An Order Relative to an Amendment of a Temporary Construction Easement
Agreement relative to Properties at 204 Arsenal Street and 85 Walnut Street
among Watertown Gables LLC; BP3-BOS4 250 Arsenal Place LLC and the City of
Watertown and Authorizing the City Manager to Execute the Amendment of the
Temporary Construction Easement Agreement on Behalf of the City.
WHEREAS, BP3-BOS4 250 Arsenal Place LLC, as successor-by-name-change to
BP3-BOS4 85 Walnut Street LLC is developing property located at 85 Walnut Street;
and
WHEREAS, Watertown Gables LLC owns contiguous property, located at 204 Arsenal
Street; and
WHEREAS, BP3-BOS4 85 Walnut Street LLC, Watertown Gables LLC and the City
entered into a certain Temporary Construction Easement Agreement, dated as of June
30, 2021, recorded with the Middlesex South Registry of Deeds in Book 78198, Page
300 pursuant to which a pedestrian path, known as the Birch Road Pedestrian Path,
would be constructed and connected to other publicly accessible pedestrian paths; and
WHEREAS, in the course of construction, a portion of the pedestrian path has been
relocated, and Exhibit D to the Temporary Construction Easement Agreement needs to
be amended.
NOW THEREFORE BE IT ORDERED: That the City Council agrees, in connection
with the relocation of the Birch Road Pedestrian Path, to the Amendment of the
Temporary Construction Easement Agreement affecting the properties of BP3-BOS4
250 Arsenal Place LLC at 85 Walnut Street and the property of Watertown Gables LLC
at 204 Arsenal Street.
AND FURTHER, that the City Council hereby authorizes the City Manager to execute
an Amendment to the Temporary Construction Easement Agreement on behalf of the
City.
