding charges that will be assessed cities for police calls beginning in 1983. 6. PLANNING AND ZONING DEPARTMENT Dockside, Preliminary Plat, Public Hearing, 8:00 P.M. JoEllen Hurr read Public Hearing Notice. Dave Hansing presented following comparisons of development plans with criteria set forth by City Council: Lakeshore setbacks, number of units, hardcover, setbacks fromCo. Rd. 19 and Lakeshore Ave. and Land use (Multi -family) meet criteria. Size of units and fence placement do not comply. He stated that approval from Hennepin County and the Park Reserve District will be needed,wu°L for grading, utility easements and storm sewer and that a sea wall will need to be con- structed. Letter from Pioneer Creek Watershed District indicates that erosion protection should be provided during construction and an earthen berm needs to be constructed along the lake during construction of buildings. Fran Hagen of Westwood Planners stated that restrictive covenants can handle the 17,000 sq.ft. unit size requirements and that they caon provide for the concerns of the Watershed District. Robert Franklin stated that due to the fact that there is less area available, than originally thought, the hardcover and unit size should be reduced. Mr. Hagen stated that by using the high water level as set by the DNR some land area has been gained, perhaps 4 - 6 ft. along the lake. Robert Ludwig asked if the additional units that are planned could be accomodated by the sewer and water system. Thomas Anderson stated that more use of the systems is needed to make the system work more efficiently and that seven assessment units were charged against the property when assessed. Mr. Ludwig stated that there have been problems with the water and sewer systems since they were put into operation either because of poor management or over -use. Thomas Crosby stated that not enough use of the systems has caused problems in the area. Robert Franklin stated that sufficient parking and drive area is not provided. Mr. itagen stated that 3 - 4 spaces per unit are provided. Robert Linkenheil stated that the property is very fragile and the plan has to much hardcover. Consideration should be given to changing guidelines because land area has been reduced. Reuben Fries stated that there are problems with surveying lots in the area and perhaps there is not as much land area ash shown on the map. Dick Wulff stated that density is to great and property should comply with density of lots to the west. Allowing more than six units would be irresponsible. Robert Franklin asked hbr Council intended to steal with the plan in view of the fact that plan does not meet guidelines. Thomas Crosby explained that plans are very near Council criteria if the ,square footage had remained as originally calculated. Mr. Hagen stated that they had followed the March 27th letter sent to them by the cities attorney. Howard Weller asked what type of business would be allowed on the property under present commercial zoning. Thomas Crosby stated that many types of businesses are allowed undercommercialzoning, and that residential is the best use of the property with present utility system being able to serve the proposed 10 units. The most important items that need to be addressed are density and environment protection. Motion by Reiser, seconded by Crosby to close the Public Hearing. Motion declared carried Public Hearing closed at 9:45 P.M. William Reiser stated that project should be denied because guidelines have not been met. Thomas Crosby asked attorney to elaborate on procedures if project were denied. Richard Schieffer stated that a new applicationwould be dealt with under new ordinances and townhouse criteria would allow 14 units. Thomas Crosby suggested that engineers and attorney meet to determine if developer can meet hardcover requirement based on acreage decrease, consideration should be given to Robert Franklin's letter and Richard Schieffer's March 27th letter. He also asked that Indepen- dence Beach residents be given results of meeting for their review. Motion by Crosby, seconded by Scherer to table the matter until meeting between engineers, attorneys and other interested parties has been held and matters resolved. Motion declared carried 2 4 Albert Jewell, Variance JoEllen Hurr reviewed Planning Commission recommendation to grant a setback variance to Albert Jewell to construct a 3 car garage at 4792 Sycamore Ave. Motion by Reiser, seconded by Crosby to approve a 20 ft. front yard setback and an 18 ft. side yard setback variance to Albert Jewell to construct an attached 3 car garage on Lot 19 Block 1, Independence Heights Third Addition. Motion declared carried Accoustical Floors Dave Hansing explained that there were problems with drainage, grading and sewer plans that had been submitted for the Accoustical Floors building on Lots 4 and 5, Medina Creekside. Motion by Crosby, seconded by Lutz to table action on the Accoustical Floors Conditional Use Permit application pending approval of engineer. Motion declared carried Berthiaume/Weed Lot Line Rearrangement JoEllen Hurr explained that letter signed by property owners on Blackfoot Tr. does not add- ress the fact that a parcel of land less than 5 acres has been created which is not allowed under the existing development agreement unless Blackfoot Tr. were to be blacktopped, Motion by Scherer, seconded by Lutz to authorize preparation of an amendment to letter not- ing the undersized parcel which is to be resigned by property owners. Motion declared carried 7. ML'DINA MORNINGSIDE SEWER./WATER Discussion of easements that need to be signed. Richard Schieffer stated that he could contact Fred Keller. Thomas Anderson stated that consideration should be given to ser- vicing Mr. Keller's property with city water. Richard Schieffer reported that Marlon Haugen contacted him regarding payment for the water system. He stated that he would discuss the payment of interest and the problems that have developed with the wells, with Mr. Haugen. Dave Hansing reported that approval of the sewer installation plans should be received shortly from PCA and advertizing for bids could then begin. Motion by Lutz, seconded by Scherer to authorize preparation of a resolution ordering that bids be taken for installation of sanitary and storm sewer and street restoration in the Medina Morningside area. Motion declared carried 8. WILLIAM BOTNAN SUBDiviSION Discussion of property divisions similar to Mr. Botnans' where a road is a natural property divider. JoEllen Harr stated that criteria would need to be written covering areas that would need compliance before approving a large lot division without handling according to subdivision regulations. Richard Schieffer stated that the definition of a "Lot of Record," in the subdivision reg- ulations could be revised to include such criteria. JoEllen Hurr reported that Mr. Botnan would be applying for his division according to the existing subdivision regulations. 9. CHARLES PANGIER Marilyn Pangier presented pictures of several junk areas of Independence Beach and asked that something be done to clean up the area. She also requested that all ordinances of the city be enforced. Discussion of other areas of accumulated junk in the city. Council instructed the Police Department and Zoning Administrator to begin work on the problem immediately. Chief Hoover stated that he could issue warnings and if not taken care of within 10 days a citation could be issued. 10. PERSONNEL POLICY Council asked that attorney review personnel policy, as soon as possible. 11. PARK COMMISSION Mayor Anderson appointed Anne Heideman chairman of the Park Commission. Anne Heideman stated that she would call a meeting of the existing committee and asked if ' there were other interested residents that may want to serve on the commission. She also stated that she would work with Ron Duran on the development of the Hunter Farms park. 12. CONSENT AGENDA Hamel Athletic Club Agreement Motion by Reiser, seconded by Crosby to enter into agreement with the Hamel Athletic Club to provide recreation services at a cost of $1500 for 1981. Motion declared carried Suburban Community Services Motion by Reiser, seconded by Crosby to enter into agreement with Suburban Community Ser- vices to provide the services of a coordinator to assist the Hamel Senior Citizens Club at a cost of $425. Motion declared carried 13. BILLS Motion by Reiser, seconded by Crosby to pay the bills; Order Checks # 9578-9647 in the amount of $75,070.75 and Payroll Checks # 6274-6302 in the amount of $11,900.51. Motion declared carried 14. CABTE TV Thomas Anderson reviewed Cable TV process and the fact that bidder receiving the franchise will pay all of the review expenses incurred during franchising process. 15. NORTH - SOUTH ROAD Thomas Anderson reported on meeting among Hennepin County personnel, Wilfred Scherer, JoEllen Burr, Donna Roehl and himself regarding realignment of Co. Rd. l9 near Baker Park and a north -south road through Yedina.. He stated that Co. Rd. 19 plans appear to be adequate and plans for a north -south road will be drawn and returned within a few months. He explained that they favor Willow Dr, as a route south of Co. Rd. 24; that normally acquisition of right-of-way and base work is done by a municipality with the county doing the blacktopping.
